the drug war is unconstitutional.
if they want to make any drug illegal congress must first pass a constitutional amendment to take that right away. then that amendment has to be ratified by 3/4 of the states just like they had to do when they made alcohol illegal with the 18th amendment.

fed law only supersedes state law if the states are in violation of the constitution. :wallbash:

bottom line, bushs drug war is just as unconstitutional as obamas drug war. however obama is much better than bush on states rights when it comes to medical marijuana .
 
Not sure if you know this but Obama is the Drug Czar's boss... so anything the Czar says essentially it comes from Obama's policies.

I hope you liberals are happy for what you voted for in office. At least Bush was upfront that he was an asshole.:woohoo::2cents:

bush lied. in 1999/2000 bush said he supported states rights when it comes to mmj. to bad he flip flopped.

I think you guys relay too much on the Obama farse.
By this, I mean that the problem is not Obama, but those behind him.
Obama is just a puppet like Bush was and also 'Clingon'.
I wish there was this machine who could give you all the truth. First thing I'd ask would be 'how many people CHANGEd their toughts about Obama after he was elected?'

and my final question, not directed to the machine, but to you guys,

how does the kush.ca staff feels about their 'Obonga' campaign now that according to Gil Kerlikowske, Cannabis has no medical value?

Interpret this as you want, but for me it's another wake up call.

Vote Ron Paul 2012 (or Jesse Ventura if he runs.).

He changed his mind. Like everything else. Obama can hire/fire a member of the cabinet at any time. He is going with these statements if he does not show otherwise.

true true. i read somewhere that obama took away some of the cabinet level power of the drug czar.
bush made the drug czar a cabinet level position for the first time in history.

The argument shouldnt be "this substance is illegal, lets try to prove that is beneficial so it has to become legal", the argument should be "Justify why this law exists, if the drug causes no harm, why is it worth locking people up over?"

Driving a car is not medicinally beneficial either.

You've obviously never been to the White House, at least since the early 1960s. You don't get on the lawn without being vetted by the Secret Service. Hell, they closed the public street in front of the White House after 2001 totally screwing 10s of thousands of commuters every working day. You know the annual Easter Egg hunt? Want to take your kids for that next year? You better apply now to have any hope of being approved.

Just make a backross of any of there 9 patented varities and suddenly you have a new, non patented variety.

Not if they license the seeds, and as part of the license say you can't breed them. Monsanto does that with corn. Oh yeah, as part of the license you grant them permission to come on your property and take DNA samples if they want to do so.

Google "roundup ready" monsanto corn license and see what they can do with patents and plants. Anyone who thinks that it can't be done is just fooling themselves.

It's just a figure of speech really. I know you cant go on the president's lawn. :) I still think we need to get a million stoned ass marchers together in the area, and march to the white house. Clog the streets in front of the supreme court, congress, and the white house with a million people in shifts, until the government to listens to the people and. Technically we should march against the whole drug war. We wouldn't actually have to march that long. just bring some lawn chairs and blankets and we can sit down and protest.... passing huge joints around

I really dont think there is any other way these assholes are gonna get the point, that the people want weed until we force it down there throat with massive protest

Great in principle but how long before the stormtroopers come rushing to break up the "disturbance" with tazers, tear gas and riot gear? I see it all the time already. Non-violent protest quickly turns into cops beating on people and then the news calls the protestors the instigators. Those in power have no respect for the people nor the Constitution. We're running out of options here people!

then we will show a peaceful demonstration being manhandled and bullied by an overzealous police force. If we can create a link in the minds of those who are on the fence about legalization, and get those being abused at the rally to not respond in anyway there is a sense of compassion that starts to breed in the mind of the people.

Already enough people are starting to realize how ridiculous the laws are. Now if we can show how they react in an overzealous way, there could be a wave of sympathy and stronger convictions in the average citizen to put a stop to it. The biggest problem would be getting the people being abused by the police force to just "take one for the team" and not retaliate by cussing, fighting back, resisting, or throwing things.

Lets say one of their patents is for NL5 X SK1.. That doesn't mean you can't grow, sell or license NL5 pure or any other NL5 cross or even SK1 pure or any other SK1 cross it just means you can't grow their particular pheno NL5 crossed with their pheno SK1.

If they are claiming anything above that then that would be reaching in terms of a patent IMO.

There are many SK1's out there do to the percentages of there ancestors so it's just rubbish to say that if they hold a patent on a particular pheno of say SK1 that ALL versions of SK1 would be patented.

I'm glad you brought up monsanto and the genetic testing because genetic testing is EXACTLY what will distinguish your pheno from their. (live by the sword, die by the sword)

ONLY clones have identical genes, EVERYTHING else has only one unique genetic footprint and thus only that particular gentic footprint can be patented.

It would be absurd for patent lawyers to conclude anything else.

But you can live without the 9 varitietes they hold patents to.

That's my point, many different crosses work equally well for certain ailments so just because one is patented doesn't mean the other 999 varieties out there won't work.

IOW, you can't really corner the market on cannabis in terms of strains because all have there pros and cons and there are literally thousands of strains, not just 9.

My post to BlueDot was in response to his claim that one could just cross breed the patent holder's pheno, now he's changed that.

One can certainly grow corn without buying Monsanto corn. But there is obviously some reason why farmers want that particular set of genetics over all the heirloom varieties that they could plant without the hassle that Monsanto requires you agree to in order to grow theirs. It is so in demand that they agree to allow Monsanto reps come on their land at their pleasure and take samples of their crop, without prior notice or permission other than the license, as well as agreeing not to grow a seed stock for next year. People already pay more for certain phenos in the cannabis seed market without any patents involved.

I love this drug czar!

I am becoming a huge fan of Gus Kerlikowske.

But, you say, how can that be? Kerlikowske opposes marijuana legalization.

Of course he does. He's the drug czar and required to by law.

It's the way he does it -- so deliciously ridiculous.

"Legalization is not in the president's vocabulary, and it's not in mine," he said. [...]

"Marijuana is dangerous and has no medicinal benefit," Kerlikowske said in downtown Fresno ...

This is pure gold. He said this in California! "Marijuana has no medicinal benefit." In California where everybody knows somebody who is benefitting medicinally from marijuana.

You see, our old drug czar would have attacked this with subterfuge. He would have said something like "The FDA and other legitimate medical organizations will never accept smoked drugs as medicine. We have to turn to medical professionals for the proper development of drugs from cannabis, with properly controlled doses, not the false and damaging hope of a dangerous smoked drug just because it makes people feel good. What message are we sending to the children?" And some people would have nodded and thought that sounded reasonable.

Not Kerlikowske. He goes into California and says that marijuana has no medicinal benefit. Well nobody really believes that anymore -- even the hard core drug warriors out there are trying to convince people that other existing drugs provide the same or better benefit as marijuana. By claiming no medicinal value, Kerlikowske looks like a doofus, and by extension, so does the entire U.S. marijuana policy.

And that 'legalization not in his vocabulary' business, over and over again -- more fabulous stuff. It sounds stupid and totally childish. And not just to us.

Of course, we need to ridicule him for this and take advantage of it. Point out the Emperor's New Clothes. But this is easy stuff. And we can make it work for us.

When it comes to marijuana, I love Gus.

However, that does not mean that I'm sold on him as drug czar in all areas. Not in the least. I'm very concerned with the damage that he may cause in the area of prescription drugs -- he's really big on pushing the abuse/overdose messages there (it seems to be a personal agenda for him) and I worry that the government may go even further overboard in terms of making it hard for doctors to prescribe what is necessary for pain management.

But today, he's making me smile.
