Just got pulled over by a cop while carrying freshly picked marijuana.

when he said "i could tackle you, handcuff you and take them from you" I would have said. "oh? Lets see it. I'm a cage fighter by the way." lol probalby would of gotten in alot more trouble but still something you always want to say to those fucks.

This is a little bit odd. First of all, smelling pot, which the poster admits he could, is probable cause to search the vehicle. Add to this the admitted condescending tone to the cop and I don't see a way he wouldn't just pop the trunk, with or without keys.

Where I'm from, and anywhere else I've lived, the Law wouldn't hesitate to tear the vehicle apart if they smelled pot. Especially if they were being lipped off to....

Yeah I felt the same way...I'm happy to hear you didn't get busted...

but yeah I thought smelling herbs was probable cause....

Really ballsy though!!! Glad you got away!

remember you dont have to tell him shit. give him your license and whatever else, and if he starts asking why youre doing so and so whatever, you dont have to give him any explanation.

and another good rule of thumb, dont drive with anything you dont want the cops to know about. you really dont have many rights in a motor vehicle.

id like to know more about this probable cause smelling MJ and searching anyways, too

one time some years ago, i was driving my old really fancy car and a cop followed me and pulled me over, because the car is flashy i came to think. I had a beer earlier in the night, but my license prohibited driving with any alcohol. NONE. he told me he smelled booze and got me out of the car, he said id be arrested if i didnt consent to a breathalyzer, in fact next time i will do so, just so i can buy some time for my BAC to lessen. i blew 0.01 BAC and they towed my car, and left me on the side of the road. (not only that, but they needed a flatbed truck to tow it, and they charged me 200 bucks extra...wtf eh)

next time i will take the arrest, keep my car parked at the side of the street, and go down to the PD to let them sort me out there, hopefully at that time ill blow 0.0 BAC...

funny how it's always more than one cop that shows up to a single police car incident. like what, a lone human being is too much for them to take? with a fking gun...and tazer, whom they kill people with, robert dzkansky(sp.)anyhow, they were laughing when they saw the 0.01 BAC...they knew they had me by a string, and they were happy to nail me...again

anyways tangent filled story, they searched my car because he asked me to open my mouth and it was green inside, i had actually been smoking apple flavoured hooka at the party, NO marijuana, this was before i even smoked marijuana, and he used that to search my car. didnt find anything, obviously.

good going nickmode, i wonder if these same rights apply to canadians too?

Here's my story,

Back in 2002 I worked graveyard shift, and occasionally when I got off I would goto the local casino to waste some time and money.

So I'm cruising down the highway in my 1978 LTD on the way to the casino. On the way, I had to pass through a small town that was basically a suburb near the town I once lived in and was notoriously known for having some asshole 5-0's.

Suddenly I look in my rear view mirror and see cherrys and think to myself "aww fuck, i was speeding", which was entirely on accident.

Luckily, I had no pot on me, nor did I smoke any that morning.

This cop walks up, does the routine license, regestration, etc. He then comes back to my car and asks where I was going. I simply said to the casino, I just got off work. He says, "take a step outta the car for me quick."

So I did, and he tells me that he smelled marijuana coming from the car when he first walked up, and asked me if I had anything in the car. I laughed, because it pissed me off, and I said, " no, no I don't, I just smoke ciggerettes."

He then asked me if he could search my car.

I told him " no, you can't, this is bullshit." He asks why. I tell him "just because I'm in my 20's and on the highway at 6 a.m. coming home from work, doesn't give you the right to hound me. If I was some old man in my 60's, you prolly wouldn't have said shit."

He then proceeds to tell he how suspicious it is that I won't let him search my car. I told him straight up "because it's a waste of my time, and you have no reason to."

He again asks me, "can I search your vehicle?", again I refuse. Then he says "well can I have my dog smell around your vehicle? But, I don't need your permission on that, so I think I will go ahead and do that."

He tells me to lean against his hood, and he walks his dog around my car. After the first rotation, he slows down and kinda glares at me, then proceeds to walk around again.

His dog smelt nothing, so he said I was free to go.

I think he felt like such a douchebag, that is the reason I didn't get a speeding ticket.

Point being, those cock suckers will say anything to try to shine in there local department. Even if that means trying to find shit that isn't there.

My advice is to give respect to an officer first, if in turn, he is one of those douchebags, that's when you let the respect go, and the brutal truth set in.

Don't engage in conversation. If you are pulled over, retrieve your license, insurance card and registration. When the cop approaches, hand him these. Don't engage in conversation.

If he leaves to run your papers, get out of your car and lock it. When he returns, don't engage in conversation. Don't deny, don't agree, don't engage in conversation..The only response you can give him is to say NO to a search.

Never, ever assume you can talk your way out of being arrested, having the dogs called, etc. Never, eve assume that if you "treat him with respect", he'll let you off.

Do assume that once you are pulled over, innocent or guilty, you are going to be arrested. If you take that attitude, then you can get ready for the cuffs and thr trip.

You have a much better chance of beating a rap or getting off with your innocence at the police station or in front of a judge.

great job nick, and a very helpful story for everyone here at IC. We all need to have balls of steel in those kind of circumstances...and a solid knowledge of our constitutional rights.

edit: Yikes! I just saw when this thread was started, back in 2008! I probably already posted in it. :)

Most other places "smell" is probable cause for search.

Good to know you made it out... I also had a close call once; not funny.
