Takes away a Jury trial. Still can have a Judge trial. Actually was a point of the bill was to take away expensive jury trials where the max penalty for a loss is $100. It was ridiculous anyways, but I wonder how many people got busted for under an ounce and went to trial over the $100 fine? The major point is that, if you are dependent on not having even a misdemeanor drug possession on your record, all you have to do is stay under an ounce. I think this is huge and hope Arnold signs. It's just another way to move the front lines in this "War".

1449 is positive. Getting rid of the misdemeanor is a great thing. look...even the Antis like it! However if you have a few ounces at home you still can get 6 months. Also, hash is still a felony. But hey...we'll take it!

LEGISLATIVE COUNSEL'S DIGEST


SB 1449, Leno. Marijuana: possession.
Existing law provides that, except as authorized by law, every
person who possesses not more than 28.5 grams of marijuana, other
than concentrated cannabis, is guilty of a misdemeanor and shall be
punished by a fine of not more than $100. This same penalty is
imposed for the crime of possessing not more than 28.5 grams of
marijuana while driving on a highway or on lands, as specified.
Existing law provides with respect to these offenses that, under
specified conditions, (1) the court shall divert and refer the
defendant for education, treatment, or rehabilitation, as specified,
and (2) an arrested person who gives satisfactory evidence of
identity and a written promise to appear in court shall not be
subjected to booking.
This bill would provide that any person who commits any of the
above offenses is instead guilty of an infraction punishable by a
fine of not more than $100. This bill would eliminate the
above-described provisions relating to booking and to diversion and
referral for education, treatment, or rehabilitation.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 11357 of the Health and Safety Code is amended
to read:
11357. (a) Except as authorized by law, every person who
possesses any concentrated cannabis shall be punished by imprisonment
in the county jail for a period of not more than one year or by a
fine of not more than five hundred dollars ($500), or by both such
fine and imprisonment, or shall be punished by imprisonment in the
state prison.
(b) Except as authorized by law, every person who possesses not
more than 28.5 grams of marijuana, other than concentrated cannabis,
is guilty of an infraction punishable by a fine of not more than one
hundred dollars ($100).
(c) Except as authorized by law, every person who possesses more
than 28.5 grams of marijuana, other than concentrated cannabis, shall
be punished by imprisonment in the county jail for a period of not
more than six months or by a fine of not more than five hundred
dollars ($500), or by both such fine and imprisonment.
(d) Except as authorized by law, every person 18 years of age or
over who possesses not more than 28.5 grams of marijuana, other than
concentrated cannabis, upon the grounds of, or within, any school
providing instruction in kindergarten or any of grades 1 through 12
during hours the school is open for classes or school-related
programs is guilty of a misdemeanor and shall be punished by a fine
of not more than five hundred dollars ($500), or by imprisonment in
the county jail for a period of not more than 10 days, or both.
(e) Except as authorized by law, every person under the age of 18
who possesses not more than 28.5 grams of marijuana, other than
concentrated cannabis, upon the grounds of, or within, any school
providing instruction in kindergarten or any of grades 1 through 12
during hours the school is open for classes or school-related
programs is guilty of a misdemeanor and shall be subject to the
following dispositions:
(1) A fine of not more than two hundred fifty dollars ($250), upon
a finding that a first offense has been committed.
(2) A fine of not more than five hundred dollars ($500), or
commitment to a juvenile hall, ranch, camp, forestry camp, or secure
juvenile home for a period of not more than 10 days, or both, upon a
finding that a second or subsequent offense has been committed.
SEC. 2. Section 23222 of the Vehicle Code is amended to read:
23222. (a) No person shall have in his or her possession on his
or her person, while driving a motor vehicle upon a highway or on
lands, as described in subdivision (b) of Section 23220, any bottle,
can, or other receptacle, containing any alcoholic beverage which has
been opened, or a seal broken, or the contents of which have been
partially removed.
(b) Except as authorized by law, every person who possesses, while
driving a motor vehicle upon a highway or on lands, as described in
subdivision (b) of Section 23220, not more than one avoirdupois ounce
of marijuana, other than concentrated cannabis as defined by Section
11006.5 of the Health and Safety Code, is guilty of an infraction
punishable by a fine of not more than one hundred dollars ($100).

That is really confusing-- The only time it mentions, is 1 year, but then it mentions state prison-- But the minimum sentence for Calif State Prison, at least to my knowledge, is 16 months-- But it makes no mention of that--

You must serve felony sentences in a state prison except for certain circumstances. You can however serve 365 days in prison for a misdemeanor I believe. I really believe they put the "or state prison" wording in for judges to have discretion for "worst offenders". I'm not sure but notice there is no wording for more than one year in state prison.

And lets not forget Prop 36 that keeps 1st and 2nd time drug offenders from serving time.

it says "not in a public place" meaning technically no smoking at a phish show (like anyone would go to one of those) but your not allowed to toke up there now. somehow i dont think that is stoping anyone now...

I will take your word of the wording of the bill. If that is the case then I am not seeing the issue and would change my vote to yes. So long as it is actually 5x5 with no vertical restrictions I don't see why any non commercial person would need more for bloom.

Well, it wasn't a ball game but here it is:

Dec. 31, 1999- San Francisco. Windows are boarded up on all the shops. All hell was predicted to break lose so the cops were in riot gear in meter maid 3 wheel vehicles in squads of 12-15 roaming the city. Cops stationed everywhere by important buildings.

We brought plenty of joints as we knew lighting pipes wasn't happening with the wind there. And we had bought a 12 pack of Long neck Bud to drink while we walked around. The vibe was awesome and we new that nothing bad was happening (in THAT city anyways).

As we were walking around(there were about 6 of us), I had a Bud in one hand and a big fat joint of some Blue Dot. Back then, that was some of the best I knew of, being new to CA. It blew my mind(There was some stuff called Farmer Kate, that WAS the best, wish I could find more of her smoke).

So needless to say, I was quite confused when a cop approached me and said I had to get rid of the bud. I went to throw the joint away and he said "NO, that Budweiser there buddy!" pointing to my longneck, all pissy, like I knew better than to try to keep the beer and throw away the joint.

I gladly tossed the beer, puffed on the joint and apologized to the police officer, thinking how much I loved my new home state.....

January 7,2010- Pasadena,CA- Inside the Rose Bowl at the BCS National Championship game(How we got in with bunk tickets is a whole nother story!). Not the Rose Bowl game, but THE BCS Championship watching the greatest college football team ever(They call ALABAMA the CRIMSON TIDE - S.D.) play a great rival.

It was half time and by that time Colt McCoy's arm was dead and he was in tears(much like the Tebow before him), and his back up was in tears from the awesome defense the tide was presenting. We decided to smoke some Blue Dream I had brought with me for the trip but, couldn't find a place to smoke in private. So we sat on a bench right in the concourse, with all kinds of Texas and Bama fans wide-eyed as we fired up. They looked and gawked and we smoked like we owned the place, but trying not to be obnoxiously blowing smoke at people. A county sheriff walked by, casually looked at us and said"Aww, come on now fellas, not inside the bowl". We said "ok, no problem officer, thanks!" and put it out and went on our way.

I love my state!
