Texting While Walking Banned in Fort Lee, N.J.

It varies by state law. A pedestrian crossing with a red light does not have the right of way in my state. A pedestrian must yield to cars when crossing a street, not at an intersection.

If there is a push button cross walk the pedestrian must use the button to gain right of way with the symbols.

In my situation the girl crossed in front of my car when there was a red light. If I ran her down she would have been issued a ticket.


I don't like the law. If you are dumb enough to text and walk and get run over, maybe we are all a little better off.

They never said it varies state to state. They even made the point that it doesn't matter if the pedestrian is crossing the street illegally, they just said that the courts won't penalize you as much in that case.

I always wonder how these legislative rules are written, specifically does it say 'texting'.

For instance, it is illegal to search your mp3 collection? Write an email?

Given the headlines coming from these type of stories, it makes me think a 2nd year law student should be able to beat the charges.

wasted time on useless laws that only protect the morons from each other and have more holes than a cargo net.

In Colorado if you cross against a light and get hit, you could be issued a ticket. It never happens though.

A lady was just killed here recently crossing against a light. The driver was not cited and could sue her estate for the damage to his car.

I can't imagine Colorado laws are that different than other states.

the other day I was in the crosswalk and I stepped right in the path of the first motherfucker who wasn't going to stop for me, it was an old bastard who would've been shaking his fist @ me had I not yielded right of way to him in the same situation.......

I have almost run over a girl texting and walking, she just stepped out in the street against the light. I could have plowed her over and not even gotten a ticket.

I leaned out the window and said, "Watch out for death."
She flipped me off.
Shouda hit the bitch.

I don't know Snoopster, maybe it was just pee pee time for her.......

That is a dumb law, how am I supposed to stop for someone in a crosswalk if I have a green and am going 30 mph?

I used to live in Minneapolis. There is no way I would have crossed against a light. Even with the light I kept my eyes open.

When I went to college, cars stopped for me. Every time I would go to cross a street cars would stop for me. I thought it was a some sort of trick, they stop, I cross, they plow me over. It took me a while to get used to it.

hahahaha I hear you on that one!

when I worked at this little city, they have no stop-lights anywhere, it's awesome; and everyone stops for pedestrians, also awesome.

but it did take me at least a month to start accepting the idea that the cars will stop. but still I never got to trust it that much, always gotta look well before crossing no matter what.

fort lee is a stones throw from the george washington bridge going into nyc.
this place is a madhouse during rush hour traffic.
i think it makes perfect sense, alot more people get hit and live doing this exact thing.

and i kno im gonna get some neg rep for this and called some names but....
in jerz its called "For Ree" due to the HEAVY asian influence in the area.
now, anybody reading this ever met an asian who could drive properly?
they are accidents waiting to happen.
i mean, terrible drivers and it's not just a stereotype, its law.

IMO if you are dumb enough to not pay attention to what you are doing and get run over that's your problem. You can't regulate out stupidity. It shouldn't be the Nanny State's job to protect you from yourself.

in paterson nj you'd be lucky if you're only mugged.......

or atlantic city, trenton, camden, newark...
but they wouldn't have a law like this for very long in those places.
not after the chief had to deliver a flag to the wife of a cop who got shot over a texting-while-walking ticket.

I dont see it as a dumb law, but i do see it as a perfect example of whats wrong with this country.

People who think just because they have the right away, they can go without forethought. (I almost want to gun it when i see someone use a crosswalk and not look both ways.)

Yes, LEGALLY the car is suppose to stop, but bottom line, a car can kill your dumb fucking ass, so ultimately YOU need to prevent this from happening.

About a week ago i laided on my horn at some idiot pushing a baby stroller, jaywalking, and not looking in my direction. "Ive got a baby, no one would hit me..." SPLAT

society rules are nice, but ultimately the only one keeping you alive is you. Dont subject your baby to your own failed logic...

Yeah..having lived in the metro area..including that area around west NY...insane driving...coupled with people who simply walk right in front of your car without looking...is a recipe for disaster.

I think it is a good law...and should be enforced to max.

I don't see how someone could be legally responsible for hitting a pedestrian that crosses against a light or while jaywalking.

Well I don't know anyone personally who has hit someone to draw on their experience. All I know is what was taught in a driving class conducted by the State MVA and they taught that even if a pedestrian is crossing illegally the pedestrian has the right of way. Of course someone did ask about what if someone jumps out in front of you at the last second,to which the response was "You'd probably still be charged with involuntary manslaughter if you killed the pedestrian but likely get probation instead of jail time". Now this was back in the 80's so I guess the laws might have changed but since the population has consistently grown larger since the 80's I can't see them making the laws less favorable to pedestrians. I am also making the assumption that since the teacher was a state MVA employee tasked with teaching people the laws, that he was telling me and the rest of the class accurate information? I'm unclear as to what makes you think the laws in Colorado can't be different then the laws of another state?

Because as a driver you are required by law to maintain enough control of your car and it's environment to avoid hitting a person crossing a street whether they do so legally or not. What if the pedestrian was actually a boulder that rolled out in front of you at the same point you might encounter a jaywalking pedestrian? Are you going to crash into it simply because there were no laws telling you to stop?

I mean if there is no accountability then what's to stop people from deliberately running down anyone they see that crosses illegally? I'm not saying the pedestrian should get off scott free but that is a moot point usually as most pedestrians die when run over by a car or truck. This sort of thing happens though because there is a scary number of people behind the wheel of a car that truey have little to no clue as to the forces they are controlling. It's likely a thought that never even crosses thier mind until/unless they survive an accident.
