even if you have no intentions to grow, CHANGE YOUR LOCKS
LANDLORD shows up, locks changed, calls Locksmith...

Now you have no key to get in...SMART...?

BETTER...have locks changed as part of Lease...

In the eight Southern states I have lived, 14 days tops...EVICTED and on the street.
Unauthorized tenant repairs especially lock changes...EVICTION...

I can't speak to why you got evicted so fast unless you had given them an acute reason such as damage to property or the owner broken in and saw that you were running 10 lights. At that point they can file for an unconditional notice of eviction which doesn't allow the tenant the chance to respond in order to maintain residency. This is usually not the case and the tenant can fight this in a court of law fairly easily which just equals more time to get your crop done and get yourself out. If you don't fight it you could be kicked out in under 20 if the landlord knew a judge or had the attorney prefile all the necessary paperwork. Most evictions are not of this sort, most times those being evicted are served with a notice that they are in breach of the terms of the agreement and have a given time to rectify the situation usually anywhere from 3 to 10 business days. At this point the eviction process gets into the courts and blah blah battle in courts while you stay in the place. Actually the process is getting harder since the housing crisis. Many states have passed what amount to squatter laws that lengthen the eviction process and provide for more tenant/squatter rights. Again though, this all depends on the state. And again if someone is looking for a location for a grow op as is the OP, they aren't going to give two and a half shits about breaking the terms of the lease by changing the locks.

Is it a bad idea to have someone living above you if you are in a multi-family house or building? because of odor? Even with a scrubber at some time you would have to harvest so unless you are scrubbing an entire room wouldn't that be an issue? or is there a way around that?

I like changing locks... for what ever reason... person before you, land lord, anyone that may had have access to the home your trying to potentially grow in... or would you rather come back home one day with police man chewing on your meds?

I have had a few very nice Sport for growing.. Generally you wanna go check the property for a few days.... go at night to check if any police man live around your area... or by you:moon:
if you can find a home with 200amp do it!
I like fenced homes..... "No one can knock on my door unless I open Gate" always helps. Make sure the home is not too old because you might run into problems with the house you sure don't want anyone coming over to fix it!! or having to tell a land lord... if you had one of coarse....

Much better if you can buy a place... Then you can really set a nice grow with everything required and do what ever you wish.
Having a warehouse/barn or storage within the property is a plus.
oh and most importantly Get Legal before anything! ;)

sheriff recieves orders to evict and executes, in my county their policy is to wait AT LEAST 10 days before showing up and kicking you out
We're at day 54-69 already.

Folks may have heard 14 days or 30 days or whatever, but thats just for one step in the process.

GeorgeW I have seen an attic in a 4 story apartment building. all the 4th floor units had attics. never saw it again or before.
it was built by an investor that sold it 10 years later, i bought in with a partner on a few, it was a cool building.

What landlord files eviction paperwork after being one day late on rent? Not many with a tenant that has previously paid rent on time. Furthermore, your math doesn't take into account the fact that all days must be applicable business days excluding weekends or holidays. Furthermore, courts aren't just open for you to walk in to see the judge. If there is no response within the 5 day summons period then the file must be submitted for a judge review, a process which may take anywhere from 3-10 days typically. At that point the writ of possession must be served by law enforcement. 24 hours later you can schedule law enforcement aided eviction, typically with the sheriffs dept. That being said, this is the process in most of Florida though it varies by county.

Furthermore, I see no reason why this should be a consideration when you as a grower will be paying the bills on time because it is just one of the rules. Not all states operate in the same way as Florida and at any point the tenant may contest the eviction process and the landlord must schedule a court appearance which would add days if not weeks to the process.

As a personal aside, your insistence on calling anyone who disagrees with you wrong and your use of allcaps rubs me the wrong way in that it makes you look like a grade A certified douche. You aren't the only person who has ever been evicted or evicted someone. If you want to discuss the legal process in each of the 50 states thats fine but a general rule of thumb for 90% of the country is 30-45 days from failure to pay rent. Again, this should never be an issue in our circumstance where we are considering the rental a grow house. Oh and get it in the lease agreement or not, changing the locks on a house to intend to grow in is a smart move.

Yeah, that woulda been a whole lot nicer. Nothing in my post was wrong or misleading. I spoke truly and accurately for one state in the south. I have no interest in matching resume's, and I never questioned that your version is true for whatever state you're talking about. For that matter, much of this stuff can vary by county even. In the state I was referring to, the length of time to get a court date varies from county to county, and the state law specifically directs each county sheriff to decide how long after delivery of judgment to execute the eviction.

WAKE UP...if you think you are going to sit in a place where you have VIOLATED the lease when a Landlord is PISSED. GET A GRIP.

I can sit in the house for 45 days in my current state. Been there, evicted someone, took even longer than 45 days most of the time. But again this is a moot point because if someone is renting a house to pull a crop the first rule is to pay the rent and bills.

I prefer city to country. It is weird but having lived in both it seems the more densely populated the less likely you are to know your neighbors. The less densely populated the more your know your neighbors and watch out for each other.
Another major thing to look for is higher penalties for being near a school. Some cities even go as far as how far from a school bus stop. Google "marijuana grower arrested" in your town and see how it happened and what happened to them. There was a major arrest of a pot dealer almost 2 years ago in my county and the home he lives in is still in his name on the county tax role. You would be surprised at the information available.

Yeah I had Cheney as a house guest a few months ago and now the whole place just stinks like fromunda cheese so I don't want to even be there let alone grow there. I decided to slum it and rent a place, live like the common folk:D

I know it's a little more dangerous, but buying a house is out of the question I got no cash and bad credit, so I'm trying to decide what type of apartment is gonna be the best option. It's a long and tedious search unfortunately.

Rather than just get anything I'm waiting for THE right place/situation to come up. I thought something with an attic would be ideal and aside from the summer I don't see temps being an issue really. At the very least I want to make sure I'm on the top floor wherever it is, cause I'm afraid of the scent cone traveling up and out. I think that sounds logical, no?

I'm in a situation not so different from yours, except that I have some cash, and some credit, but no job. A top floor apartment with access to an attic for ventilation sounds like a plan -- but there is always the use of AC scrubber/filter and|or Ona Pro Gel or its equivalent. An indoor guerilla grow, with no "off" scents, and no excessive utility (electric or water) would be my goal. In many localities, a top floor with attic sounds really hot in the summer.

But a situation that I have run into here in NorCal regarding rental properties is the landlord or management company using a County or Locality LEO inspired rental addendum which quotes Fed, not State codes when specifying "drug use, possession, or manufacture". This appears to happen in multiple Counties, and not just for apartment or SFH rentals, but also renting a mobile home park lot with my own mobile home on it -- the management demanded 24/7/365 access to my mobile home by any agent they designated, including LEO. Needless to say, I didn't buy that mobile home.

With my rapidly diminishing range of options due to economics, I may just pack-in the whole idea of growing my own. Sadly, I've already bought a good bit of new kit for just that purpose. But good, no great news -- the USA recession turned the corner in the summer of 2009. LOL Yeah, for the Banksters.

On the changing locks issue. I had the house key on a chain connected to my wallet. Lost the wallet which also contained things detailing my name and address. Rang the landlord to let him know what had happened and asked for permission to change the locks and he was fine with it. Wasn't growing at the time but its a tactic you could use, or at least an excuse if they asked why the locks were changed.
