Fresno Shuts All Cannabis Dispensaries

The City of Fresno has ordered all nine of its medical marijuana dispensaries to be closed, and Fresno County Superior Court Judge Alan Simpson upheld that order.

At issue in this case was whether city zoning laws banning dispensaries can overrule the state laws that allow them.

The judge made two rulings:

1. State law does not pre-empt enforcement of zoning laws.
2. Dispensaries violate federal law, which make them in violation of local zoning ordinances.


This does not bode well for Fresno or for other localities seeking to keep their dispensaries open in the face of continuing opposition from law enforcement. The case goes to trial in January of 2010.


"Maybe they should move to San Francisco," council member Lee Brand said referring to Fresno residents who use marijuana for medical reasons.

to close while they battle it in court, the residents will win (I am one of them by the way) and we will be removing the council in the next elections anyways. They can either fall in line or find new jobs point blank.

Dispensaries vs. Collectives is all that is going to happen, those who setup business as a dispensary can change it to collective and be within zoning odds are. Either way, we have bad ass pot lawyers around here actually somewhat famous ones as we have had plenty of shitty cases around my stomping grounds.

First they were saying the violation of federal law and how they have to abide by state AND federal. Once obama put that memo out all they can do is talk zoning BUT that is for dispensaries and not collectives anyways.

I will be posting links for the council and some copy/paste emails to send them for those in fresno and ANYWHERE to email/mail/call them and let them know that they SHOULD support the citizens of fresno and the laws of the state they are in.

Fuck you Mr. Brand. This is America. Your constituency voted for this. Now stop representing Big Pharma and the Feds and start representing the people who voted you into office.
 
fuck fresno, i spent the worst 2 months of my life there.
telling people to move away, thats just insane! these politicians are so ridiculously stupid its amazing.

Fresno needs a better working relationship with the police and council. Screw you cops just wont work. Invite the chief in and ask for advice and be candid. Dont forget the doughnuts and coffee. Its a hell of a lot cheaper too include them than exclude them. Growing up a friends dad was a federal judge. I would bring the beer and booze to his house for ballgames and poker with judges, prosecutors and city officials there. Sold pot for ten years never had a problem.

I would be curious to find out the real reasons for their opposition.
Is it because people have forced a free for all attitude upon the community.
Have these dispensaries not complied with the State guidelines?
Maybe it is the infusion of recreational users in to the medical marijuana market that has the council upset?
I can't see anyone telling the truly disabled and infirm to simply move, it has to be directed at those whose 'medical conditions' are questionable.

I have to believe there is more to this story than is being related.

That's an oxymoron, then investigate the Doctors, not the patients or people providing herb, what a rediculous thing..

So some right wing judge says...so what/ Another judge will ovberride him and thats that. The will of the people may be delayed but victory is our in the long run.

Something tells me if they were to "investigate the Doctors", there would be the same level of outcry.

Perhaps the community should police itself and not violate the trust of the voters ?
The whole issue revolves around greed and profit, remove that from the matrix and most other issues would dissolve away.

See, as I see it, people providing herb are in it for the profit. The doctors signing questionable requests are also doing so based upon profit.
The dispensaries also are based around profit as they buy low and sell high.
That leaves the consumers at the end of the food chain. Those who are working and can afford these high-priced 1/8 oz etc. keep these companies in business while the patient who is unable to work and may be living on Supplemental Income are pushed out of the market.
I am a firm believer the only workable solution is to allow each registered patient under the program to grow their own, either for themselves or as part of a collective. I do not believe there is any need for a Professional-class of profit-driven suppliers.

wow i didnt know fresno had 9 dispensaries to start with,and what was the reason for them closing?
im going down there tomorrow(Clovis) as the house I own down there had a tree uprooted from the crazy winds a couple days ago ////I will find out what up firsthand,,this is also my daughters final semester at FSU and she cannot wait to get outta there(we either so i can sell the house)

I am getting a bit more involved with the local efforts here in fresno, waiting for some contacts from the local med friendly orgs that we have and suggestions from them about cookie cutter emails to send to the council. Odds are they have more than dealt with this b.s. in other cities and have quality emails, letters and phone scripts to work from.

I setup a new thread which is in my signature now that I am working on for those who want to let these council members know their thoughts whether good, bad or indifferent.

Fresno CAN be a great place at times, its more of a back and forth with this because they setup the marijuana cards and even has it listed happily on the main fresno website as seen here http://www.co.fresno.ca.us/DivisionPage.aspx?id=32977 BUT are trying to play the "BUSINESS ZONING" bullshit!!!

I am done with the council, the supervisors AND our pretty faced waste of space mayor. Time to remove them all and get some real quality RESIDENTS OF FRESNO in their seats.

seen that one before,

Kind of like how all of the previous mayoral candidates were given funds if they would support a power plant around fresno. There is a very LARGE political influence in our city even though it really isn't all that large or at least I have lived in MUCH larger places before.

This sort of b.s. is happening in MANY cities around the nation and world for that matter.

Wow...that sounds like a Grocery Store/Retail Store/Liquor Store/Pharmacy'''and most any other thing that we all need on a daily basis!! But weed should not be sold?? Let me reiterate...."Wow!!"

I too wish all you've expressed yet, we are not living in that world today and sitting on our hands, dreaming of some fictitious future won't resolve the problems of today.
