Do you really need to yell?

I started to read this post, it seems like perhaps you are trying to make a good point. But, for crying out loud, if you are not going to use punctuation, the least you can do is use small case letters with caps at the beginning of sentences. You may have had a good point, but not good enough to make it worth the trouble of reading your post.

So in order to make sure that all the legal bases are covered besides the laws that are intentionally going to be broken. I have found the rules of engagement.

http://cityofsacramento.org/parksandrecreation/recreation/pdf/event-planning-guide07-08_1.pdf said:
DEMONSTRATION/PROTEST/RALLY
Demonstrations, protests and rallies are allowed without a Special Event Permit on public property under
the following conditions:
• Protest remains peaceful;
• Amplified sound is not audible from more than 100 feet away;
• Pedestrian/vehicular traffic is not interrupted;
• Streets and sidewalks are not blocked;
• Building entrances remain open.
If any of the above guidelines are violated the Police Department may ask individuals to leave the
premises, or take enforcement actions. For any exception to the above, a Special Event Permit is required.
For more information please contact Special Event Services at (916) 808-7888.

The details including date, time, and place will be coming. The legitamate purpose of this "Cannabis Party" is to establish a new collective of patients. But with a totally different model and purpose of those collectives we have now. We will be starting a political action committee. It is a collective effort of patients so then we are allowed to freely exchange medicine according to the AG's strict fucked up SB 420 adhering guidelines.

The only information that will be asked at the time is an email address and a name, nothing else. We won't make copies of your doctors note, visual inspection at exchanges should be enough.

The purpose of the PAC is going to be to support pro cannabis political canidates and the true liberation of cannabis while opposing measures to tax cannabis and the implementations of new laws and regulations against cannabis.

FF, I like the idea of fighting the good fight...small guy making a big difference. I didn't have time to read the whole thread, but you've consulted an attorney right? I only had some prelaw classes, but my concern is that you are going to a fight with anecdotal arguments when much legal precedent has already been decided. Saying 'they can't' or 'they won't be able to' may not be the best way to rationalize this fight. I don't know you, but if you are going to be a voice for the cause--please be clean cut and look professional and be able to speak and enunciate clearly. Worst way to lose this fight is by being/looking unprepared.

That goes for anyone; at the next rally can we all agree to leave the tie dyes, patchouli, sandals, and ponytails at home? People won't take us seriously until they realize we are just like them...mostly.

Had you read the whole thread you would realize that the ballot materials have already been successfully used in court to prove that plant and weight limits are unconstitutional. And yes while much precedent has been a set, a lot is still missing. The case law surrounding mmj in California is like a pyramid. We just need to cap off the top finally and finish the job. Cities are passing illegal moratoriums, the state is collecting illegal sales tax, and many people have forgotten that we already had LEGALIZATION years ago as approved by the voters. The precedent that finally acknowledges that is yet to be set.

Furthermore on the question of attorneys. Most of the MMJ lawyers don't want the right precedents set in appeals courts. They would lose tons of work if the cops/DA's/Judges/Media had an appeals court decision declaring weed legal. It was lawyers/politicians that brought us plant and weight limits. Why do you think the lawyers want ballot initiatives passed that are restrictive and punish if not followed? Because they are greedy blood sucking scum. IF there were to ever be another violent revolution in the USA you can be assured that Shakesphere's advice on killing all the lawyers would be first on the agenda.

Saying 'they can't' or 'they won't be able to' may not be the best way to rationalize this fight.
Dig deep into your lawbooks. Research case law, learn how the legal system works. Then you too will know what they can and can not do. As somebody who has been to prison before I am very aware of what they CAN do.

I don't know you, but if you are going to be a voice for the cause--please be clean cut and look professional and be able to speak and enunciate clearly. Worst way to lose this fight is by being/looking unprepared.
You obviously don't know me. And if you read the whole thread you would realize that looking "professional" could actually be a detriment. The goal is to get charged, brought into superior court, get found guilty, appeal to the 3rd district in California have them reverse the superior court decision and publish their opinion. IF I look too professional the city might not cite me. If I look professional the jury will have a harder time finding me guilty. IN the court of appeals it doesn't matter how I look or sound. They judge their cases based on the facts that were introduced at trial. No new arguements or presentation. It's done on paper at that point.

As far as case preparedness, yes that is a must and am well ahead of others.

That goes for anyone; at the next rally can we all agree to leave the tie dyes, patchouli, sandals, and ponytails at home? People won't take us seriously until they realize we are just like them...mostly.

That line of reasoning right there is one of the reasons why prop 215 was passed. To bring social change, so people aren't judged by their clothing labels or hairstyles, but by their merits, contributions, and intelligence.

*edit* BTW I have been able to create a legal cannabis corporation (yep even the IRS knows about us), that was able to get a business operation tax permit (biz license) as a patients collective in a city that wasn't issuing them to collectives/coops/clubs/dispensaries. So being concerned about me looking proper is silly.

All I'll say is that I've never been to prison, so I must know how to keep out of it. I was trying to help you do the same. Jury trials and perceptions are part of the game and people acquit most often for people that are like them.

Thank you for fighting the fight in your own way, even if I may not agree with the the methodology. Best of luck to you.

I just found out that Richard Lee fired Dennis Peron from Oaksterdamn U. for his anti tax and regulation speech. I will be getting a copy of the video from his last lecture as an Oaksterdamn professor and post it for you guys to see!

those oaksterdam guys are crooks. the owners of those shops that scraped by and didn't get closed down are in cahoots with oakland police and city council and there both getting a cut out of "oaksterdam" thats the only reason the other places got closed, they are nothing but crooks and monopolists who want a grip on the oakland cannabis market...oaksterdam will never get any of my meds or my money...

Well there have been a few interesting developments and newly aquired knowledge that is chagning the approach of this.

The first and most important is a letter that I recieved from the city. California Cannabis Inc. has been invited to take part in a series of meetings about shaping a permanent ordinance in Sacramento. This is huge. It means the city is officially acknowledging us. So because of that I can't risk company by becoming a defendant once again. Especially when they might actually listen. Obviously there will be others there too, but a lot of them are going to be in support of caps and probably will negotiate local taxation in exchange to keep existing "dispensaries" in business.

The next major development is that I found a lawyer that is approved by a friend of mine that hates lawyers. He already has a few cases on the same subject in the appeals courts now, including a case from LA! Yeah that came as a surprise. He is a lawyer that fights plant limits too. So instead of getting dragged into court, now I can drag the city into court.

So instead of blowing my wad on the moratorium I will wait until the "permanent" ordinace is passed and then challenge it.

Good luck with the city, sounds like they may actually listen, but then again who knows till it happens !!
So are there several meetings scheduled, and how soon are they getting the ball rolling??I hope that the permanent ordinance to be agreed upon & put into place in Sacramento will help the cause here in Yuba County someday.Sorry but it is an added expense going into Sac. as well as a major pain for many up here, and we need services ,and several to choose from if possible.I see so many empty storefronts, commercial buildings, and the like and always think, what if...........well it is time, and this area needs some economic boost, so why the hell not.I just hope that I can educate myself enough and soon enough to make a difference up here.Hey a man can try cant he???Someday damn it someday!!!
