A Virginia mother was charged with felony murder and child neglect following the death of her four-year-old after he ingested a “large amount” of delta-8 THC gummies.

Virginia mother Dorothy Annette Clements is facing felony murder and child neglect charges after her four-year-old died after ingesting “a large amount” of delta-8 THC gummies, CNN reports. Although it is less potent, delta-8 THC carries similar effects as delta-9 THC, the most common cannabinoid found in cannabis. Delta-8 has also been ruled to be federally legal as a hemp-derived substance under the 2018 Farm Bill.

The death, which occurred on May 8 after the four-year-old was put on life support on May 6 due to a “medical emergency,” is considered by Virginia’s Department of Health to be accidental, and “the cause of death is delta-8 toxicity,” according to the CNN report.

“Detectives believe the child ingested a large amount of THC gummies,” Major Troy Skebo of the Spotsylvania Sheriff’s Office told CNN. “The attending doctor told detectives that if medical intervention occurred shortly after ingestion, it could have prevented death. Statements made to detectives by the mother did not match evidence seized at the home.”

Clements was indicted by a grand jury last week and taken into custody on Thursday. She told WUSA9 before she was charged that the toddler was sitting beside her when she noticed he was having trouble breathing.

WUSA9 reported that Clements had realized the child had eaten a gummy and called poison control.

In September 2021, the U.S. Food and Drug Administration (FDA) and the Centers for Disease Control and Prevention (CDC) issued warnings concerning the use of and experimentation with delta-8 THC products.

“The health effects of delta-8 THC have not yet been researched extensively and are not well-understood,” the CDC wrote in a Health Advisory report. “However, delta-8 THC is psychoactive and may have similar risks of impairment as delta-9 THC. As such, products that contain delta-8 THC but are labeled with only delta-9 THC content rather than with total THC content likely underestimate the psychoactive potential of these products for consumers.”

There are currently zero recorded deaths attributed to a cannabis or THC overdose.

That’s very harsh to charge the mother with murder. Also what is the evidence of the mechanism of delta 8 and cause of death due to delta 8. I feel for the mother and child involved and I hope it’s being recognised properly and not just being put down to cannabis without the reasons.

I was wondering that same thing. Both Delta-8 & Delta-9 are both structurally similar. Although D8 binds more weakly to the CB receptors and isn't as potent as D9. So how is it that a weaker substance can cause death well delta-9 never has?

Crazy charging her with murder though she did screw up big time and that action or inaction could certainly fit the charges of neglegence causing death.... but murder??? that's messed.
Unfortunately children die from ingesting all kinds of things and as a society we have been kind of trained to be aware. Childproofing ones home falls into that being aware category that to most , and especially parents, is just the practice of good common sense. When we fail to practice good common sense and someone dies because of it..... well that's being negligent. I would think she should hire a lawyer and appeal.
I don't have kids in the house anymore but when I did, my weed, medications and any other items I could think of, were out of any child's reach.
Sad story for sure.

Does not matter if it was legal or not. FYI New Zealand legalized synthetic cannabinoids because they thought it to be less dangerous then cannabis because it was made in a lab rather than grown.
Provisional figures from the coroner show that more than 70 people have died from synthetic cannabis toxicity in the past two years.

Your DEAD wrong about that! Sorry eh but the facts are in. Cannabis is a lifesaving drug for some kids with epilepsy.

Researchers at the University of Saskatchewan say preliminary results suggest medicinal cannabis oil can reduce or completely stop seizures in children experiencing severe and drug-resistant epilepsy.
Dr. Richard Huntsman, a pediatric neurologist at the university's college of medicine and one of the study's authors, said the results are nascent but encouraging. The overall reduction in seizures was close to 75 per cent on average.

Yup people die after eating contaminated food. But that does not have anything to do with dying from a THC overdose, None of these cases had anywhere near a LD THC level that could cause death.

Too bad hundreds of kids have DIED from epileptic seizures that cannabis could have prevented. Very sick kids dying becuase of propaganda about cannabis you know reefer madness and yes it's still alive and well.

BTW Check out how much THC is needed to kill a 30 pound dog.

So if the kid took her blood pressure meds would she be charged with murder? No! It was an accident.
This is a waste of time and money to charge her with murder. It is also not fair to label her a murderer.
It's not fair to jail people who use a drug that no one has ever died from while alcohol kills 3 million per year and tobacco kills another 7 million per year. But some people hate stoner hippies and any other visible minority, you know republicans.

BM had zero to do with this. You added that just to disparage BM. The best cannabis grown comes from BM gardens. BM growers are some of the kindest ethical growers there are. Even when cannabis was illegal across the country and growers were using strong bad pesticides its never killed a soul. .. Has nothing to do with BM.

Syntheitc cannbis is not cannabis. Any that use it are risking their health. No reason to even buy that crap today. Real Cannabis has never seriously harmed anyone.

Its so sad to read this child died and the mom is changed with murder.. An autopsy would be able to show if the child even ate a gummy. If they find 1 gummy that did not kill this child. Id be looking at RSV, it's much more likely to be the cause.

Sorry buddy but your friends and you who grow cannabis ethically are the minority in illegal cannabis sales. Most do it for profit and don't care about any health risks like mold or pesticides.
But I agree real cannabis has not caused anyone serious harm.

This poor child died 48 hours after the eating the gummy well after the time it takes for the majority of the THC to be metabolized. And again the child did not have anywhere near enough THC in his system to cause death. Just like a few other supposed deaths from cannabis in the southern states that were later debunked by doctors peer reviews.

We were not talking about all the people jailed for weed. Nor were we talking about alcohol, tobacco and how some people hate stoner hippies. None of that is fair and it isn't fair that you implied that I think that is fair. WTF???
I am a stoner hippy. Have been since 1970. I had hair down to my waist. I will still out smoke every person that dares to step up to take my crown, including motherfucking Snoop Dog.
Then you want to make this a political thing. WTF?? I'm an independent and since 2008 I am 50/50 voting Dem or Repub. Republicans can be pot smoking hippies too.

In an illegal state kids are a huge security risk. Even if you can get them to stay out of your edibles, they still can snitch inadvertantly. Schools are winding them up like little drug spies, sending them home to gather evidence and report back. Best that they know nuthin.

NZ legalised some synthetics that had been tested. They thought it would be safer to have tested drugs in public consumption than untested.
Adulterated and illicit drug use fell over the period these synthetics were legal - unfortunately political will is fickle, and they were soon made illegal again. This began a race against the wording of the law with new drugs created that were not specifically classified as illegal, but were much more dangerous. A drug would get banned, a new one would be created.
The synthetic deaths in NZ are largely due to the end of legalisation.
Synthetics were originally rivals/replacements to hard drugs like meth, not cannabis.
