Yes sales are illegal, the only activity under that code that is specified in the act is give away. That is how they expanded 215 for our protection. Originally you could only grow or posess, with the 420 enhancement you can now give away as well as transport.
How does money change hands when you all you can do is personal activities when not a caregiver. I do not pay myself to grow and no one else can pay me unless I am a their caregiver long before the marijuana provision is considered. You can associate collectively or cooperatively but only for you own personal use, if you are not participating in the grow you can only get meds from one who does grow and gives away some to you. If anyone ever charges you for marijuana they are a criminal.
Marijuana should be completely legal..

My argument is that bad laws should be changed and until then, YOU SHOULDN'T FOLLOW THE LAW. Do you smoke pot? I guess you don't have as much regard for the law as you think you do eh?
That's the difference between you and me. I'll happily break the law by smoking my MJ but I don't whine when caught and try to come up with all kinds of crazy excuses when caught.
I would fully expect a jury to convict me.

SAN DIEGO COURTS — A Superior Court judge reduced a felony drug possession conviction to a misdemeanor Wednesday for a Navy veteran who authorities said was the manager of a now-defunct medical marijuana dispensary in Kearny Mesa.
Jovan Christian Jackson, 31, was placed on probation for three years for possessing the drug Ecstasy, and for having Xanax without a prescription. Last month, a jury acquitted Jackson of five charges of possessing and selling marijuana illegally — the major counts — in a case that stirred activists within the medical marijuana community.
San Diego Judge Cynthia Bashant determined Wednesday that Jackson had credit for enough jail time (42 days) to satisfy an $839 fine.
Jackson said outside the courtroom Wednesday that he is thankful the case is over. However, he noted that he remains a member of the marijuana collective called Answerdam Alternative Care.
“If I’m put in a position to lead the collective, I will do that,” Jackson said.
During the trial, which began in late November, prosecutor Chris Lindberg argued that Jackson and other operators of the dispensary were selling the drugs for profit, a violation of the state’s medical marijuana law.
A San Diego police detective testified in trial that he made two undercover buys at the dispensary on Convoy Court in June and July 2008.
Jackson’s lawyer, Lance Rogers, argued that the collective operated legally and professionally. He said members of the collective were asked to show a valid doctor’s recommendation before obtaining any marijuana and sign an agreement that detailed how the collective worked.
California law allows medical marijuana patients to collectively grow the drug to treat their illnesses.
The foreman of Jackson’s jury said the law doesn’t clearly define collectives or cooperatives, so the panel had to find him not guilty.
A co-defendant in the case, 60-year-old Lee Edward Bumpers, pleaded guilty Dec. 9, 2008, to sale of marijuana and was placed on probation for three years.
Jackson has another criminal case pending in which he is accused of possessing and selling marijuana. A preliminary hearing in that case is scheduled for Monday.

LOL, this type of double-speak is exactly why I think of Mr. Jackson the way I do.
He's basically saying he was (and will be) the operator of this D when all along his defense was that he was a "minor" player.
Since he's now on probation it would probably be wise for him not to speak because obviously he doesn't think before he speaks.
