PETA ties beheading to animal abuse

An animal rights group attempted to purchase an ad in a Sun Media-owned newspaper which compares the beheading of Tim McLean Jr. to the slaughter of animals.

People for the Ethical Treatment of Animals officials hoped to run an ad this week in the Portage Daily Graphic that uses lines such as, "An innocent young victim's throat is cut" and "The man with the knife shows no emotion."

The description leads the reader to believe it's describing McLean's death aboard a Greyhound bus last week about 20 km west of Portage la Prairie. Only later is it revealed the ad is referring to the slaughterhouse treatment of animals.

"We're really challenging everyone who was shocked by this horrendous crime against Tim McLean to go to our website and see for themselves that animals every day go through exactly what he went through," PETA spokeswoman Lindsay Rajt told the Winnipeg Sun yesterday.

Barry Clayton, publisher for the Portage Daily Graphic, said the ad would not appear in his newspaper.

One friend of McLean's said PETA's ad is misguided. "I'm behind animal protection ... but don't try and take away from what Tim was. He was a great person," said Doug Mitchell, who helped organize a vigil for McLean at the Manitoba Legislature last weekend.

"It just seems they're trying to take that away from the light. I know Tim loved animals ... but don't run something so gruesome with something else that's gruesome."

PETA did not contact McLean's family regarding the ad, Rajt said. She said McLean's death was horrific and that "our hearts go out to his family."

One ethics specialist described the ad as deliberately shocking.

"It's meant to draw attention to their cause," said Arthur Schafer, director of the University of Manitoba's Centre for Professional and Applied Ethics.

The ad seems geared towards forcing people to confront the treatment and slaughter of animals, he said, adding it could backfire and not generate sympathy for animals at all.

"It's timing is such I think it will massively turn people off," said Schafer.

Peter Miller, a scholar in philosophy and ethics at the University of Winnipeg, said the ad is a gamble on PETA's part.

"I would think (the ad) would cause harm for the friends and family of McLean. Others may be revolted by it or think it's in bad taste," said Miller. McLean's family could not be reached for comment yesterday.

I just say the PETA ad. I respect a person's right to avoid all animal products. I am an animal lover too. But this organization is led by animal 1st extremist. These Zealots are smearing the memory of the young man who was beheaded.

living things die all the time, and it is incredibly presumptious and selfish of us to imply that we are the only beings with emotion that suffer.

What about a dolfin caught in a fishing net, they are known to be highly emotional animals, does their family not suffer?

Death is a part of life, however horrific or not, and I'm against PETA for one reason, where do you draw the line?

It is impossible for any living organism to survive without death.

Does that mean we have to have a little ritual every time we kill a living thing?

There's a religion out of india that believes all living things are important and try their best not to kill anything, although I don't think they count plants, maybe peta should join them.

I always take care of my business & I never whine when I'm faced with time. I don't think you have the knowledge to be judging Canadians or Chinamen as you put it dude.

We do pay our government to work for us.

The charge at the moment is 2nd degree murder. He's having a forensic psychological assessment. They can always change the charge(s) Li is the 2008 poster boy for schizophrenia. Either way you won't be seeing Li free for a long time if ever again.

Canada

As defined in the Criminal Code of Canada, murder is considered one type of culpable homicide, distinguished from the offences of manslaughter or infanticide. [30]

First and second degree

In Canada, murder is classified as either first or second degree.[31]

1. First degree murder is a murder which is (1) planned and deliberate, (2) contracted, (3) committed against an identified peace officer, (4) while committing or attempting to commit one of the following offences (hijacking an aircraft, sexual assault, sexual assault with a weapon, aggravated sexual assault, kidnapping and forcible confinement or hostage taking), (5) while committing criminal harassment, (6) committed during terrorist activity, (7) while using explosives in association with a criminal organization, or (8) while committing intimidation. [32]
2. Second degree murder is all murder which is not first degree murder.

Manslaughter and infanticide

1. Manslaughter is any culpable homicide which is not murder or infanticide. To kill someone with a deadly weapon, or may not be so.[33]
2. Infanticide is the killing of a newly-born child by its mother where the mother's mind was disturbed as a result of giving birth or of consequent lactation. It is a type of homicide but is excluded from murder.[34]

Penalties

The maximum penalties for murder are:

1. First degree murder - mandatory life imprisonment without the possibility of parole for 25 years (can be paroled under the Faint-Hope Clause after 15 years imprisonment, but such a reduction is rarely given and is not available for multiple murders)
2. Second degree murder - mandatory life imprisonment without the possibility of parole for 10-25 years (parole eligibility determined by the judge at sentencing) (exception: if the person had committed another murder in their past, parole eligibility is 25 years)

There is a clause where persons convicted of any "personal injury offence" meeting the statutory criteria to be declared a "dangerous offender." A dangerous offender is sentenced for an indeterminate period of imprisonment and is eligible for parole after serving at least 7 years. An offender convicted of 1st or 2nd degree murder is ineligible to be declared a dangerous offender. However, an offender convicted of manslaughter can be declared a dangerous offender.

Any sentence imposed in addition to a life sentence must be concurrent.
