Homosexuality was illegal and like with most laws, there is a two-tier justice system. IE - an oligarch committing tax fraud, and a middle class worker committing tax fraud are two entirely different things right? The middle class dude will go to jail, and the capitalist elite will MAYBE get a slap on the wrist.
Same was true for homosexuality because obviously the elite participated in it without any repurcussion from the law but if two average workers did they would be imprisoned or whatever. So turn of the century leftists viewed (incorrectly) that homosexuality was a sign of capitalist decadence.

The statement is neither incorrect nor is it out of date and as you know the argumentum ad populum to most modern leftists is not a not a valid argument, it is a fallacy.
