Would this apply to caregivers as well?
Or is it just for the MMJ centers and growing with offsite licenses.

Does that mean all grow would have to be powered by solar panels and wind turbines on the roof, That seems impossible to acomplish. I think that is what they are trying to say.

I believe you would have to purchase carbon off sets or something similar.

Really? wouldnt going 100% Solar /wind cost a small fortune for a decent grow...
Unless you mean Grow outside and use the sun.

The green power offset was not included in Boulder County land use bill. They did say that forestry and ag land are restricted for now because they went off of retail and office space land use regulations. Lots of Niwot residence complaining about the children.

SAVE THE CHILDREN! BAN BAN BAN! instead of actually EDUCATING their children, lets just hide it from them.

That didn't get put into the Boulder County regulations, only city of Boulder. The offset regulation also didn't pass. They are limiting dispensaries and commercial grows to areas zoned as:

Commercial
Business
Office
Light Industrial
General Industrial

They are basically treating dispensaries and grows as the same thing, until 1284 fully clarifies the differences. Areas and ranches zoned as forestry or agricultural were not included. They said they would consider adding agricultural, but not forestry due to the risk of fire. They also included the density regulation, requiring all grows/dispensaries to have at least 500 ft to each other. The problem is that there are only about a dozen areas in unincorporated Boulder County that are zoned for mmj, and the density requirement makes it so you can pretty much only have one location per zoned area. Currently, there is no licensing board for this, as it will be developed in accordance with upcoming HB1284. If you are an established location and you are not in full accordance with the new zoning regulations, you can file an appeal to the licensing board when it becomes established. They said they would consider a few exceptions within reason through the appeals board.

A few residents of the town of Niwot showed up to show their distaste for marijuana in general, but other than that I felt there was a good consensus of patients and the industry. One woman said she would like to see Boulder County completely outlaw even the 6 plants you get as a patient in a home grow, but they said they could not change that as it is a granted right in Amendment 20. An elderly gentleman came to the stand to speak, and I was thinking he was another Niwot resident ready to speak about how we've opened Pandora's box...but it turned out he had 40 acres of land zoned as agriculture and he was pissed off that he couldn't grow on it! He was the one that asked for the appeal process! I thought that was awesome! I gotta give it to the old farmer guy!

or are they already kicking the doors of little 6 plant med grows? If they arnt now, will they after this bill passes? If not will med patients with personal small grows have to use solar panels or windmills?

this shit is confusing
 
I do wonder what it will be like. I had 9 plants in a little 4x4 closet get inspected by the police a month or two ago. They said everything was in order and they left me alone, but man that shit can shake you up and I hope they're not planning on coming back now that these bills are passing

So I was reading the newest version of the bill, And I searched felony within it. Its not saying caregivers cant be felons anymore. Has anyone else noticed this. So I gues felons just cant be mmc, and grow op owners or employs right? but were good as caregivers?

Been there, done that... and your right even if the cops are cool, it still leaves a weird feeling after they leave...

So then it is business as usual for everyone until july 1, 2011?

Even though a dispensaries has to prove it can produce 70% by sept 1 2010, if the rest doesnt go into effect until july 2011, can caregivers have more than 5 patients and can caregivers sell their surplus to dispensaries until july 2011?

and is it possible someone will get an injunction on the bill into effect before july 2011, being 14 months away?

Personal grows are ok as long as you are compliant, they said over and over again that personally growing 6 plants for yourself is a constitutional right that no city, county or municipality can ban. What these places can do is put limits on the number of plants and moratoriums on MMC's.

Like today I heard that in Fort Collins, you can have up to 11 plants in your home, so basically you and one other person. Can someone who lives in The Fort confirm or deny this for me... I heard it from the assistant Boulder county attorney.


Tuesday night Boulder City council approved sweeping regulations for businesses that deal with medical marijuana. Here's a look at some of the major components of the proposal:

Dispensaries and growing operations have to be licensed through the city. A license costs $5,000 up front and $2,000 a year to renew.

Every business that grows medical marijuana on site must offset 100 percent of its electricity consumption by purchasing wind power, participation in a community solar garden or using on-site solar power.

Marijuana businesses must install 24-hour security cameras, a safe and other security measures. They must also submit business plans and security plans to the city.

No marijuana business can operate within 500 feet of a school, licensed day-care center or in areas that already have three or more other marijuana businesses within 500 feet.

Medical marijuana can't be sold from vehicles, only stationary storefronts. Deliveries to patients are allowed.

The city code is not a defense to federal laws that prohibit the possession or sale of marijuana.

Owners, managers and financiers of dispensaries must submit fingerprints and personal histories. A criminal history alone is not grounds for denying a license, but the city can require evidence of "rehabilitation" of such applicants. People deemed to be "not of good moral character" could be denied operating licenses.

Anyone younger than 18 must be accompanied by a parent or guardian when entering a dispensary.

Businesses can only keep enough of the drug on hand to serve the number of patients who designate them as primary caregivers.

Dispensaries have to maintain detailed records about patients, which the city will be allowed to inspect similar to a "bar check."

Dispensaries can only do business from 7 a.m. to 9 p.m.

No one is allowed to use medical marijuana, in any form, at a dispensary or in plain view of the public.

No operation can be larger than 3000 Sq ft

How can people still believe that we live in a free country, and that our economic system is still capitalist? Im gonna just do what i know is right, and pretend like i live in a free country. Just ignore this socialist bill.

Ha! You dont understand what TRUE CAPITALISM is. If our economy was truely capitalist, the government would not be writing bills regulating an industry. In true laize faire capitalism, the government stays out of economics. The part where the people from Cali hire a SENATOR , and the senator writes a bill . The senator is works for the goverment. When the government makes laws regulating the economy, and individual freedoms, that is socialism,or communism , they both suck. I am in favor of a true democracy , and capitalism. I cant stand this socialist republic, corporate monopoly we live in now.

My point is i think both sides promoting this bill are fucking sleazy. they are both wrong. I can sum it up with saying this isnt socialism or capitalism. It is straight up greed and corruption, as hoss said in his last sentence. lets not bring other political arguments into this thread and ruin it. it is still all good. we are all here for pot rights. THIS IS NOT A THREAD ON POLITICAL FUNDAMENTALS. I dont want this thread canned it is helping me dammit!!!!

Once the government gets involved, its not capitalism. This is a political thread, its about a bill! I am in favor of a free market, where anyone can grow and sell as much weed as they want. No government regulations and taxes on the sacred herb.

In all seriousness I really hope this joke of a bill gets tossed right in the fucking trash where it belongs. If this bill does stick it's going to be my life mission to make sure that these fucking idiots never get elected again... I suggest that everyone who is against this bill does the same..hell if for some miracle the governor vetos it, I'll still do the same..
