I agree with FreedomFGHTR here.

5' x 5' is tiny.

Outside that is literally just one large tree.

Nature didn't give me soil and sun to be limited to 1 plant by the government.

One plant is not a victory!

You know where the web site is.. Go voice your opinion and read what has been written.

I think if you want to grow commercially you can get a permit and get to it.

The bottom line is get involved.

Hey man, I seriously understand the desire for legalized MJ usage. But don't be like the politicians over in congress who don't read the laws before the vote for em........ I suggest you go and read the whole bill and not just the part that says "You can get high now". They give ya a little so they can take a lot.

It takes the tax money made from sales ($50.00 A POP !!!!) and creates a whole new government agency "Regulationary Task Force" that "regulates" the whole industry. PRIVATE as well as commercial.

This means you surrender YOUR PERSONAL RIGHTS the day you plant a seed or bring MJ to your house. Once you grow this task force will be allowed to "INSPECT" your growing area. If you grow........You will be limited to 5 square feet. Anything over that and your busted. Plastic baggies in the house? You must be selling. Scale?? Selling !! Now your a tax evader. Yeah I agree that that's what we have now. But instead........they make billions on it and you end up paying for more government workers with "union wages and benefits" to control YOU. Yeah......We need that don't we?

Its about controlling you, everything you do and TAXING YOU to fund it. If you want "California State Inspectors" coming to your house in their little white "Electric Hybrid" government supplied car that you paid for to verify your 5x5 outdoor garden.........have at it man. ............."Would you mind if we 'inspected' indoors as well Sir"? No? "Ok........We'll be back".

Not me. I'm in the 46%tile for the bill "As it is written". A different version maybe. Not this one IMO.

And taxes are not a capitalist idea. Its a socialist idea.

I know for a fact the san diego board of supervisors will not wants sales of MJ so there will be no growing in san diego.

Why lump growing in with sales, they are two different things?

Why would I vote for a law like this?

When prohibition of alcohol ended the people didn't say let the local cities and gov decide if they want to sell alcohol.

The people DEMANED that it be sold everywhere, as is now the case with alcohol in CA, it's the same for every jurisdiction.

We are winning the war right now, prohibition of MJ is about to end. There is no reason to settle for scraps thrown by our local governments.

It's time to drop the hammer and demand MJ be legal EVERYWHERE in CA.

Just because Richard Lee knows oakland will permit sales, I sure hope he doesn't expect to use the force of the population of CA just to get MJ legal in his neck of the woods.
An iniative either hurts or benefits everyone in the state equally, otherwise it's a bad initiative.

JackTheGrower, I just won't vote for this law in san diego and neither will many others if it means no growing so you better take this issue up with the "higher ups" because san diego has a sizable population and a no vote here will dent this initative badly.

I'll try and read through the latest draft language and be more informed but consider this..

If it's 25 sq ft isn't that "per Adult" in the household?


Maybe as long as the plant stalk is inside the 25 sq ft I think that's legal. That it will grow outside that boundary is Nature.

The more I think about 25 Sq Feet the more I like it.

About that Ounce.. I am guessing since I have to read the draft but, that would be if you were stopped and checked and had an ounce it's okay.. More than that it isn't.


I'm thinking this TaxCannabis2010 is better than we are letting ourselves think.

Their approach. a ballot initiative is the correct one to take. But how they want to do it is wrong. Really all they need is to do two things. Have california remove all cannabis offenses from penal code and health and safety code and peg the taxation at sales tax. Pretty damn simple and it would pass. We don't need regulation and county authority. I thought thats what legalization is, getting rid of the regulations the prohibit the free flow of cannabis.

well Jack actually by the voters giving local governments the authority to regulate and tax themselves.. the prices could be higher and leaves open a clean slate for a whole new era of screwing Cannabis over in California.

Well I can speak from a medical point of view on that one.

In my county I am allowed to grow within a certain amount of space. (square feet) The method of measurement is "Total Canopy". They would measure from leaf tip to leaf tip at the widest points and that's the square footage of the plant.

Any leaf tip that extended beyond the 25 (total) square feet would make that plant or plants illegal.

When growing for Medical.......the suggestion is to stay Under the allowed space to be sure your within the legal limit allowed.

Using that method..........you would use a 4.5 x 4.5 space to grow under this bill which would give you approx. 20 square feet to remain "safe".

To clarify:
You would measure leaf tip to leaf tip to get square footage.
Not......How many main stalks can I fit in a 5x5 square.

I study every subject brought before me to vote on and I research as many candidates as I can when elections are coming up.

I refuse to vote for something or for anyone I know nothing about.

If all Americans did this............we wouldn't be in the hole we are in today.

Well these polls that say 56% (or something like that) likely voters would legalize and tax marijuana. What I am suggesting is that. Legalize and set the tax rate. It's what people are saying yes to in the polls. It doesn't need to be complex. People are saying they want to remove regulations, not change them.

It's great that we are discussing this.. It's not final and that's why we need people discussion.

Where are you that the canopy must be so? I don't remember that in Prop 215

If it passes as written then san diego will have 0 sq feet to grow in.

Are you going to talk to richard lee about what I said in my previous posts?

Well I see where your coming from but Blue Dot said it well.

All I can say is this........Its not the space issue for me. Its the 17 to 20% tax that eventually funds a whole new government agency to check up on ya. Try amending that out later. NOT !! Expect the tax to go up and the agency to get bigger. Has it ever been any different?

Answer to your question:
Prop 215 allows 12 plants per patient. SB-420 which came later allows the counties and cities to regulate locally and set their own limits. (but never less than the 12 total)

In my county (Santa Cruz) I am allowed to have 100 square feet (10 x 10) of canopy (Per patient) !! No matter how many plants I can fit within that space.

It's 100 square feet per patient so I went and got medical cards for myself / 2 dogs / one cat and a lizard.

Thats the problem with ballot propositions is that once they are passed they are kinda hard to amend. It's also what makes them so strong. It's a double edged sword thats 12 feet long. It's not a wise thing to use unless absolutely necessary and then make sure its handled with care.
