I agree with you somewhat; however, if everyone in this country thought the way you do, there would NEVER be ANY change. There are so many people who had the courage to take a stand, and those people created movements and made history.

I get what you're saying. I feel that way sometimes too. I just think that if everyone in this country felt that they were powerless, there would be no change. Imagine if M.L.King Jr. had felt powerless...

Accessible from just about any leo outfit. They might not be targeting a weed site troll...but just wait to you fuck up some day or do come under the radar of a cop...

Yep... and I've always been a bit of an conspiracy theorist. I'm just surprised that people are surprised by this. Our government is corrupt and has been for a long time; however, we do live in a powerful country ran by powerful people who can most likely access our gps pinpoint, jump on the satellites which can see right through the roof of our houses, and zoom in to see our tiny little fingers typing on our laptops on the couch. Scary shit! BUT how does that affect me? It doesn't. Nothing I do or say could possibly be that important to the government... they probably have a reason and a motive for doing what they're doing. We do not know what that is and probably never will. Does that make it ok or moral? No. But the average person, which most of us are, is not on their agenda.

There is no great awakening going to occur....where everyone embraces each other with sanity. It's not a part of the human condition..so...move on.

It's a greedy world...but then...when has it not been? Situational awareness. I've no interest in marching around trying to change people's minds...but you do....good....have at it. I wouldn't know what to say.

You are thinking like a person who wayne described a couple back. A person who has little hope for their future and thinks they will always be on the bottom of the totem pole. Those are the people who should in deed just be quiet and TAKE IT like the rest of their kind do which is really a result of something they were born with and cant help: stupidity.

They claim it is for terrorism. over 10 billion spent each year on the program and there have been other problems that are worse then "terrorism" that get nowhere near the amount of funding that the NSA gets from the american taxpayers. Americans were duped just like LilWaynE said. Duped into the terrorism scheme.

Now light has been shed on what is really happening and that is that innocent americans (yes even the ones who think there is no reason the government would EVER look at them) are having their rights violated by the second and it seems most don't even realize where they are headed....

Federal 'nudge squad' led by 20-something wunderkind gears up to change Americans' behaviors – for our own good


When does a nudge become a shove?


Americans may find out in coming years, as the federal government is setting up a 'behavioral insights team' to tinker with the way we accomplish everything from saving money and staying in school to losing weight and becoming more energy-efficient.

A document from Maya Shankar, a late-20s Yale graduate and former violin prodigy, sketches out the Obama administration's grand plans for behavioral science.

Shankar joined the Obama administration in April as a senior policy advisor at the White House Office of Science & Technology Policy.


'nsights from the social and behavioral sciences can be used to help design public policies that work better, cost less, and help people to achieve their goals,' says her proposal, first spotted by Fox News when Shankar sought help from a university professor.


In 2006 Shankar was named one of Glamour magazine's 'Top Ten College Women,' telling the editors that her dream job was to become 'Science advisor to the president.' A handful of years later, she's already there.

Shankar's mandate is to reproduce a British pilot project in the U.S. Launched in 2010, it identifies and tests 'interventions' that can save the government money, and drives ordinary Britons to embrace behaviors that the government finds desirable and cost-effective.

In the UK, a series of bulletins from the office of the Prime Minister's cabinet sketch out how broad the approaches have become. They have already tackled wasting food, cheating on exams, job-seeking schedules, skimping on charitable giving, drinking milk, morning commutes, choosing sources of energy and sticking to New Year's resolution.

Now the concept is poised to enter America with a formal structure consisting of a team to oversee clinical experiments to see what works and what doesn't. Shankar's memo suggests the project is already up and running.

'We are already working with over a dozen federal departments and agencies on newly-designed behavioral insights projects,' the document reads, 'including the Department of Labor, Department of Health and Human Services, Department of Education, Veterans Administration, Department of Treasury, Social Security Administration, Department of Housing and Urban Development, and the United States Department of Agriculture.'


Shankar did not respond to a request for comment. She finished her postdoctoral research at Stanford this year, where her faculty advisor was Dr. Samuel McClure.

McClure studies 'delay discounting,' the habit of giving up large future rewards in favor of smaller bonuses in the short term.

Some behavioral scientists believe they can improve people's self-control by understanding the relationship between short term memory, intelligence and delay discounting.

This has mostly been used to counter compulsive gambling and substance abuse, but Shankar's entry into government science circles may indicate that health insurance objectors and lapsed recyclers could soon fall into a similar category.

The science community is split on the value of 'nudge paternalism' in government.

Richard Thaler, who co-authored the book 'Nudge' with former White House regulatory czar Cass Sunstein, told Fox News that anyone 'who would not want such a program ... must either be misinformed or misguided.'

'The goal is to improve the efficiency and effectiveness of government by using scientifically collected evidence to inform policy designs. What is the alternative?' Thaler asked.


But Utah State University economist Michael Thomas said he was 'very skeptical of a team promoting nudge policies' in Washington.


'Ultimately, nudging ... assumes a small group of people in government know better about choices than the individuals making them.'

After three years, the British government announced in May that it would seek to find a commercial sponsor and privatize the entire project, making it 'the first policy unit to spin off from central government,' according to Cabinet Minister Francis Maude.

Initial reports that the agency is on course to save the government $483 million over five years may make it a valuable takeover target for a private industry seeking to trim its own fat while acquiring the cachet of scientific relevance.

David Halpern, its government director, has claimed that 'billions will be saved.'


In the U.S., however, there's no indication that the White House's 'nudge unit' will be anything other than a government enterprise.

That may not bode well for the Obama administration, given the cautionary tale posed by New York City Mayor Michael Bloomberg, whose long-ridiculed ban on large-size fizzy drinks has officially fallen flat.

An appeals court ruled Tuesday that the city's Board of Health didn't have the constitutional authority to limit how much soda can go into a restaurant's cup.


The measure was originally hailed as a perfect example of 'nudge' paternalism that would subtly change behaviors without preventing the truly thirsty from buying two cups.


But the ruling will set a precedent that opens up such government interventions to legal nannying of its own from industries whose bottom lines are affected when bureaucracies try to tweak what ordinary people do, and how they do it.

A Key Element of SOPA Is Back

lot of things contributed to the demise of the infamous Stop Online Piracy Act, a 2012 legislative proposal to severely restrict online content sharing.

There were blackouts by content sharers Wikipedia and YouTube and thousands of citizens who called or emailed their members of Congress. Ultimately President Obama came out against SOPA, as did lawmakers on the left and right, and the bill was shelved.

Early in that debate, about 50 petitioners went to the White House site We the People to demand SOPA be shut down. That didn’t make much difference to SOPA but it meant a lot for We the People, which was only a few months old when the SOPA petition launched and had only seen a handful of popular petitions up to that point.

Now a key element of SOPA is back in a report from the Commerce Department’s Internet Policy Task Force and the protesters are back on We the People. A petition to Stop SOPA 2013 has received more than 88,000 signatures since it was posted Thursday and is well on its way to acquiring the 100,000 signatures necessary for an official White House response.

The Commerce proposal would make it a felony to stream copyrighted works without permission. That might include the parody and homage music videos that clog the pores of YouTube and could ensnare even Justin Bieber in its dragnet.

In response to a similar proposal in legislation by Sen. Amy Klobuchar, D-Minn., the teen heart throb said the senator should be “put away in cuffs.”

jericho, i don't know how old you are but let's look at this from a parent's perspective.

are you going to teach your kids "to be realistic and not try to make positive changes manifest in their lives"?

are you going to cut off your children's nut-sacks?

without the encouragement in the fact that human's can manifest they effectively lose their ability to manifest.

this nsa program is a threat to all of humanity. it must be dealt with globally.

the first giant baby step is to inform the masses of the truth.

the second giant baby step is to inform the masses that we can make a difference.

the anti-cabal movement will gather power and manifest itself subsequently. we don't need to generate a 1000 page manifesto apriori to get it done.

SAN FRANCISCO (Reuters) - If the United States attacks Syria, it will be the first time it strikes a country that is capable of waging retaliatory cyberspace attacks on American targets.
The risk is heightened by Syria's alliance with Iran, which has built up its cyber capability in the past three years, and already gives the country technical and other support. If Iran stood with Syria in any fray with the United States that would significantly increase the cyber threat, security experts said.
Organized cyber attacks have already been carried out by the Syrian Electronic Army (SEA), a hacking group loyal to the government of President Bashar al-Assad. It has disrupted the websites of U.S. media and Internet companies and is now threatening to step up such hacking if Washington bombs Damascus.
"It's likely that the Syrian Electronic Army does something in response, perhaps with some assistance from Iranian-related groups," said former White House cyber security and counter terror advisor Richard Clarke.
Little is known about the hackers behind the Syrian Electronic Army, and there is no evidence that the group is capable of destructive attacks on critical infrastructure.
However, former U.S. National Security Agency director Michael Hayden told Reuters that the SEA "sounds like an Iranian proxy," and it could have much greater ability than it has displayed.
Thus far, the SEA's most disruptive act was in April when it broke into the Twitter account of the Associated Press and sent fictional tweets about explosions at the White House. The false messages sent the stock market into a downward spiral that, for a short time, erased more than $100 billion in value.
In an email to Reuters on Wednesday, the SEA said if the U.S. military moves against Syria "our targets will be different."
"Everything will be possible if the U.S. begins hostile military actions against Syria," the group said in the note.
President Barack Obama vowed on Wednesday that the Syrian government would face "international consequences" for last week's deadly chemical attack in Syria, but he made clear that any military action would be limited.
Asked about the threat of cyber retaliation, U.S. Department of Homeland Security spokesman Peter Boogaard said the government "is closely following the situation and actively collaborates and shares information with public and private sector partners every day."
A U.S. Department of Defense spokesman said he could not discuss specific threats, while another source at the Pentagon said no unusual activity had been detected by late on Wednesday.
IRAN SHARPENS ITS GAME
Cyber experts have said that Iran increased its cyber capabilities after the United States used the Stuxnet virus to attack Tehran's nuclear program.
U.S. intelligence officials have blamed hackers sponsored by Iran for a series of so-called distributed-denial-of-service attacks against many U.S. banking sites. In DDoS attacks, thousands of computers try to contact a target website at the same time, overwhelming it and rendering it inaccessible.
In three waves of attacks since last September, consumers have reported inability to conduct online transactions at more than a dozen banks, including Wells Fargo & Co, Citigroup Inc, JPMorgan Chase & Co and Bank of America Corp. Banks have spent millions of dollars to fend off the hackers and restore service.
Researchers have said that Iran has also infiltrated Western oil companies, and it could try to destroy data, though that would increase the risk of retaliation by the United States.
Things in cyberspace would get more complicated if Russia, an ally of Iran and Syria, were to step in. Former Obama administration officials have said that Russia, which has supplied arms to Syria, has cyber capabilities nearly as powerful as the United States.
Even if the Russian government did not act directly, the country's private hackers rank with those in China in their ability and willingness to conduct "patriotic" attacks. Cyber experts have said that Russian hackers have struck at government and other sites in Estonia and Georgia.
The Syrian Electronic Army's servers are based in Russia, and that alliance could strengthen if matters in Syria became more dramatic, said Paul Ferguson of the Internet security company IID.
"We already have a bad geopolitical situation," Ferguson said. "This could play into the entire narrative I don't want to see happen."
It is unclear how much cyber damage Syria could or would want to inflict, said Dmitri Alperovitch, chief technology officer of security firm CrowdStrike.
"We haven't seen significant intrusion capabilities from them or destructive capabilities," he said.
Earlier this week, as the Obama administration pushed for more support for strikes on Syria, the New York Times, Twitter and the Huffington Post lost control of some of their websites. The SEA claimed responsibility for the attacks.
Security experts said electronic records showed that NYTimes.com, the only site with an hours-long outage, redirected visitors to a server controlled by the Syrian group.
The SEA had planned to post anti-war messages on the Times site but was overwhelmed by the traffic it received and its server crashed, the SEA said by email. Late on Wednesday, some users still could not access NYTimes.com.
The SEA managed to gain control of the New York Times web address by penetrating MelbourneIT, an Australian Internet service provider that sells and manages domain names.
It could have done much worse with such access, experts said, underscoring the vulnerability of major companies that use outside providers.
"Chief information officers need to realize that critical pieces of their online entities are controlled by vendors and that security policies should apply to them as well," said Amichai Shulman, chief technology officer at security firm Imperva.

I have a feeling that the "Syrian Electronic Army" is really composed of members of the NSA.... similar to how I also feel that members of "ANONYMOUS" are ALSO members of the NSA! Why would the Syrian Electronic Army, (if they really were in Syria) take down twitter and the New York Times? Two of the electronic organizations within America who have been exposing the NSA's secrets to not only their fellow Americans but also the world alike... Syria has no need to go after these organizations BUT NICE TRY NSA/Obama Admin!

remember when they were talking about how obama can shut down the internet in the US based on a law that HE created? well that IS true, and Obama DID in fact write up a law that gives him the power to do so....yep. He just made it up and it became law. Simple as that.

I have a feeling he is going to use the "Syrian Electronic Army" as an excuse for why our internet was taken down.... because it is only a matter of time if you ask me...Obama will go after Syria simply so he can make the internet and all communications go offline for a while.....

ASSIGNMENT OF NATIONAL SECURITY AND
EMERGENCY PREPAREDNESS COMMUNICATIONS FUNCTIONS

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:

Section 1. Policy. The Federal Government must have the ability to communicate at all times and under all circumstances to carry out its most critical and time sensitive missions. Survivable, resilient, enduring, and effective communications, both domestic and international, are essential to enable the executive branch to communicate within itself and with: the legislative and judicial branches; State, local, territorial, and tribal governments; private sector entities; and the public, allies, and other nations. Such communications must be possible under all circumstances to ensure national security, effectively manage emergencies, and improve national resilience. The views of all levels of government, the private and nonprofit sectors, and the public must inform the development of national security and emergency preparedness (NS/EP) communications policies, programs, and capabilities.

Sec. 2. Executive Office Responsibilities.

Sec. 2.1. Policy coordination, guidance, dispute resolution, and periodic in-progress reviews for the functions described and assigned herein shall be provided through the interagency process established in Presidential Policy Directive-1 of February 13, 2009 (Organization of the National Security Council System) (PPD-1).

Sec. 2.2. The Director of the Office of Science and Technology Policy (OSTP) shall: (a) issue an annual memorandum to the NS/EP Communications Executive Committee (established in section 3 of this order) highlighting national priorities for Executive Committee analyses, studies, research, and development regarding NS/EP communications;

(b) advise the President on the prioritization of radio spectrum and wired communications that support NS/EP functions; and

(c) have access to all appropriate information related to the test, exercise, evaluation, and readiness of the capabilities of all existing and planned NS/EP communications systems, networks, and facilities to meet all executive branch NS/EP requirements.

Sec. 2.3. The Assistant to the President for Homeland Security and Counterterrorism and the Director of OSTP shall make recommendations to the President, informed by the interagency policy process established in PPD-1, with respect to the exercise of authorities assigned to the President under section 706 of the Communications Act of 1934, as amended (47 U.S.C. 606). The Assistant to the President for Homeland Security and Counterterrorism and the Director of OSTP shall also jointly monitor the exercise of these authorities, in the event of any delegation, through the process established in PPD-1 or as the President otherwise may direct.

Sec. 3. The NS/EP Communications Executive Committee.

Sec. 3.1. There is established an NS/EP Communications Executive Committee (Executive Committee) to serve as a forum to address NS/EP communications matters.

Sec. 3.2. The Executive Committee shall be composed of Assistant Secretary-level or equivalent representatives designated by the heads of the Departments of State, Defense, Justice, Commerce, and Homeland Security, the Office of the Director of National Intelligence (DNI), the General Services Administration, and the Federal Communications Commission, as well as such additional agencies as the Executive Committee may designate. The designees of the Secretary of Homeland Security and the Secretary of Defense shall serve as Co-Chairs of the Executive Committee.

Sec. 3.3. The responsibilities of the Executive Committee shall be to: (a) advise and make policy recommendations to the President, through the PPD-1 process, on enhancing the survivability, resilience, and future architecture of NS/EP communications, including what should constitute NS/EP communications requirements;

(b) develop a long-term strategic vision for NS/EP communications and propose funding requirements and plans to the President and the Director of the Office of Management and Budget (OMB), through the PPD-1 process, for NS/EP communications initiatives that benefit multiple agencies or other Federal entities;

(c) coordinate the planning for, and provision of, NS/EP communications for the Federal Government under all hazards;

(d) promote the incorporation of the optimal combination of hardness, redundancy, mobility, connectivity, interoperability, restorability, and security to obtain, to the maximum extent practicable, the survivability of NS/EP communications under all circumstances;

(e) recommend to the President, through the PPD-1 process, the regimes to test, exercise, and evaluate the capabilities of existing and planned communications systems, networks, or facilities to meet all executive branch NS/EP communications requirements, including any recommended remedial actions;

(f) provide quarterly updates to the Assistant to the President for Homeland Security and Counterterrorism and the Director of OSTP, through the Co-Chairs, on the status of Executive Committee activities and develop an annual NS/EP communications strategic agenda utilizing the PPD-1 process;

(g) enable industry input with respect to the responsibilities established in this section; and

(h) develop, approve, and maintain a charter for the Executive Committee.

Sec. 4. Executive Committee Joint Program Office.

Sec. 4.1. The Secretary of Homeland Security shall establish an Executive Committee Joint Program Office (JPO) to provide full-time, expert, and administrative support for the Executive Committee's performance of its responsibilities under section 3.3 of this order. Staff of the JPO shall include detailees, as needed and appropriate, from agencies represented on the Executive Committee. The Department of Homeland Security shall provide resources to support the JPO. The JPO shall be responsive to the guidance of the Executive Committee.

Sec. 4.2. The responsibilities of the JPO shall include: coordination of programs that support NS/EP missions, priorities, goals, and policy; and, when directed by the Executive Committee, the convening of governmental and nongovernmental groups (consistent with the Federal Advisory Committees Act, as amended (5 U.S.C. App.)), coordination of activities, and development of policies for senior official review and approval.

Sec. 5. Specific Department and Agency Responsibilities.

Sec. 5.1. The Secretary of Defense shall: (a) oversee the development, testing, implementation, and sustainment of NS/EP communications that are directly responsive to the national security needs of the President, Vice President, and senior national leadership, including: communications with or among the President, Vice President, White House staff, heads of state and government, and Nuclear Command and Control leadership; Continuity of Government communications; and communications among the executive, judicial, and legislative branches to support Enduring Constitutional Government;

(b) incorporate, integrate, and ensure interoperability and the optimal combination of hardness, redundancy, mobility, connectivity, interoperability, restorability, and security to obtain, to the maximum extent practicable, the survivability of NS/EP communications defined in section 5.1(a) of this order under all circumstances, including conditions of crisis or emergency;

(c) provide to the Executive Committee the technical support necessary to develop and maintain plans adequate to provide for the security and protection of NS/EP communications; and

(d) provide, operate, and maintain communication services and facilities adequate to execute responsibilities consistent with Executive Order 12333 of December 4, 1981, as amended.

Sec. 5.2. The Secretary of Homeland Security shall: (a) oversee the development, testing, implementation, and sustainment of NS/EP communications, including: communications that support Continuity of Government; Federal, State, local, territorial, and tribal emergency preparedness and response communications; non-military executive branch communications systems; critical infrastructure protection networks; and non-military communications networks, particularly with respect to prioritization and restoration;

(b) incorporate, integrate, and ensure interoperability and the necessary combination of hardness, redundancy, mobility, connectivity, interoperability, restorability, and security to obtain, to the maximum extent practicable, the survivability of NS/EP communications defined in section 5.2(a) of this order under all circumstances, including conditions of crisis or emergency;

(c) provide to the Executive Committee the technical support necessary to develop and maintain plans adequate to provide for the security and protection of NS/EP communications;

(d) receive, integrate, and disseminate NS/EP communications information to the Federal Government and State, local, territorial, and tribal governments, as appropriate, to establish situational awareness, priority setting recommendations, and a common operating picture for NS/EP communications information;

(e) satisfy priority communications requirements through the use of commercial, Government, and privately owned communications resources, when appropriate;

(f) maintain a joint industry-Government center that is capable of assisting in the initiation, coordination, restoration, and reconstitution of NS/EP communications services or facilities under all conditions of emerging threats, crisis, or emergency;

(g) serve as the Federal lead for the prioritized restoration of communications infrastructure and coordinate the prioritization and restoration of communications, including resolution of any conflicts in or among priorities, in coordination with the Secretary of Defense when activities referenced in section 5.1(a) of this order are impacted, consistent with the National Response Framework. If conflicts in or among priorities cannot be resolved between the Departments of Defense and Homeland Security, they shall be referred for resolution in accordance with section 2.1 of this order; and

(h) within 60 days of the date of this order, in consultation with the Executive Committee where appropriate, develop and submit to the President, through the Assistant to the President for Homeland Security and Counterterrorism, a detailed plan that describes the Department of Homeland

Security's organization and management structure for its NS/EP communications functions, including the Government Emergency Telecommunications Service, Wireless Priority Service, Telecommunications Service Priority program, Next Generation Network Priority program, the Executive Committee JPO, and relevant supporting entities.

Sec. 5.3. The Secretary of Commerce shall: (a) provide advice and guidance to the Executive Committee on the use of technical standards and metrics to support execution of NS/EP communications;

(b) identify for the Executive Committee requirements for additional technical standards and metrics to enhance NS/EP communications;

(c) engage with relevant standards development organizations to develop appropriate technical standards and metrics to enhance NS/EP communications;

(d) develop plans and procedures concerning radio spectrum allocations, assignments, and priorities for use by agencies and executive offices;

(e) develop, maintain, and publish policies, plans, and procedures for the management and use of radio frequency assignments, including the authority to amend, modify, or revoke such assignments, in those parts of the electromagnetic spectrum assigned to the Federal Government; and

(f) administer a system of radio spectrum priorities for those spectrum-dependent telecommunications resources belonging to and operated by the Federal Government and certify or approve such radio spectrum priorities, including the resolution of conflicts in or among such radio spectrum priorities during a crisis or emergency.

Sec. 5.4. The Administrator of General Services shall provide and maintain a common Federal acquisition approach that allows for the efficient centralized purchasing of equipment and services that meet NS/EP communications requirements. Nothing in this section shall be construed to impair or otherwise affect the procurement authorities granted by law to an agency or the head thereof.

Sec. 5.5. With respect to the Intelligence Community, the DNI, after consultation with the heads of affected agencies, may issue such policy directives and guidance as the DNI deems necessary to implement this order. Procedures or other guidance issued by the heads of elements of the Intelligence Community shall be in accordance with such policy directives or guidelines issued by the DNI.

Sec. 5.6. The Federal Communications Commission performs such functions as are required by law, including: (a) with respect to all entities licensed or regulated by the Federal Communications Commission: the extension, discontinuance, or reduction of common carrier facilities or services; the control of common carrier rates, charges, practices, and classifications; the construction, authorization, activation, deactivation, or closing of radio stations, services, and facilities; the assignment of radio frequencies to Federal Communications Commission licensees; the investigation of violations of pertinent law; and the assessment of communications service provider emergency needs and resources; and

(b) supporting the continuous operation and restoration of critical communications systems and services by assisting the Secretary of Homeland Security with infrastructure damage assessment and restoration, and by providing the Secretary of Homeland Security with information collected by the Federal Communications Commission on communications infrastructure, service outages, and restoration, as appropriate.

Sec. 6. General Agency Responsibilities. All agencies, to the extent consistent with law, shall: (a) determine the scope of their NS/EP communications requirements, and provide information regarding such requirements to the Executive Committee;

(b) prepare policies, plans, and procedures concerning communications facilities, services, or equipment under their management or operational control to maximize their capability to respond to the NS/EP needs of the Federal Government;

(c) propose initiatives, where possible, that may benefit multiple agencies or other Federal entities;

(d) administer programs that support broad NS/EP communications goals and policies;

(e) submit reports annually, or as otherwise requested, to the Executive Committee, regarding agency NS/EP communications activities;

(f) devise internal acquisition strategies in support of the centralized acquisition approach provided by the General Services Administration pursuant to section 5.4 of this order; and

(g) provide the Secretary of Homeland Security with timely reporting on NS/EP communications status to inform the common operating picture required under 6 U.S.C. 321(d).

Sec. 7. General Provisions. (a) For the purposes of this order, the word "agency" shall have the meaning set forth in section 6.1(b) of Executive Order 13526 of December 29, 2009.

(b) Executive Order 12472 of April 3, 1984, as amended, is hereby revoked.

(c) Executive Order 12382 of September 13, 1982, as amended, is further amended by striking the following language from section 2(e): "in his capacity as Executive Agent for the National Communications System".

(d) Nothing in this order shall be construed to impair or otherwise affect:

(i) the authority granted by law to an agency, or the head thereof; or

(ii) the functions of the Director of the OMB relating to budgetary, administrative, or legislative proposals.

(e) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

(f) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.
