Yea one good lesson to learn in life ... is its not your business .. just because you see something doesnt make it your business ... just keep moving .. mind your own business. Im sure this guy is plenty aware of his own situation .. if hes not .. its not your business anyways. This is a life lesson that will serve you well in many situations.
I only read your original post and about the 1st page of comments, but here's my idea..
Top the 2 plants (or 1 plant, again lol) right at the fence haha.. Keeps him out of danger, kind of, and keeps everyone else from seeing it and he should get the hint. Yeah just cut the branches right where they meet the fence or slightly lower, maybe a bad idea if they're budding already though which I'm sure they are

thats the problem with the community as it is, no one knows shit about each other and nothing changes and the more shit stays the same the worse it gets.
to the OP:
that shit happened to you and you remember DAMNED well how that shit felt dont you?! so why would you:
1) not warn the cat and watch someone go through the same shit you went through
2) not take a chance to warn a fellow grower who obviously (hello!) grows and you can have, at the very least, some manner of neighborly acquaintance with?
this shit is just getting stupid now! all this "cloak and dagger/ living like a hermit/ shut in" bullshit is getting outta hand. yes in certain places its absolutely necessary but if its not then why does it have to take precedence over common sense all the damned time?!
for me, i cant tell anyone or socialize about it in my area cause:
-i live around a bunch of fuck nutz who, i really think, are idiotic enough to try some dumbshit while im away
-draw way too much unnecessary attention to themselves (literally 2 minutes before i saw this post, i had to run outside to see what all the popping noise was about and the usual fuck nutz decided they wanted the do a post 2012/pre 2013 4th of july fireworks display; i step to the door and one moron is actually yelling "more, more, more!")
-live around a bunch of cops, hell, my nxt door neighbor just became a cop after 10+ odd years in school security system, i dont know about you guys areas but out here in NJ they take this school shit pretty friggin seriously.
BUT if your area is one that pretty much cool and laid back then i consider you fortunate and you should go make some mention of it in the least. and if its like you said that the trees are peaking over the top of the fence in plain damned view then he/she could probably give a fuck but at the same time would need to know that, that kind of advertisement can bring the assholes out from under their rocks.
trust me, you are a grower yourself and you are mature enough to understand how to be tactful, and if he/she is growing like that then you know we all have a universal code that we can pick up on.
i may not have met you but believe me, you know damned well that if we met in the right place and said the right things then we would know exactly what the other was talking about.

...Or, the dude could actually be a prick. The OP tells him and now has an additional person/potential ripper (Aside from the rippers that got him already.) that now knows he grows. How many people would he tell? Now the OP has his whole neighborhood after his next crop...
Close your eyes when you walk that area, choose another street to walk down...Whatever, just forget about it. See no evil. Speak no evil and hear no evil. Low key and anonymous is always the best option in these situations.
