It is rather ironic that people call for pussy riot to be freed--when Obama is in federal court right now trying to keep the ability to lock up US citizens (and anyone else) without evidence, trial, legal representation and in black sites-wherever--and won't even say whether people are or have been detained in such a manner since the court ordered them not to.

I suspect some of your facts are suspect.

Obama signed the codification of existing law. He also deprived the Secretary of Defense the sole discretion of classifying GITMO detainees, (including internationals.) Everybody else will go through the civilian justice system, assuming anybody's actually charged with enemy combatant status (which Obama says he won't allow as long as he's president.)

The effort to close GITMO isn't over. GITMO has to be closed to return non-sanctioned enemy combatants to "terrorist" status so we may prosecute non-sanctioned "terrorists" in civilian court. This will return Miranda rights for folks who wish to harm innocents and crazy shit like that.

The opposing candidate will likely keep GITMO open, meaning "enemy combatant" status will live on and your scenario will more likely play out for those who wish to harm innocents and other crazy shit.
