WA might ban MMJ doctors.

Would like to update you all on the current state of the bill. It is currently getting ready for its second reading in the House.

They have totally fucked up the bill.

Example:

EFFECT: Requires the Department of Health (DOH) to reimburse
qualifying patients for any pizza consumed by the qualifying patient
while he or she was under the influence of medical cannabis.
Requires the DOH to reimburse the patient no later than five
business days after the patient submits a receipt for the pizza.
Prohibits the DOH from reimbursing the patient for delivery charges,
gratuities, or toppings in excess of three. Defines "pizza" as a
pie with a bread crust topped with tomato sauce, cheese, and various
toppings. Clarifies that "pizza" includes Chicago style deep dish,
New York style thin crust, and stuffed crust.

Actually, thats the only good part of the bill, every thing else, sucks. In its current state, it will ban collective gardens, MMJ doctors, and won't give arrest protections for patients who don't sign up for 'the list'.

some of my faves:
no MMJ growers at all, just DOH and DOA to grow it.
No MJ under 21 years old
MMJ within 500ft of a minor is a criminal offense
and on and on...

we need to urge our reps to KILL THIS THING.

Whatever, this is easy to get around. Just hold onto your current MMJ doctor's contact info and find out where he/she normally practices medicine. Make an appointment to see them like any other normal doctor. You know they are going to sign a recommendation already.

I think this is more to curtail the numerous referral agencies that have popped up that setup the clinics with the docs. Which also sucks, by the way.

It passed the Senate with the amendment banning the MMJ doctors. I recommend people who got their's at a clinic, if they have to renew yearly, next time they go in (before this new law kicks in), to ask the doctor to make it so their recommendation never expires. This law does not invalidate your recommendation.

just have the doc fill out like 50 to 80 of them. one for each year of the rest of your life.
 
Well. The worst of the amendments have been removed. Says it passed 3rd reading. Though even with the worst amendments killed, this thing still sucks. Hopefully Sensible Washington will get their initiative on the ballot this year, and the medical patients will be just like everyone else.

I'm a LEGAL Washington grower and regardless what they do I'm growing and smoking til I croak! Fuck`em! My dad has the V.A in his corner. They paid for his card,lights,complete setup...wtf are they gonna say to that! I swear,these bitches always wanna change shit..they need to fix the current laws and make sense of that b4 they go making new rules...FUCK THE REPUBLICAN in FAKEWOOD!

I love when law makers try to control something that they can't even begin to fathom the benefits it has for us patients...it boils my blood.
 
The bill specifically does not protect Patients or Providers against arrest if they are not on the DOH patient registry, but does say that the police can take them into custody if they are over the limits set. Which makes me believe that you can only be taken into custody if you are over the limit. I'll put the actual text here in a minute.

19 A qualifying patient or designated
20 provider who is not registered with the registry established in section
21 901 of this act may raise the affirmative defense set forth in
22 subsection (2) of this section, if:
23 (a) The qualifying patient or designated provider presents his or
24 her valid documentation to any peace officer who questions the patient
25 or provider regarding his or her medical use of cannabis;
26 (b) The qualifying patient or designated provider possesses no more
27 cannabis than the limits set forth in RCW 69.51A.040(1);
28 (c) The qualifying patient or designated provider is in compliance
29 with all other terms and conditions of this chapter;
30 (d) The investigating peace officer does not have probable cause to
31 believe that the qualifying patient or designated provider has
32 committed a felony, or is committing a misdemeanor in the officer's
33 presence, that does not relate to the medical use of cannabis;
34 (e) No outstanding warrant for arrest exists for the qualifying
35 patient or designated provider; and
36 (f) The investigating peace officer has not observed evidence of
37 any of the circumstances identified in section 901(4) of this act.
1 (2) A qualifying patient or designated provider who is not
2 registered with the registry established in section 901 of this act,
3 but who presents his or her valid documentation to any peace officer
4 who questions the patient or provider regarding his or her medical use
5 of cannabis, may assert an affirmative defense to charges of violations
6 of state law relating to cannabis through proof at trial, by a
7 preponderance of the evidence, that he or she otherwise meets the
8 requirements of RCW 69.51A.040. A qualifying patient or designated
9 provider meeting the conditions of this subsection but possessing more
10 cannabis than the limits set forth in RCW 69.51A.040(1) may, in the
11 investigating peace officer's discretion, be taken into custody and
12 booked into jail in connection with the investigation of the incident.

Hmmm I don't really like the idea of a registry, but protection from arrest would be nice. Tough decision.
 
The only thing I don't really like is the registry. But then again CO, OR, CA, and all the rest have registries and they're doing fine, and those patients don't even have the choice to not be on the list. I really like the fact that we get full protection from arrest/seizure. If you're over your limits they can only confiscate meds/plants to get you down to your max limit and not throw you in a goddamn cage and cut your crop.

It ain't perfect, but it's a hell of a lot better than some lame ass "affirmative defense".

Oh yeah, the doctor restrictions suck too, but I'm sure there's more than one way around that.

I never knew WA had arrest protection...? If your over limits they just take plants to bring you down to limits...for some reason why can't I imagine the gift actually taking the holding the hand approach towards the sick.

WA currently does NOT have arrest/seizure protection. Which is why our state currently sucks when it comes to patients' rights. The swine lock you up and cut your crop and let the judge decide whether or not you "affirmative defense" is valid.

The legislature is trying to fix this as we speak with SB 5073. Has to make it through the senate one more time and then it hits Christine's desk.

Doctors have more lawyers than cigarette companies. I don't think the threat of a misdemeanor is gonna rattle that cage one bit.

You are too kind to describe them as "conservatives" -- they're fascists. Real conservatives would support States' Rights, as well as a maximum of rights, liberties, and freedom of each person, with absolute minimal intrusion by the government. The same holds true for business regulations, including the tilting of the "free market" in favor of crony corporations through special interest tax incentives and other corporate welfare.

OTOH, fascism can be defined as preferential government treatment of favored corporate interests, to the benefit of those corporate interests instead of all the citizens under that government's dominion. "Private profit and socialized risk" is one of their maxims. The USA stopped being a constitutional republic infused with small "d" democratic principles about the same time as the rise to power of the Military Industrial Complex and the National Intelligence infrastructure, at the close of World War 2. Over the course of the past 40+ years that trend has been greatly accelerating -- highlighted by the assassinations of JFK, MLK, RFK, the Vietnam Conflict, and Nixon's War on Drugs.
