New MMJ bill introduced in North Carolina - HB577

What happened to the other one? It passed and was taken to a "medical review board" for approval and then the senate would vote is what I had heard. What happened to that?

"Debilitating medical condition" means any of the following:

31 a. Cancer, gliomas, glaucoma, positive status for human

32 immunodeficiency virus (HIV), acquired immune deficiency

33 syndrome (AIDS), hepatitis C, porphyria, amyotrophic lateral

34 sclerosis (Lou Gehrig's disease or ALS), Alzheimer's disease, nail-

35 patella syndrome, fibromyalgia, severe migraines, multiple sclerosis,

36 celiac disease, Crohn's disease, diabetes mellitus, dystonia,

37 gastrointestinal disorders, hypertension, incontinence, injury or

38 disease to the spinal cord, spinal column, or vertebra,

39 methicillin-resistant Staphylococcus aureus (MRSA), myelomalacia,

40 osteoporosis, pruritus, rheumatoid arthritis, sleep apnea, Tourette's

41 syndrome, or the treatment of such conditions.

42b. A chronic or debilitating disease or medical condition or its treatment

43 that produces one or more of the following: cachexia or wasting

44 syndrome; severe pain; severe nausea; anorexia; seizures, including

45 those characteristic of epilepsy; or severe and persistent muscle

46 spasms, including those characteristic of multiple sclerosis (MS),

47 amyotrophic lateral sclerosis (Lou Gehrig's disease or ALS), or

48 Crohn's disease.

49c. Any other serious medical or mental condition or its treatment

50 approved by a physician or other practitioner authorized to prescribe

FINALLY NC'S TIME!!

That's what we all said the last time...we're still in the bible belt fellas, and as much as I love my state, I'm not holding my breath for the good ol boy network in charge to change things up...

But here's hoping! :tiphat:

I dont think that it passed, but was the initial steps to get the bill going. I seem to remember reading or maybe hearing that the bill would resume march of this year

It got shelved and fell off the legislative calendar, I think.

So the short and dirty version of this bill is:

1. $5000 license fee for dispensaries (per year)
2. $5000 license fee for growers (per year)
3. $10K if doing both
4. 10% of monthly gross revenue paid to the state quarterly, which is pretty much like every other legal business
5. No previous felonies in 5 years, no license at all for those previously convicted of growing or distributing Schedule I or II drugs.
6. Two year resident of NC, unless applying within first 180 days of law enactment. Then only 180 day residency requirement.
7. Jail and fines for state employees that violate confidentiality of licensure records. Presumably for state cops and those that give info to Feds.
8. No more than 24oz possessed by patient
9. No more than 250sqft of females (~15x15) of canopy for patient. No limits noticed for "producers"?


eta: I wouldnt be surprised if Perdue were to veto it if it passed. She's already proven herself to be FIRMLY in Obama/Feds pocket. So much for Democrats being the "compassionate party". She'll get run out on a rail if she vetos though!

There's another democratic governor (I thinks it's in New England) that's on the record as opposed to reform. They're about the only two ds in the news these days. TBH, I can't find any relevant info on Perdue's position on mmj, I just remember the question being broached in or around the election. She responded with the V werd.

Here's a couple of questions that come to mind.

Does the 5k distributor fee apply to dispensaries and individual distributors alike?

Would a street-front dispensary be required to distribute?


10k would be a fat bite in the ass. Maybe I'll just hope for patient-status. I gots a 25 x 10 room... that's one decent vert setup.

Those license fees are the ONLY way this will get passed. The state spenders have to see that they can feed their pet projects through revenue from MMJ, and that it's more revenue than through criminal enforcement. It's the sad reality of the situation but I do think that legislators know that current "producers" would probably be able to get that kind of cash together in a hurry.

I predict the state health department will proscribe the specifics regarding store front activities. I don't see any provision in the bill that requires a store front but Im sure if you want the card/license, you need to pay the fee, regardless of where you intend to supply.

I love North Carolina so much in other ways that I'm still thinking about moving there full-time as a grower, risking extensive prison in a state with documented electric company snitching.

Alas, looking into this for five minutes tells you this has roughly zero chance of passing.

I think NC will be the first Southern State to go our way, but we've got at least another half decade before medical.

bev Perdue told the nccpn pres she wouldn't veto it but what might really happen is another story. Today he supposedly briefed one of her staffers In an arranged meeting and stated that they got along very well. I know it seems unlikely but the new president of the organization is a retired decorated Vietnam vet and if anyone can do it he can... Here's hoping

I love NC. I finally left the state after several fellow growers got 6 figure tax bills for not buying cannabis tax stamps for their grows. Those bills bankrupted those folks. I fled to a medical state. Will go back when NC goes medical. Doubt it will happen in the next 3 yrs. God bless the growers of WNC, that Marlowe lady, and Perry Parks for being such dedicated activists!
