Wow I didn't realize this was a Sheriff. I would expect more from the Sheriff than the other LEA's. Disgusting behavior for a Sheriff and I hope other Sheriffs put him in his place.


And did you know the Scientologists run rehab centers in CA? Where do you think they get the majority of their referrals from? Hint: very few cannabis users admit themselves. Those of you that guessed from the criminal justice system are absolutely correct. Now do you see why Baca doesn't want Prop 19 to pass? Can you say, "vested interest in prohibition"?
So sick.. I'm still on the fence about 19, but if it passes it better be enforced (allowed). Pisses me off that a State Sheriff would go with the feds on a State law issue per the 10th amendment. But as you pointed out, he probably has some third party reasons/incentives to do what he is doing.

when you blatantly arrest someone for a non-existent crime, isn't that termed false arrest?
not really clear, but if memory serves, a police department(i.e. county/municipality) can be sued for false arrest
i wouldn't think this tactic would go too far

True, but when you have the federal government saying its a crime, technically the feds can still bust you. They wont be charging you with state crime because there wont be one (well, you know what I mean, as long as you follow prop19). There will still be a federal crime (even though I and many others think its completely unconstitutional) and the feds can prosecute you and apparently this Sheriff will arrest you and refer you to the feds for prosecution. Much like they do with some large cases today.

this does get interesting since the federal government has filed suit against arizona to not enforce federal immigration laws on their own
the collision of state and federal law will be a gift that just keeps on giving

I think what would happen is local LEO would just make the arrest. Then they'd turn them over to the feds to file charges. I wouldn't be surprised if CA DEA offices ended up with long lines of local cops taking a number to hand off their prisoners for booking. The DEA probably wouldn't even have to leave their comfy offices anymore.

On the bright side, I read about a piece of legislation that is being prepared that would take effect if Prop 19 passes. It fills in a lot of the details missing in the proposition, and one important thing it would do is prohibit CA LEO from aiding or working with the feds to enforce federal laws. Don't remember where I read about that.

hope if 19 does pass, this follow up bill does pass too
i think we're in a very murky area with the local/state enforcing federal law
i believe the current usual practice is local LEO will bust a grow house and have a DEA guy tagging along
it it's big enough, DEA takes over on the prosecution
but if you look at what DEA considers worthwhile, 100+ plant grows, that may not change much
DEA just can't start grabbing a bunch of small fish because they can't keep up now
there could be a spurt of arrests, but they can't win the marathon that is coming

As bad as he is, Obama was the better choice-- (IMO)

Neither was a good choice, one is too far left with no experience, the other right with too much.
