You guys act as if Federal would be worse than state, which is nonsense.

I'll bet dollars to dirt it comes back a state charge.

Tell your friend to get a lawyer, and to keep his mouth shut.

Federal time is way better than state except for the CS fed felony on your record which will keep you out of pretty much all white collar jobs.

may get dropped, may get more than a year fed....never know

Sounds like a good time to move to Spain or somethin' for your friend till the US goes legal....

People need to be more careful when sending stuff in the mail. Never use the government sponsored business (in USA that would be USPS). The other companies, like UPS, do not give 2 shits what you send in the packages. As long as the package does not give off a god awful odor, leak liquids, or break open from bad packaging, it will always make it to the destination.

He is probably fucked big time. Using a delivery service to transfer drugs over state lines... never good.

Feds don't always take these ... particularly with such small amounts & only marijuana. Probably a local prosecution. Wonder how they found it.

He should talk to a lawyer IMMEDIATELY - definitely before going in to get charged. The visit by police was most likely investigatory 'cause they didn't have enough. If they did, they would have showed up with a warrant ... not a conversation.

usps is the most popular and safest to ship .

Priority Mail, which is often used for shipping tobacco, is sealed against inspection. Therefore a federal search warrant or consent would be needed to open these packages. Unless the mailer voluntarily discloses that a package contains nonmailable matter, generally the only way to determine whether it contains unlawful contents is to open the package.

Go to court with a lawyer the very first time, don't wait to see what's going to happen then get a lawyer. Say nothing.

USPS being the safest is a misconception. Due to the fact that it is government owned and operated, they have access to and are required to use more in depth screening of packages.

In fact, they initiated the Drug Package Profile, which I found the following information on:
In an effort to clamp down on marijuana growers using the U.S. Postal System as a means to distribute their harvests, the United States Postal Service, in conjunction with the Drug Enforcement Administration and local officials, have constructed a "Drug Package Profile" to alert postal employees to suspicious mail. The mail profile focuses primarily on the following characteristics:
* size and shape of the package;
* package heavily taped to close and seal all openings;
* hand-written labels;
* unusual return names and addresses;
* unusual odors coming from the package;
* fictitious return addressee;
* destination of parcel;
* multiple packages sent to same address, but to different persons
* packages mails to arrive for delivery on a repeated basis.

Packages fitting all or some of these descriptions are generally deemed to be suspicious and will often be removed from the conveyer belts of mainstream mail. Once the package is isolated, a drug-sniffing dog is brought in to investigate further. If the dog reacts to the package, the police will obtain a search warrant. The package is then opened, its contents fully examined, and a controlled delivery by DEA agents and local authorities is made. (Often times, a signaling device may be placed on the package as well.) Depending on the circumstances and the nature of the delivery, the recipient of the package may be arrested immediately upon acceptance or his actions may continue to be monitored throughout the course of the day.

Would you trust your packages with a government sponsored entity... or one that cares about nothing but money?? Personally I say go with the businesses that just want money, and aren't constrained by as many government stipulations.

CO to TN shouldn't be that suspicious unless CO is starting to do more work since they are big with MMJ now.. maybe the shipping carriers are doing more?

Or this guy completely messed up the package and they smelt it easily or it fell out, etc... someone had to snitch or really screw up the packaging process...

OR CO is using drug dogs

need more details on what happened

As being from CO, it depends on what county he was caught trying to do that in. I know people that their box taken and it got sent back to their house saying the Expect a visit from the DEA. Nothing ever happened. As far as getting caught and them coming to your door, that might be different. If your friend has a clean record then i bet the DA will just want to make a deal. Your frined will have to pay a large fine im sure and will have to do some sort of probation. The state makes more money on probation and fines.
