Thats why you gotta have notarized notices of intent to kill on sight as well as claims of right to defend your family, your property and yourself with whatever amount of force you deem necessary, posted around the perimeter of your property, so if shit goes down you have a much better chance to get off the hook, as the dead thief was informed of your intent to shoot him prior to entering the property, and you cant be held responsible for another mans choice. Expensive lawyer would come in handy as well.
