i need some clairty on amendment 64

ok, they say that its now legal to possess one ounce and six plants 3 of which can be mature.

but what if those 3 plants have 8 ounces each on them?????

and, what about hash & oil?

You are allowed to possess the entire harvest at your residence no matter the amount.

Hash and oil should be fine.

So now there is a huge market for legal sales but no stores for 2014, does anyone know if it will be legal to sell ounce or less?

I would imagine all that's up in the air until they can find a way to tax it all.

You can grow your own tobacco, brew your own wine and beer and distill your own spirits... but you're not allowed to sell it outside their control system.

What if 4 adults are living in the same house,can they each possess 6 plants?Or is it a 6 plant maximum per household?

It's six plants per person in an enclosed and locked space. A household with 4 adults would have a 24 plant limit.

You can keep keep the entire harvest but can only be in possession of a zip if you leave your house.

(3) Personal use of marijuana. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE FOLLOWING ACTS ARE NOT UNLAWFUL AND SHALL NOT BE AN OFFENSE UNDER COLORADO LAW OR THE LAW OF ANY LOCALITY WITHIN COLORADO OR BE A BASIS FOR SEIZURE OR FORFEITURE OF ASSETS UNDER COLORADO LAW FOR PERSONS TWENTY-ONE YEARS OF AGE OR OLDER:
(a) POSSESSING, USING, DISPLAYING, PURCHASING, OR TRANSPORTING MARIJUANA ACCESSORIES OR ONE OUNCE OR LESS OF MARIJUANA.
(b) POSSESSING, GROWING, PROCESSING, OR TRANSPORTING NO MORE THAN SIX MARIJUANA PLANTS, WITH THREE OR FEWER BEING MATURE, FLOWERING PLANTS, AND POSSESSION OF THE MARIJUANA PRODUCED BY THE PLANTS ON THE PREMISES WHERE THE PLANTS WERE GROWN, PROVIDED THAT THE GROWING TAKES PLACE IN AN ENCLOSED, LOCKED SPACE, IS NOT CONDUCTED OPENLY OR PUBLICLY, AND IS NOT MADE AVAILABLE FOR SALE.
(c) TRANSFER OF ONE OUNCE OR LESS OF MARIJUANA WITHOUT REMUNERATION TO A PERSON WHO IS TWENTY-ONE YEARS OF AGE OR OLDER.
(d) CONSUMPTION OF MARIJUANA, PROVIDED THAT NOTHING IN THIS SECTION SHALL PERMIT CONSUMPTION THAT IS CONDUCTED OPENLY AND PUBLICLY OR IN A MANNER THAT ENDANGERS OTHERS.

You guys should really actually read the amendment it is only a page long and will actually answer most questions as to whats in it

thata means you can grow for anyone

Depends on what county or city laws says, in Arapahoe and denver county there is a limit of twelve plants per household no matter how many mmj card holders live in house. Check with your city and county because you know that LEO knows the laws and WILL use them against you.

It's NOT in effect until Hickenlooper signs it.

There is quite a bit of hoopla going on where Hickenpooper, county sheriffs and the municipalities are talking with the feds as to what actions to take. It's possible they may try to delay the entire process or attempt to completely de-rail the entire 64 amendment.

But wait! I though it was "LEGAL." Yeah..right <eye roll>

Actually... Hickendoofer can only stall until January 4th.

He cannot veto, modify or do anything else about it... just stall until then.

Now... the 'commercial' aspect of it may present some issues that they're going to have to work out. The personal end though? It's a done deal. :D

There will most likely be county and city limits on plant numbers per household... but according to the amendment, there's no limit.

You could literally have a party apartment complex... with everyone just getting their share of cannabis each month... huge communal garden just run by a couple folks. KingBUD Apartments... leasing soon! LOL

I don't see how that will fly. The Colorado Constitution now specifically allows 6 plants *per person*. Constitutional rights don't change because there are more than 2 adults in a household.

It's like the right to free speech or the right to bear arms...

No, they didn't just die for speaking aloud that the earth was round, along with other scientific explorations. They were murdered, beheaded, hung, burned alive, etc. And most of the murders were committed under the laws and patronages of the Catholic church.
