It's not about winning or losing. I know for a fact they can crush me. It's about standing up to a bully. I always have, and I always will.

How could I teach my kids to do the same if I don't practice what I preach?

Worst case I close my business. So fucking what.

Originally someone called the State on me for selling OGBIOWAR Foliar. I handled that, and then the State decided to call the EPA on me.

It was an anonymous tip that started it all. I am now a possible criminal.

The irony in this is enough to make you laugh so hard you cry. :)

Totally. Just look what they done to the DDT guys. You just can't find the good stuff anymore. I also would give up my business, just for a cup of the stuff. Damn birds anyway..

I suppose the ultimate irony is I run this business because it is a passion, not for any monetary gain. I have never drawn a paycheck ever.

Dear EPA,

From reading your email, I see that you are in violation of your oaths to protect the Constitution. As a public employee, it is also incumbent upon you to defend the Declaration of Independence, including that part about "Life, Liberty, and the Pursuit of Happiness".

In case you weren't aware, the "Pursuit of Happiness" includes the right to use and to sell non-toxic pesticides without involving the US government.

It's looking like the EPA is just a big jobs programs. If you can't work for the government without being a traitor to the people, why don't you try the private sector ?

In the mean-time, I have an opening Monday April 20, at 10 AM. In 2026.

Funny enough I was hearing on the news today that the epa is issuing new rules for "organic/natural farming methods" things like you cant mix your own compost on site, it will need to be done in an epa approved fertilizer manufacturing plant. Things like stopping people from claiming DE has pesticide properties. Sort of like how its illegal for you to claim water haydrates you. Because that claim has not been proven by the fda.

So you want organic huh. Well looks like you will have to get your organic gardening supplies from a biotech firm.

I was working at a commercial nursery greenhouse with one of my seed partners and considered buying the business from him. Once he showed me all the bureaucratic paper work needed for applying/using fertilizers, pesticides as well as water (environmental dept. gets involved in that one), we both decided, I was better off taking the knowledge, and growing/going elsewhere.

He sold the biz to a former cop, who has had (so I heard) problems with the EPA on pesticides used during greenhouse operations. Now he (my seed partner) does his thing, we do ours, so together we grow the hybrids we want, and not under the limelight and beacons.

Consult an attorney rather than get random opinions. Once they dig their incisors into you, it's best to cooperate and make peace.

At least in some states....when you go to a grow/hydro store, you speak in terms of growing medium, plants, but NEVER an utterance of cannabis. I think your predicament is somewhat similar.....yes, you sell items that "can be used" as pesticides....but stating it's a soil amendment makes it sound organic and not pesticidal. Capisch?

Good words of advice.

Making peace is not the answer. Everyone else before has "made peace", and look where we are.

More people need to stand up to the Government.

I think the right thing to say is "Grow a pair, and fight. Even if you you lose, you can lose with dignity."

A competitor would be logical. Also there is a certain person on here that loathes Cap, and OGBIOWAR. There are a couple of possibilities.

Shit happens.

It does not mater what the product is (water, chemical, magic pixie dust), if you make a claim to control any pest (bugs, weeds, whatever) the product MUST be registered with the EPA and the state were you do business. This is done to protect the environment and end consumers from damage and fraud. My advice would be to change all labels with claims on them and just list the content of the products. Then think about other ways to inform your customers about other uses for your products( blogs, forums...etc). I dealt with this bullshit for over seven years and I feel your pain brother. There are so many great organic products that are not made available to the general public because of the cost of getting a product registered. And if a company can't patent a product it is hard for them to make a return on investment. I know it is hard for the small business owners to play this game but it can be done. Keep up the good fight.

"Must" is not a fact. "Must" can only be used because people allow it to happen. I have only shared "facts" about these products. I don't make them, and actually if you believe in god he is the one that made them.

So The Federal Government is saying that I can not share a fact about a product that is made by god, or whomever?

It has nothing to do with research. It has to do with right, and wrong. There right is my wrong. My right is their wrong.

The "fact" is these laws are made by giant chemical producing corporations. I do not agree with them. That is my "right" as a US Citizen.

All the research in the world won't make a wrong right will it? Exactly.

Scale is a critical concept here. Pointy toed shoes could be categorized as insecticides by EPA guy because they kill cockroaches in corners. That's clearly absurd. EPA guy may not understand DE is closer to the pointy shoe than a chemical useful for industrial scale production.

I wonder if you could get around it by presenting the "claim" as a warning: Insects that come into contact with DE may become desiccated and die!

You should talk to the guy. He may actually have useful solutions to your problems. The concerns are pollution and fraud. If you aren't doing either you shouldn't have anything to worry about.
