What now?

Friday, after I got home from work I was talking to a buddy on the phone gazing out the front door when several LEO's of all rank and type showed up from nowhere and everywhere at the same time. A few of them had automatic weapons. They asked if they could come in, I said no, I'll step outside. One guy wants to know if they can go inside to see if anyone else is home. I said firmly "your not going in there". (nothing inside anyway but I know my rights)
Now, I'm rural, about a third of a mile through thick poison ivy and part the reeds out in my swamp I had the most beautiful grow of my life going. I don't think I would have needed to grow again for 3-5 years. All gone.
The Sergeant in charge told me he had to do his job and take my plants. I had 10 of them in 3 gallon bags, 8 in 5 gallon buckets. I'm in the mid 50's and told him that I had no idea what I would do now for my pain. Most nights I'm not sleeping till I medicate, Mrs. Toker is the same way. He said it least I could stay home, he gave me a card, told me he would be in the office monday, call with questions, we'll see what happens next.
It's wednesday and nothing, no word. I felt absolutely ill monday so I called him about 3pm. A woman answered and said he is in training all day. I have not tried back.
I'm in Minnesota, no criminal record at all, the locals didn't even know me even though I've been here over 20 years. What happens next?~mT

Oh, so I told them no one knows, no one, I was stunned they knew. I was told they had a reliable source and I was spotted walking in my yard. Found out later Mrs T thought she heard helicopters a few hours earlier.

Who the fuck is growing pot on your land? Damned kids nowadays have no respect for people's property rights. I'd be royally pissed if I were you.

And why did you tell the police that you're a user?

Well, what's done is done. Tell us how it works out.

You never know what will happen till it happens. Guess that's why it's good to practice possible scenarios. Best of luck to you.

Maybe give some money to a lawyer now to hold onto in case the cops try to take it later. You could probably use one's advice now also. Hopefully the missus' name was left out of the conversation. Maybe she should practice acting pissed at you in case there's a need for a performance. If you have a nice vehicle, don't wax and polish it. Maybe let the dogs sleep in there till you know what's going down.

you may have to go full in on a MMJ defense, not sure how Minnesota legal system responds to pleas for medical mercy
most likely it will end up being a lot of money and probation of some sort

No one has read me my rights. The lot of money thing would be tough, we don't have it.
Thanks for the replies.

Looking at your initial posting, you've given out a lot of identifying information. Except for the missus it probably doesn't matter though. If you delete your statements about the wife, mine will go too.

edit; actually it puts your name on those 136 posts. But I'm the paranoid type.

Seems this would be expected of anybody. I walk in my yard everyday.

lol I was thinking the same thing

i would think maybe someone saw him going to or leaving the "spot", I wonder if there were any neighbors around there or hunters or what not who could have spotted him.

I just think a helicopter idea is less likely. that a heli spotted the plants and in less than a day the cops are already at the door. Do we really have helos flying around small towns lookin for small grows? I'm not so sure.

Well it could have been a chopper looking for big grows. But sometimes they'll take what they can get.

Hey, I know MN, I've had some pot cases in that state. First thing, hopefully I can put your mind at ease, in general MN is really lenient with pot. It's going to depend on what county you are in to some degree, but you're looking at a 5th degree controlled substance felony, which is about as low as felonies go. The only thing lower is selling oregano.

If you have no criminal record you'll be able to get a diversion deal where you do probation for a year and at the end the record is expunged for you.

I also know a very good but affordable attorney based in the metro who takes personal issue with marijuana crimes. PM me if you'd like his contact info. I, um, know someone who was on felony parole for a 1st degree controlled substance crime that got caught with around 150 plants and this lawyer got him a deal where after sitting in jail for a few weeks waiting for a parole hearing the only punishment was a few months on house arrest and another year of probation, I think that cost like $7500 but it was more expensive because of all the dealing with parole people.

For a first time offender you have very little to worry about legally. It's a shame you said anything at all to the cops though, the less they have the better position your attorney is in to bargain.

there is almost never anything to be gained by saying anything but your name ,age and ss number or providing id.you don't need to be read your rights till your arrested and not free to go.i cant even count how many times I told the piggies I have no comment until I talk to my lawyer. you have my id and info am I free to go officer? I was quite a hell raiser as a kid lol

Sounds like Sgt. McFriendly pulled the "im against what we had to do and feel for ya', just doing my job" routine on you. At least you didn't let them in the house, whether or not you have anything going on in there. Once they get in it becomes a fishing expedition for whatever they can find that they dont like.
