Friends: Been offline for a while but wanted to fill you all in on what happened to me. A friends relatives were in a bitter dispute with him and wanted to smear any and all his friends with lies, and I got caught up in it. A crooked narc managed to piece together a warrant affidavit containing absolute lies, and worded it so that it sounded like I was growing at my home. There was no reliable info in the entire thing but a judge signed it and on 11-18-2010 they raided my home. I had enough advanced warning to get rid of everything but stored growing equipment...the only weed found was trash in a shop vac, nothing smokeable and mixed with hair and trash...the lab stated they found 14.2 grams of pot, using only the D/L test. They charged me with manufacturing pot, maintaining a dwelling for pot, paraphenalia and simple possesion. two felonies and two misdemeanors. Thrown in jail under a 5k bond which I made after 3 days. It was a clusterfuck from the get go. The source they claimed was a " reliable informant " was a mentally ill relative of my buddy who lied completely and had never been in my home. the other source, which the narc failed to mention was her daughter, was a notorious addict and felon with no credibility. The cop had absolutely NO corroboration whatsoever, and the judge that signed the warrant was bamboozled by the clever lies and wording of the affaidavit.
I fought the charges because not a shred of the affidavit was true and it was an obviously faulty document. It dragged on almost 2 years, and at one point my attorney had me sign a statement denying " any and all allegation contained in the affidavit and charges ". The filthy and crooked pig and DA decided that since my name and address were at the beginning of the warrant narrative, that I must be denying that I lived at my house, and charged me with perjury!! One night duing a storm when the power was out and my disabled daughter was home with me, a pig showed up and busted me for the perjury warrant! It was totally bogus...they might as well have claimed that I was denying my name as well..the affidavit contained allegation,s but my name and address were NOt allegations, but know facts stated to identify me and where I lived..they were not allegations of any sort. Another high bond..and after the second day in jail my attorney went to the head DA and showed him the travesty...he immediately ordered me released, ordered the local DA to have no contact with me, and dropped the charge. My lawyer accused him of prosecutorial misconduct and the whole courthouse was abuzz with the nasty business..this ia s small town. it was payback plain and simple for daring to defy the pigs and demand a full trial...the indictments were bogus, there was nothing growing found, no smokeable weed found, only stored equipment.
Finally, the lawyer convinced me that local jurors were too stupid to comprehend reasonable doubt and I had no money for experts to prove the D/L test bogus, etc...so I settled on a deal: Plead guilty to one count of felony possession ( even though the weight of weed actually found was far less than a felony amount ) and the rest would be dropped. 18 months probation, 100 hours community service ( which I beat due to being disabled ) and about $ 1600.00 in fines. $600.00 of that went to the SBi lab for their 3 minute D/L test...bastards..and i end this nightmare this Nov 18th. I have to report online every month and see the PO every 3 months...she is actually a sweetheart and hugs me and tells me that it is a shame an old Vietnam vet like me with chronic disabilities had to go through all that crap.
The narc that scammed the court and system finally got fired a few months ago after many perjuries and planting evidence so at least that prick got some karma returned. But learn this: you can be victimized by hearsay, lying cops that can craft a warrant affidavit in such a way that the truth is of no matter, and get your life turned upside down over nothing. I lost 3 grand in equipment but in the end I will have no record..the sentence we agreed on means that at the completion of the probation the case is dismissed and is like it never happened. That is the biggest reason I went for it, along with no jail time.
Had i had resources, i could have beat the case...the D/l test was declared non-specific in my state by the Supreme Court, the cops found nothing growing, thus no manufacturing, the indictments were faulty, etc. But without money for a crack legal team I had to bite the bullit. Come November 18 my gardening will once again commence, although i moved out of that county for safety..they can never stop us, just delay the inevitable...laws againt weed never convince, never morally win..and someday we will see the end to such a waste of time and money. The state spent over 50k screwing with me and all for nothing...anyway, I am about to begin the genesis of a new and better effort, and will contribute my results as soon as I am officially out of the rookers of the millicents! Glad to be back!
