RR you may want to let Tick know that if the bill is signed as written, there WILL be a constitutional challenge and the law will be declared INVALID be cause of unconstitutionality. NV is a small state and the NV supreme court will have plenty of time to hear the case before their Jan 2014 enactment date.

If he wants his SCAM dispos and all the licensing fees, he better leave the solo grower, and the hydro shop owners alone.

When I told them that the State of Nevada would get sued if they stopped patient's from growing their own, this is the response I got from Segerblom:

"We are reconsidering – the bill is still a work in progress"

everyone please use this in any e-mails to the senator, it will do wonders for the cause. i'm certain when presented with naming who is responsible for trying to exploit medical users by denying them cultivation, mr. tick will look for other blood to suck. jmho

Yes such good comments and you can totally see they changed from almost all for to against because of that damn amendment. Whats also good is that Tick is much more responsive now.I was one of the first emailing him ant no response.. now people posting left and right about him trying to assure them that he is working to fix it. Really really cool. Hope its actually true.

There are only 2 weeks left in this session. My money is on this doesn't pass and comes up against in 2 years.

That would be fine too at this point.. as long as it comes up again without the crazy amendment since it is what will probably make it not pass this time around if we are lucky.

I know posting it here is pretty redundant, as people here already done all they could, but in case someone new reads this I just decided to make it easier on them to know how to contact whoever they need to regarding this issue. I am also posting this to all the cannabis forums that I can find.

Please Help Local Nevada Growers to Keep Their Right and Keep Growing – Change or Defeat SB 374!!!


The poorly thought out Senate Bill 374 is slowly moving through Nevada’s inefficient legislative process and we have ONLY 2 WEEKS to persuade the sponsors to remove the amendment that will make home growing illegal or ask Senate Finance Committee and Assembly Judicial Committee to NOT PASS the bill as it is written.

The bill wants to allow for dispensaries to open but makes personal home cultivation illegal.

Please help!!! We are running out of time. A slot was done and our outrage was heard and responded to, but we need more voices to be heard!!! We NEED to send as many emails as possible to the email addresses of the both committees’ members (listed below) and urge them to NOT pass this unconstitutional bill that will marginalize law abiding patients and cut their access to the medication all together since they will no longer be able to afford it, as dispensary prices will have hefty fees on top of high prices.

Please write short, effective but polite letters (rudeness and anger will only work against us at these crucial last weeks) to the addresses below and urge them NOT TO PASS THIS BILL until the NO GROW Amendment is REMOVED!

Odd that they would now be having a 2nd hearing on this bill in the Sen Finance Committee. Not sure what that's all about but guess we'll find out tomorrow. Maybe they got enough of an outpouring of emails and calls they did the right thing, who knows?? Interesting. Very interesting!!

On tomorrow's agenda, the bill is scheduled for Work Session. I think that the Work Session part of the meeting will be behind closed doors, just like any self respecting Banana Republic should be run. The first part of the meeting will be internet broadcast, so maybe they'll keep the tape running...we'll see; but I don't think so.
Anyway, fer sure let's Email all members of Sen Finance Committee with all of the negative financial consequences for the State: Patients dropping out, prosecution of those who continue to grow, lawsuits for this and that, etc.....you know. I don't think they give two shits about our negative financial consequences, so we should concentrate on how this isn't the Golden Cash Cow they are being sold by the Tick.
I can't believe how they can fuck up a decent dispensary bill with one unconscionably cruel and greed based paragraph. Pigs and Ticks. Igs and Icks.

Here is a beautiful letter written by a patient. She posted a copy on the Las Vegas MMJ Meet Up site:

Dear Senator Hutchinson and Segerblom,

Constitutionally, the legislature cannot remove the right of Nevada State Medical Marijuana patients to grow their own medicine for themselves without the State of Nevada first being able to LEGALLY prove that third party medicinal cannabis is Nevada State inspected and approved as either food grade, organic, or medicinal grade in order to provide "Safe Access" for all medical marijuana patients.

Some marijuana growers only grow for profits, not for the medicinal quality. Such industry growers will lie, stating that their marijuana plants are 'organic' but in reality, they will use harsh chemicals to increase plant volume in order to make more profits per gram. These chemicals are really not good for anyone, but when it comes to patients suffering from cancer or intestinal issues, then this could really be dangerous especially if they wish to consume the plant as medicinal food rather than smoking it.

Simply put, a plant that is not properly inspected with a Nevada State seal on it, may not necessarily be legally "Food Grade" "Organic" or "Medicinal Grade" and this could make people really sick. If Nevada wants to take away a medical marijuana patient's right to grow, then, it is only wise for the state to protect itself by creating a new agency within the government that inspects the cannabis crops sold by the dispensaries and collectives that require cash money and purchases in order to obtain legal marijuana. The State of Nevada WILL get sued if they cannot prove third party plants are 'safe access' for patients.

As a medical marijuana patient, I am very concerned about this portion of the bill, because I have strong trust issues when it comes to other people growing The Herb. I believe in making a spiritual connection with the plant, and this right of mine will be taken away, therefore violating my religious freedom. Plants respond to the energy that is given to them, all plants do. When one wishes to be healed by a plant, then it is best for someone to spend time with that plant so that the vibrations from the patient can be detected by the herb and shared. Something is lost when plants are grown in large quantities at warehouses. It has been scientifically proven that plants do respond to human voices and positive affirmations. It would be nice if the Senate would reconsider their position on allowing medical patient's to grow their own. Give the power back to the people, many of them chose medical marijuana so that they could become independent and heal themselves. Let us citizens and public servants of the State of Nevada avoid allowing private industry corporative false profits to deter us from healing the population and empowering communities. If it is illegal to grow as an individual for personal use, then minority populations looking to continue illegally growing and dealing will continually be arrested and nothing is going to get done about the racial targeting in marijuana charges. Yet again, Nevada will get SUED one way or another, either because of a violation on constitutional rights, religious rights, or human rights. Nevada may not get sued by me, but I can promise that someone will sue.

I appreciate the service the two of you consistently do for The State of Nevada.

I forwarded a copy of the above, along with my comments, to every member of the Senate Finance Committee to hopefully consider during their work session tomorrow morning. You-all please help fill up their mailboxes and maybe we can solve this problem tomorrow. We need a BIG PUSH right now, today!

It is a nice letter, however this first part is factually incorrect-

Using the language from the 1998 and 2000 voter initiative, the language from Article 4 Section 38, the language from NRS 453a, the law setting up the Nevada MMJ program, and the definitions used in the above listed documents from the State given in NRS 453 Controlled Substances , constitutionally, approved patients are allowed to possess, produce, use, and even manufacture, which are all referenced to in the documents, the plant itself. They don't have to prove shit before they take away a patients right to grow, they legally can't without changing the language. Just the way it is. For her to even imply that underscores the fact that she doesn't know what she's talking about.

Once it leaves the Senate Finance committee, it goes to the Senate floor to be voted on. If passed there it goes to the Assembly Judiciary Committee where it will be up for public comment and then, because it has finical implications, on to the Assembly Ways and Means/ Finical Committee where another public comment period will be held before going to the Assembly side for the final vote. It could be sent back to the Senate side to be amended/changed at either point in this process where it would then be returned to the committee for further review. In either case, time is running out and it will either be rushed through so they can vote on it or die in a committee along the way which is doubtful.

Tomorrow is a work session indeed. They will here if any new information come up, if any amendments are to be added or removed by the bills sponsors, clarify comments, and ask questions of those who testified previously per the information I was just given. BTW, it was verified that they have been getting hammered by emails and phone calls.

Oh, man I so hope it is either amended or is stuck somewhere and runs out of time. Just wrote to Finance Committee again about the financial impact to the state. As many people as this outrages, it will be absurd if they just pass it without changing it.
