New Law in Cali coming, DUI for testing positive for pot in blood

Funny thing is they push pharmaceutics all day long, but no tests for that. In fact I watched a report that says pills have taken over the number 1 spot of abused drugs in all age groups but 60 and over.

This is what we get for electing the same retards every election. People here are too busy smelling their farts to worry about politics so they leave it up to the politician's. Every election they just vote for who they've heard of. There're so many bleeding hearts and fems here that they will just cast aside their personal freedoms to make it fuzzy for a homeless dude (that likes being homeless).

O thought that was already law in CA...if you get into accident they take blood and if you are positive for thc you get a dui. ..maybe you are talking about something different ..that's also already law in several states...

it's a little fuzzier, in NY there is no given THC level, it's something that would have to be presented to a jury that some THC level was present, and they would judge how much impairment there was
i believe California is the same currently
a few states have begun to legislate THC levels like alcohol, an ominous trend

they tried the magic 5 nano thing in colorado. it was suppose to be the number that meant you were high. some reporter from Westword sat in front of a camera stone cold sober and not smoking for 24 hours, then took the test and pretty much blew the numbers off the scale. (i don't remember the exact numbers)

it will be things like that that make enacting and enforcing these laws impossible in the long run.

i wish i thought that meant that the retards who run this place wont try it anyway

in a court of law ...I would make they show that you being over the limit they set made you impaired....you may have THC in your blood but your not impaired...prove it

A heavy daily toker that has alittle body fat will fail a THC DUI test after a month of not smokin....guaranteed hes not impaired

^^ you won't make them do anything, they don't care that you are not impaired, they just want you to be over the threshold and that proves it!:nanana:

^maybe the California courts will nullify this. mandatory road side blood test is pretty fascist. I have a needle phobia, and I would sue the ever living shit out of them.

unfortunately this has been a law in arizona for quite some time now. they get away with it by changing the terms of obtaining a drivers license to say that you must consent to any officer's request to draw blood at any time. by signing the drivers license application, you waive your right to refuse a blood test. at least that's how i understand it.

im sure a good lawyer can get those charges dismissed.....theres no way they can prove that you were driving under the influence just because you have THC in your blood. you can even "document" your smoking sessions to show the court your last dose of the evil marijuana plant was over 3 days before you were pulled over.

also, if you are getting blood draws, its probably because you were already being suspected of DUI for alcohol..and i doubt they are gonna stack marijuana charges on top of DUI for alcohol, eventually you would just plead to DUI of alcohol because its easier to prove..

edit tmi. way to evil for icmag. had to edit lol

A mandatory blood test to me is the equivalent of legal rape. forceful penetration of my body.

^ If the cop got lucky and I was not carrying a gun that day I would sue sue sue, until I got my point across. I do not give a fuck what I signed. waivers don't mean shit. Lawyers get past them everyday. Not to mention driving and flying IS a RIGHT, not a privilege. Common Law states a man has the right to travel, it does not say by horse or foot. it just says to travel. technically the entire DMV and TSA are unconstitutional. I can put up with the I.D. requirement, but mandatory blood test is so many violations of the constitution that I would refuse the blood test and opt to be arrested. I would first ask the cop to prove impairment with a basic motor skills check. I would then tell him I have Thrombophilia a blood clotting disorder so taking blood road side is out of the question. Which is a lie but he doesn't know that. If he cant observe anything wrong in a basic motor skills test then he has no business asking for a blood test anyways.

If I lost my case I would appeal.

same goes with the pot laws. trying to imprison me for growing is a death sentence. Take away my plants and I have nothing to lose. I will snap, and they will have to kill me to stop me. However I will leave national destruction in my wake. I will reach every pissed off southerner with my message and start a civil war. All over a traffic stop. That is how much I hate the US government.

Some days I just really can't wait until the time comes and citizens rise up and kill the fascist regime that hijacked our country. other days I would just rather go off to the woods in peace. I know though that the woods wont stay peaceful. unchecked tyranny will follow.

Hey HZ, they have phlebotocops here in az. They take a class and they are certified to draw blood. While a few people have been wrestled down and had their blood drawn on the side of the road, they usually take them to the cop shop and if they won't submit, they'll strap you into a chair and do it.
I try not to forget my eyedrops and breathmint before i drive. Stay under 5 over, that sort of thing to stay off their radar.

you have to be able to chose the be arrested option. just say arrest me please instead of do a road side blood test. they will take it as an admission of guilt but your lawyer could get you off. frankly I would rather take the misdemeanor than the blood test just on principle. fuck them arrest me. i don't care. I will go to time out for a few hours and argue my case in court. If I lose I will appeal. I would contact civil rights lawyers that do controversial cases and make a big fuss if I had to. It is my duty as an american citizen to stand up for my rights.

i'm kind of stunned to hear this, makes very little sense, but that doesn't mean it doesn't happen
curious what the bar is for them to decide to try this, just what drug do they think they'll find that they couldn't get from taking someone to the local hospital?

LOL at RIGHTS and Common Law my friend. Sounds good being read from the paper they were written on, but it ends there. We sure had a good run thinking we had rights though didn't we.

Yeah LOL @ driving as a right....that's what I thought too! I haven't had a driver's license for years....REVOKED. My offense? ...DUI...? ...reckless driving...? At-fault accidents...? No, none of the above. Lots of speeding tickets (mostly 5-10 over)...driving while suspended (for speeding), and being too broke to participate in the insurance racket are apparently all good enough reason to deny a man the right to travel.

"Oh, we're not denying you the right to travel! You just can't drive, that's all. You can still ride in a horse and buggy just fine, or pay someone to drive you to and from your house 15 miles out in the country to help you run your business and ship packages.....all while you're literally starving trying to keep the lights and water turned on! Totally confused as to why you would think this is unfair or your rights are being violated...kids these days, with their sense of entitlement!"

It disgusts me what this country has become....

You can't get a license in California without being noticed that driving in this state is a privilege, not a right. They're not saying you can't travel, they're saying you don't have an automatic right to travel in that manner of your own volition without giving up some rights.

Considering that driving always involves a large vehicle, and that large vehicle can be and often is a deadly weapon, I don't take issue with that. Especially after experiencing hit-and-run accidents and being rear-ended on my motorcycle...? Yeah, don't have so much of a problem with it.

I think it's appropriate. What I don't think is appropriate is the TSA groping my 73yo mother's vagina when she's traveling IN STATE, not even across state lines. That is inappropriate.
