I used to believe the same thing, and then an old acquaintance made what was, for me, THE compelling argument.

Any other murder, while still a capital crime, while still the ultimate crime, does not foment same degree of fear and the subsequent effects on a group's freedom as a hate-based murder.

In other words, while, for example, domestic violence against women is a common occurrence, it has a random nature to it. One's normal reaction is not to prevent men and women from cohabitating, for example. It is to address the violence itself. Same for abuse of children.

However, for example, when a homosexual receives the same treatment due to his or her homosexuality, they are no longer being individually targeted, the entire gay & lesbian community, the entire black community, the entire Middle Eastern community, is also essentially terrorized by motivation behind the act.

It is for that reason that I changed my own stance on hate-based crimes and how they're handled legally and punitively.
