I wonder if cuttings without roots still don't count as a plant..... So I went from 200 to 60. But I had to find out about this law, non of my legal team new about it.

Hello mate can you remember where you found this? Was it part of the sentencing guidelines?

I don't think it's in the Misuse of Drugs Act.

I can't see it happening tbh Vonbudi ... because we will lose a lot of privilages from the union and there's not much to gain apart from north sea oil revenue and our share of the national debt.

It was more a technicality re the cuttings with no roots as not counting.

As by definition a plant has to have roots. They could not prove this and therefore was no different to a bag of matter that I could have just removed. It can count against you but if they count it as a plant numbers and you get it removed then it can not be used as evidence at all. That was how I understood it. An this was how it played out

It's not quite as straight forward as that bro.

You would still need to satisfy the "lesser role" criteria before plant numbers would come into it.

i.e. according to the guidelines, even if you had under 9 plants (category 4), but satisfied the "significant role" or "leading role" criteria, you could end up with 26 weeks custody if you play a "significant role", or up to 3 years custody for playing a "leading role".

Again, if you keep between 9-28 plants, but were found to play a "significant role" or "leading role", you could be given 3-5 years.

I think the most important factor in keeping within the "lesser role" is to satisfy the judge it's solely for your own use & not to involve anyone else.

As soon as you're seen as part of an organisation (even if it is just you and one of your pals), the judge could see this as playing a "significant role" and then you're doing a bit of bird regardless.

No problem mate.. the problem is I think it's still ultimately down to the judge.

They're not forced to stick to the guidelines and can ignore them if they think it's "in the interest of justice" - which doesnt really mean anything.

I went out earlier tonight with a 2 grams of psychosis to meet a grower mate of mine, we had a smoke in the car together he brought his own weed,I saved a crumb of mine for pipe hit out of my bud (a little pipe a 3" thing) 0.5 of a gram I reckon I saved I put the lot in 1 joint basically. So we are sat in the car and the police turn up, Mate decides we drive off as we had perceived this to happen and allowed space to get off in either direction should anyone come, (WE were stupidly HOT!!!) at this time I thought about the 4 mature plants I have in flower a 1200 tent the umpteen mothers in another tent a second flower room of 10 plants that fits a lot more along with and a 1 meter by 500cm vito pod propagator on the go in another tent for next few runs with well over 100 clones not sure how many 9 or 11 of each, trim in the freezer and jars of cured weed. I was shaking.. Whilst thinking what to do... waiting for the blue flash, if to run stash or dispose of said (green vegetable matter) anyway all said and done I got the 0.5 confiscated and a grinder that had a (SPEC) of weed in it like (1 sepal) my mate had an £80 fine for his sticks and stems in a tub, we had a pipe confiscated. I had the spliff I was smoking in my pocket when being searched I put it there when I near shit myself before the blue lights as I thought better to be caught with a little and not cause too much suspicion throwing stuff out causing a fuss and more hassle than needed and cause a section 18.5, We could have emptied everything on the floor when we got out the car but it could have been worse,,A few medicinal tubs with residue were not of any suspicion, no problems about driving either though. Old school cop..

He and his mate knew about the acpo that is why/how I am looking here now. Apparently "My little bud" didn't constitute to more than personal use, but you get a raid 18.5 for more than 1 £10 weed and suspicious behaviour. Any grow paraphernalia on you is a no no if your caught smoking weed. (we were not told this direct but it was suggested.)

We had a good old chat with the old boy as he tried hard to get my mate no fine as he was only 28 days short of 5 years since his last stop. I can't remember all that they said just now. But we made them explain it all as per our rights: (I said to my mate in ears distance they have to explain everything if you do not understand) This seemed to un-ease the police and provoke explanations of everything.

We had them then explain to us the meaning after giving our interpenetration of the caution and mocking the answers of the simple questions when doing the paperwork,more the police than us, the paperwork said class c but that was old.. We never got a duplicate copy which seems strange,

I gave an unrealistic address as cover but can not get comeback from it,

All in all I just wanted it to be over with quickly...............................
