They are growing my patented dandilion.

I pretty sure this thread missed its mark.

If your caught growing Monsantos 'round up ready' soybeans with their genes, they will sue your ass, even if you didnt buy their seeds, didnt sign their contracts, didnt want anything to do with their GMO.

Monstanto's GMO pollute the soybean gene pool, and they sue you for it.

yes. true. just pointing out that they sue folks for growing/selling their patented GMO, so getting your patented GMO on their land won't be sue-able unless they are selling those dandelions. eff monsanto

Im not positive you have to sell the roundup tainted soybeans, for them to sue you. I think the act of growing it is good enough. (For instance, claim your beans are just for animal feed).

Now, monetary damages may be an issue, as dandelions are essentially valueless, however my 25y aged dandelion tea will serve as my product. My business plan is to sell 1Gal of tea for $10,000,000, of course we will have to wait 25 years to see how many units i can sell at this price.

Perhaps we can settle out of court

i hope your not for real..............it reads as just a pipe dream w/o much rational thought.

monsanto has ip lawyers on the payrole so they have an incentive to protect their patents.

it will cost you 100k, as previously stated, min to fight an ip infringment case.

any monetary award will be based on damages and since you have no business, no plant patent or final product then where are your real damages?

and for those suggestion ruining monsantos crops by pollonation, foolish. if you were able to achieve this do you think they would let it slide? i would bet that they have top notch security to prevent malicious attacks b/c its in their best intrest to protect their profits.

if you can secure pvt funding go for it........its not your money being squandered so what the hell.

research ip infringment cases and then ask if you still think its a solid idea.

While i do agree it is a stupid, it is something monstanto does everyday. Monstato has 'strongmen' (aka Pinkertons) who do nothing but drive around, TRESSPASS on peoples farms, and STEAL a sample of their soybeans to run genetic tests.

If your soybeans have monstanto's patented 'round up ready' genes, they will SUE and RUIN you.

Even if you are an ORGANIC farmer, if their GMO pollinates your organic soybeans, not only are you no longer organic, you are growing their patented shit, and they will OWN you for it.

I though my dandelions would be an example of turnabout is fair play. I cant keep the fuckers outta my yard BECAUSE of poorly maintained lawns upwind.

Perhaps if i could get a few of the forum users to promise they will buy my dandelion wine for the stated price. Contracts to make it legal, of course you can wait until delivery (25 years from now) until you pay. [/tongue in cheek]

And between a guy named 'COOKIE MONSTER' and 'supermanlives', this business could and should have generated BILLIONS.

I don't think monsanto is wiping farmers out by collecting the damages. I think most of the people are losing their livelihoods because Monsanto has BILLIONS to throw at their lawyers to keep the case dragging on. The farmers run out of money before it ever goes to trial in most cases, just from legal fees.

I like the idea. I really do... (in spirit) but if you've got the cash to patent your own dandelion genetics, and the cash to keep your lawyers jumping through all the hoops (and appeals all the way to the supreme court) you probably don't need to be suing them. Just hire your own mercs and burn their corporate HQ to the ground. Or get yourself an Oswald and systematically exterminate their execs.

(Please read the above paragraph with your tongue firmly in your cheek. If you get caught trying to snipe monsanto execs, don't tell 'em it was my idea.)

The patent office itself is corrupt and cannot even be a judge of patents anymore.

It's a joke and now a sham.

To bad our government can't get powerful - it's a constitutional right for us to fight the stupid thing.

We own the government, we tell them what to do. I swear, their plan is going to fail, because it seems there are too many strong people who will balance it out.

im all about 'turnabout is fair play' but make your sure your plan has a chance in proving monsanto's intentionally releasing patented pollen just so they can squeeze out the competition
via legal action protecting their IP. if this can the basis of a complaint against monsanto then the number of farmers effected only increases the ability to get a lawyer to take your case....jmo

You better A: have deep pockets, or B: find a lawyer that works on a contingency basis, because Monsanto has DEEP pockets and worse yet, they OWN more than a few politicians.

Regardless, you'd be in for a long protracted legal battle.

To put it in perspective, EXXON is STILL appealing the judgement against them for the EXXON VALDEZ accident that happened in 1989...
