Fed's can keep count of Marijuana plants over time!

I dunno...Maybe deoubleJJ is partly right. If the feds are watching sites like this maybe we need to learn how to post things up that can not be used against us later. I am also thinking hard on this. But there can't be any advancement in the growers if there is no place to discuss what each has learned??? There are no other real reasources for people like me who are trying to learn and have no real experience??? There has to be a way to keep going with the exchange of information w/o incriminating ourselves??? I don't pretend to know the answers but there has be to something we can do and still comunicate???

I do know that when i got my first MMJ lic. card in December it came with a nice long letter that kept repeating that it only gave me an affirmative defense against seizure and prosecution by local and state police BUT having or using MJ remained illeagal under federal laws. Those federal laws are what we need to get abolished. They are childish and totally groundless. My theory is that if you meet some-one who describes them-self as a politician (most attorneys as well) you shuold treat them as you would an unexpected male flower in your garden (or cockroach)...kill it quick BEFORE it has a chance to multiply.

How much property and money were stolen from them? Didn't see the mention of the financial facts of their sentence. Sometimes it appears that the system jails so many people because they can't supply them jobs and so they just stash them..

Yea they are dumb for not taking the plea deal. The guilt of her husband locked up for 1 1/2 years and her not, likely swayed her decision. Now they both get the mandatory 5 years oo wee. Poor people...

Translation: you get punished for exercising your constitutionally guaranteed rights to a jury trial by your peers.

Why? Because if everyone arrested for marijuana possession got a jury trial, the entire legal system would grind to a halt. The War On Drugs cannot survive without plea deals.

I'm on the fence about this story. Sounds like they were taking advantage of the system to make a lot of money. The bunker of weed, mailing it, which I would think would be a felony. I've found there are a lot of people taking advantage of the system, usually when I read these stories there are multiple factors, usually it's about large amounts, and large amounts of money being made, other illegal activities, etc.

The only part I find to be BS is them being able to count plants over time. Even a person only growing for himself would reach 100 pretty quick.

If you go to a jury trial you will pay a very heavy penalty when you lose and you will lose against the feds.
They have a 99% conviction rate.

The us goverment is dirty enough to do practically anything to get a indictment and get you infront of a judge. I've seen them bust a grow of 30 plants and then count seeds to get to 100 plants then get a indictment for over 100 plants and a 5 year minimum.

If you decide to take it to jury trial that will cost you around 80 - 100 thousand dollars.

If you have sold any to anybody they will then hit you with conspiracy charges that add another 10 years.

with the feds a few plants will get you the same as 100 and if the gov can prove that you grew them. (Which they easily can)
there is no way out of it period.

That is why there are always plea deals.
Who in thier right mind would spend 80 grand and risk 15 years in prison just hoping for some pie in the sky jury nullification bullshit.

I have seen a few dudes with the balls to try it and they are now old men in the pen serving 15-18 years.

Remember there is no early release with feds you do 90% of what you are sentenced.

Where is the notion that these folks were making a lot of money coming from?

The statement says "took in" 750k to 1m over 26 months.

The article says that there were employees. Businesses have expenses.

But lets wave the red flag of absurdity and ignore that, and choose the high end of one million dollars of money "took in". If we further oversimplify by saying that there's an equal distribution in money's being "took in" we end up with an annual pre-tax salary of just under $231,000 per licensed professional.

Now, if we allow for some expenses for the business, like the noted advertising and employees, the location and offices and supplies, this number plumets. If you want, factor in the potential costs of a grow...

The short story is that they were not making 'a lot' of money by California standards, or licensed professional standards.

Re-read the article: The bunker had enough plants to make the appraiser 'scared'. Not that he was asked to assess the value of a 10,000 square foot underground grow op. All it says is that a man got scared of some plants.

To someone allergic to bees, one bee is enough to inspire fear.

Contextualize this with the fact that the man was invited on the property to check it's value--they were not hiding anything.

Contextualize this with the fact that the feds had to count plants over years to get them to the trigger point of 100+.

Most importantly, if you're going to read this thread, look back at Babbabud's post number 4, a first hand account of the character of these individuals. (Sorry about all the bold and italics and underlineing. Just couldn't control myself.)

Molly was our doctor many years ago. What wonderful compassionate people they both are. Before you got you rec Dale would spend some time with you explaining the legalities of having an MJ rec. Molly would write your rec and always end her exam with a hug. What great compassionate people. So sorry you have to go through this Dale and Molly.

If the feds can charge you with something you did in the past, why then can't Obama be arrested for possession? He has publicly admitted to using mj in the past. That's a federal offense. I don't believe there's anything in the Constitution that protect the president from facing criminal charges. Perhaps if our president were handcuffed and taken into custody at a public event, he might rethink his ramping up of the war on drugs. Surely there's a DEA agent or US attorney out there who'd like to make a name for him or herself by busting the president.
 
I wonder if you could throw out a solid defense by saying that all you are doing is resizing the same 10-15 plants every time they get too big (this is cloning defined in a manner) thus forcing them to prove over 100 different gentic structures??? It might fly if no-one on the jury is a grower to confuse the definition of new plants...and if one is a grower who understands you are just renaming cloning he should be cool and at least leave it a hung jury, i would hope.
 
the first thing i want to say is i really dont even understand why this was illegal? some hater from the state police basically narced them out federally... wtf, id like to bitch slap that dude. First i want to say is it illegal for a lawyer to marry a doctor? no. Second, is it illegal for a lawyer to have two jobs? no. Third, why can a lawyer not run a dispensary? I see how they are tring to make it sound like a conspiracy, but come on... sounds to me that he was in his state guidelines correct? did i miss something about him not being? I soooo dont get after all these years and how things are now that its basically illegal to have a full range cannabusiness... from seed to ashes is illegal.... seed/clone to bud is legal. "reimbersement" by dispensaries, legal. selling by dispensaries, HIGHLY legal..... Smoking, legal with a recomendation... But if your smart enough to see the big picture before someone else realizes its profitable its a bad thing and its illegal???? This is a catastrophic failure of the American Justice system...

I understand that this is federal and these people are mutually fucked, people need to learn as i did that sometimes your government will fuck you over, if you try to fight it, they will fuck you harder... They wanted to be crusaders and not take the plea, but imo that was stupid, now their both getting 5yr.. that was a personal choice i guess...
 
@Corvette, no you couldnt because the federal government deems anything with roots, stem and foliage to be a plant, so even if it once was the same plant it is no longer seen that way legally

Don't the police actually have to witness the plants in order to get a warrant? Would pictures on the net count as evidence in an affidavit? I seems to me they have to personally be there and "vouch" for it or something. This is for people that are saying they are going to stop posting up pics of their grows

The enemy is a tricky crafty fucker. Would never be palling around with cops and growing, not ever. Don't care how "cool" those cops are, at the end of the day they're still cops who's whole job is arresting people and locking people up. I don't even trust Barry Cooper for what it's worth...

IT's obvious that the local Leo was keeping track of how many plants where grown and handed that info over to the feds. I would never have a Leo in my house. They are not there to help us they are there to collect evidence against us. Then they do a dance on a civil rights and tell us we dont have any rights. Leo lies all the time never trust them please people you might think your doing the right thing but if your involving Leo in a illegal activity they will collect all the evidence and then your in jail.
