no they can do it on a misdemeanor. When I worked at a law firm I saw a case where they seized 43k from the owner of some nail salons. They raided his houses his sisters as will as his girlfriend. Each home had at least 10k

i dont understand how they were able to search his sisters house..must have had somebody on tape explainin how that money was obtained illegally..

It's a money grab make no mistake about that.. They are out for your money and they don't care how they get it because HEY they are the law LOL what a bunch of BULLSHIT .. too bad it's us that pays for it.. Money in bank accounts should be small amounts with a provable means of obtaining the money. That means having a tax ID and the proper licenses and permits from the city, a seperate account for that business, a savings account for taxes with-held, and a personal account with your name on it.(the only account with your name on it) You would probably have the most protection with your business account if your business were incorporated, with you being one of several owners but maintaining the controlling share. Excessive funds should be placed in a trust originated and controlled through someone outside the US jurisdiction. Electronic transfers outside the US are monitored closely. Its probably best to have an imaginary "service" that your business requires and that you pay it in cash, then transfer that money to the foreign trust. Any large asset you own needs to be owned by the trust, own nothing personally.

Well here in Canada they just confiscated a $200.000.00 Lamborghini and new BMW for speeding down a mountain the first day he got the car.excess speeds of 200 is what the paper said. The cops decided to keep the cars as punishment . The Lamborghini is half owned lol..peace out Headband707
 
you dont have to be charged with a crime for the government to take your money or property. US courts have decreed that your stuff doesn't have the rights you do, and that innocent until proven guilty does not apply. You must go to court, cause if they seize your shit it gets a court date, and prove that the court should allow you reclaim your property. Its all crap basically designed to part you from your property.
 
doesnt there have to be an intent to sale,distribute or whatever,before a cop can take your money?...i know all kinds of folks who have been convicted of possession of small amounts of pot and nothin was ever brought up about their money or property..

In my state, a friend got busted 2 years ago for growing ~200 plants, and they gave him a fat fine and sent him to prison for 2 years (he's getting out tomorrow!) but they did not take any of his things in his home, motorcycles, cars or anything with his business (gardening/landscaping).

asset forfeiture or condemnation sucks, is a civil action and plays by a a completely different set of rules. Like stated, you have to prove your shit is innocent.

It varies from department to department. I have seen the extremes of both ends, small and large busts.


It is a tool for LEO to use to fund their "war chest". Tougher economic times will lead them to take more.


BTW most people can not afford to fight it. A Public defender will not handle this because it is civil. My local courthouse posts legal notices in the hallway and there are 10-15 notices that are in the $5,000 range, a old car, some cash, etc

freezing bank accounts and seizing real estate is more complicated. First of all you should never have that much money in the bank. And for real estate, if there is a mortgage, they wont take it

anything they can remove, they will if they desire. Believe nothing is off limits, they will get tow trucks, or 18 wheelers if they have to.

And no, you do not have to be charged with a felony or crime. I have seen stuff taken as part of search warrants. The warrant allowed them to take anything they wanted. Then they file a suit. Criminal charges may or may not follow

thats what i'm talkin about..you know they would have taken the guys stuff if they could 've so why didnt they?...did they take any cash?

Where I live a guy was pulled over and found to have in excess of 10,000 dollars cash in his vehicle. He refused to explain where it came from so it was taken from him.

From my understanding a hearing date is set up and you go and explain and PROVE where the money came from or you lose it.....

It is not just the DOJ. The IRS,Child Support,Labor Board even counties can file a lien or freeze accounts if they feel you owe.

I agree with Sam the Man...except the foreign trust arrangement. Courts routinely ignore these now--and if you have one LEO, will most certainly bring in the FBI & IRS and your legal woes just doubled if not tripled.

Google "asset protection" strategies for more ideas; and remember--you must implement your strategy BEFORE the shit hits the fan. Lots of ways to grow & keep your dough.

whats the deal with LEASED cars....can cops seize those, even though the bank owns the car.

They don't care about leased cars because it belongs to the dealership, you are just renting it long term.

Overall leasing is a bad idea financially, but for a grower its a fantastic idea.
