Unfortunately I have to say....GET A GOOD ATTORNEY NOW!!!! No way around that if you want your money back. No experience with this but I would hope it's a non-issue and you get the money back without a fight. Any priors for drugs/dealing? If they have nothing but a 1g bag-o-weed they can't pin you as a dealer.

I'll say, if all you had was that 1 gram on you and that was it. Then getting your money back should be a lot easier then most other people. Like the above said, if you could afford an attorney, not a johnny cockrin but a decent one, then this situation should be a walk in the park for you and him. Hope it all works out.

Your story is shady man. Why would your girlfriend's sister's boyfriend attack you? Did you provoke it? Why wasn't he the one arrested?

Arresting you over a gram is ridiculous but keep in mind that cops hate nothing more than people who have more money than them. They spend most of their lives driving around the same route over and over for very little pay. If they see a kid with $6k in his pocket (who walks around with $6500? you were way safer hiding it at home than having it on you) they'll put 2 and 2 together.

Now in court things may play out differently. They need to prove WITHOUT ANY DOUBT that it's drug money otherwise you're innocent. So a lawyer + any proof of why you had the money and where you obtained it should be enough to get the money back. No scales/baggies/quantity works in your favor very well.

I agree with supermanlives. A good attorney might even cost more than 6500 lol. If you are telling the truth and determined enough you will most likely get the money back. It will probably just take forever and cost you a few K (both directly and indirectly).
 
also, you do not need an id to deposit money. hell ive had other people in other states do it for me...
the bank could give 2 fucks about money going in, unless its alot. they only id when taking money out

I feel bad for you bro.. I feel bad for myself going through the same shit as you.. In my case they charged me with distribution for a small misdemeanor amount of marijuana & scale which the DA could not prove in court.

A week later I get a letter that not me, but the money I had in my possession is being sued.. Court docot reads State of blah blah -Vs- $550 in us currency.. I'm blown away how they can take your money/property over crimes they could not prove. Crooks I tell ya, the whole fucking slew of them from the police, da, lawyers on up..

The catch of the hole thing is, is that it usually costs more to fight the forfeiture then just eating it up as a theft of your money by those you pay to protect and serve. unfortunately these laws dont depend on innocence or guilt. People loose there livelihoods and assets to police in this country for nothing more then suspicion of a crime.

yep for future reference i've deposited thousands in cash into accounts with no id that were accounts that were not even mine. hell one time i had to have them get the account number for me because i wrote it down wrong.

a lawyer is going to eat up that 6500 i would try to look into getting it back myself first. i'd rather mess up and not get it then get back $500 after paying a lawyer 6k.

Don't tell the lawyer how much was taken, just tell em you can prove it's legit. If you have to say anything, just say "four figures". Try to get a lawyer's bid from the proof, not necessarily the amount.

Then you need to consider having the dude that mugged you charged.
 
GOD damn that's effed up! I don't think a lawyer will cost over 6k to get that shit back. And if so, shop around! There's alot of hurtin lawyers, just like the rest of us in this crappy economy.

if you have a legal job or a friend that has some money on paper some way to show proof that you made/ came in to contact with that legally then they have to give you back your money... if you cannot a lawyer is also probably pointless but worth a shot...

i had a cop trying to take 1200 from me cause he smelled weed.. i told him if you do then your wasting both of our time you have to do paper work and ill file a complaint against you by myself and sue the state... lol now may not take it that far but the cop new i had a job and once i told him i would just go down with a pay stub he stopped trying to play that game....

I didn't explain the story all the way obviously. Gf and I had a fight. She grabbed the handle of my doorthe day before when I tried to drive away so she got some uts/scrapes. Family thought I beat her her sisters bf is a druggie illegal mexican deadbeat dad. He told me I had to run my pockets and pop my trunk. He supposedly had my gf call to meet up with me and idk what t believe I wouldn't be suprised if she was in on it but what can you do? I'm a pretty intelligent guy and I feel like I got bent over and buttfucked wth no lube. I jut had brain surgery for a tumor and on my collar bone and I got beaten...and I never got a detective number or anything! I got treated like scum when I was the victim! As soon as the ruffians told authorities that I sold they forgot al about how they pulled a gun and knocked my face in. I wasn't injured that badly and its a shame that I had a broken collar bone otherwise all 900000 of those fucking pieces of shit would be 6 feet deep....agh I hate not keeping my composure but you had to be there...shit was epic. Don't know how I got away

good luck man! hopefully the lazy piggies have to fork over your cash back, its amazing how crazy cops go on a tip from a ex or a persons partner. you would think all the psychological training would go into detail how vindictive and crafty angry people can be.

my friend was kicking his gf outta his house and she called the cops and told them he was suicidal and crazy and he had to spend the weekend at a looney bin before they released him, how messed is that?

just assume the money is lost and plead your case on the principle and flaws of our laws, if you are able to retrieve your cash think of it as a bonus. you just got taxed by the man, it happens to us all sometime or another unfortunately. best of luck to u!

yea i would say your girl needs to go.... peroid.. but like i said you want your money no lawyer needed you need to prove you acquired the money through legal means... ie a job or a friend lent you the money and the friend needs to stick up for you and prove they have the means to have that much money in the first place too....

This just isn't true at all with forfeiture laws. The burden of proof is on YOU not the law. YOU have to prove it wasn't drug money, not the other way around. This is just another way the government has to unjustly fuck with people. ...and once you've proven it's yours, you can't even go after the police legally to get compensated for the attorney you had to get to get your own damn money back.
