Yeah hammerhead I'm getting SSDI. Glad you finally got yours! At least you'll get back pay, I think from five months after you apply!

How long ago did you first apply HH?
Also, did you use an attorney to submit your app, or just do it yourself?

Glad to hear it worked out for you HH. I am one of the few people that I have heard of who got it on the first pass through. In fact, my application got hung up a bit at the end because it was chosen for an audit after it was approved, and passed a second time. I did the application process myself, and I think that the key is to have about a 6' pile of documentation. Mine was an industrial injury, and I had kept records every step of the way. The only down side was that I apparently could have done it several years before I applied.

I forgot about this thread :) My back pay goes back for when I first filled for dissability. I will receive 22,500$ for almost 2 years of fighting them. If anyone needs info on how to get SSDI we can try and help you. Its not easy and will require commitment for 2 years+. I tried myself and was denied. I then got a lawyer and 2 years later I had my day in court and won

for some reason the judge like to see you represented. You must show that the severity of your dissability prevents you from doing any work. Those people that you see when you walk into target or wallmart and say hi to you. If you can do this you will lose

I'm sure you're well aware of the sheer stupidity of the rules, that with any felony conviction you could lose all that hard earned benefit. Since cultivation or possession of any quantity is a felony in most places, until the feds change their tune, IMO having state MMJ certification is meaningless and only creates risk for SSDI recipients. Especially true in this most recent political climate, the news lately, and the positions of the justice dept., DEA, etc. That really sucks because it really is screwy for the most in need of MMJ being the most at risk when having it, but that's the fact. So my advice is to just keep your head down, play it cool, and just hope that the feds will pull their heads out of their asses someday.

Im not sure what you mean. Are yo saying the people that need SSDI should not apply because they use cannabis? We all know it's illegal by the feds:dunno: Im not going to blow off my benefits because I use cannabis. I have not read any Articles about people losing there SSDI for using cannabis. I could be wrong there just not publishing this info. I know people that have SSDI got busted with less then an oz and not lose there SSDI.

I never said anything about not applying for SSDI. Of course those that warrant it deserve it. I just said a state sanctioned MMJ program is meaningless to the feds, therefore meaningless to me. That is my opinion of the matter. There is nothing to argue.

I agree the feds dont care. But I do and would never just toss 25k for no reason. No argument I'm trying to understand your thinking here witch I dont. If you got hurt and could not work you would not apply? I guess if thats how you feel No worries but if you are disabled I would encourage you to apply

Congrats hammerhead! Glad to hear someone getting it seriously their suppose to be helping us but instead you end up fighting a bunch of healthies that have no clue what your going through. Ive been denied 4 times now got a lawyer suppose to go to court been waiting a year now & still nothing LAME.

Yes make sure you give your lawyer all of your med records. Very important to show that you can not do any work. Medication is also a must have for the Judge. When she saw how much Morphine I was taking she just told the guy on the phone he was not needed and hung up. There will be you, your lawyer, the judge and The Vocational Expert this is the guy thats going to say if there are jobs that you can do with your dissability. Good luck at your hearing

Dude...there seems to be some miscommunication someplace HH. Let me try to state my position one more time.

I have been on SSDI for four and a half years. I got hurt in the USAF and VA would only "award" me 30% disabled (bastids, I can't walk much, no balance, pain, etc,). I should have been medically retired, but no. I did my whole 20. I got hurt 12 years ago. Retired from the military Sept 1, 2001 (just before 9/11). I've been diagnosed with degenerative disk disease, spinal stenosis in c-4 through c-7 I think it is (something like that, I'd have to look again), and arthritis. Bunch of medical terms. I just know I'm fucked and it hurts. All the time. I've seen a bunch of drs., 3 different neurologists, bunch of tests, MRIs, CAT scans and X-rays, and did physical therapy. I'm just screwed, blued, and tattooed. In other words just royally fucked, I guess. I fell as soon as I got out of bed this morning. That sucked.

I suppose I'm sorta lucky because I got approved without hardly applying. A little less than five years ago I went in to file my wife's death certificate so I could get that paltry $254. The lady said, "Since you turned fifty last year your now eligible for disability". I was in a daze anyway from the sudden death and said, "Cool". It seems that when you turn fifty some extra rule kicks in.

My stance on MMJ is just directed toward the state laws and clubs. I think until the feds go for MMJ it's just not wise for people like me to be on any list or in some database. I do use cannabis and think it should be available to everyone. Growing your own is your best option (if you can). But growing being felony under federal law, ain't good.

But of course, "to each his own". Just because I feel that way about this situation, doesn't at all mean you should think like that, or anybody for that matter. Do what you like. Congrats!

Here in Ca we are not on any list or in any database if you dont want to be. All you need to show is your doc rec. you dont need the cards. If you get a state card then of course you would be in there database if you used Medicann you would be in there data base. You do not need to use either of these just show your rec thats it. Im only fimiliaer with Ca rules about SSDI so if your in another state I have no info to help you sorry.

I think I know what your saying qdavid, if your receiving ssdi & you get on the feds list about growing med cannabis or getting busted growing you can get screwed by the feds & they take away your ssdi !

I wouldn't doubt it! the feds are there you help, I mean fuck you over!

qdavid I know it sucks to deal with drs. trying to figure out whats wrong with you went through the mri's. etc. they finally found the disc that was bad by using discogram I think thats how you spell it, even then the first dr. to use the discogram was doing the wrong disc & put in med records the pain was just in my head & I just wanted pain killers, err when I found that in my med records when I went to a different pain dr. I wanted to rip her f-ing head off! The second pain dr. found the bad disc had fusion surgery & still in pain, so put me down as screwed blued & tattooed also!
Good luck to you, I just try to keep a low profile myself grow my meds. in a non mmj. state & fuck them if they can't take a joke!:plant grow:

Thanks dude (or dudette, gotta be PC, ya know?). My brother-in law had that spinal fusion surgery.

Glad to hear I'm not the only one who thinks that way about MMJ lists. Actually, on second thought, I think I may have read some other people say that too. But good to hear it. It just makes sense. Good luck.
