Is paypal going to pork me on a counterfeit goods purchase?

I have a claim in for something that I bought close to retail, it has the company name & logo, as well as "made in the usa"stamped into it, most likely done in china, it is 100% fake.

Anyways, paypal says the claim is 'granted' but I must ship the item back to the seller. When I called the "customer service" rep (We go back a long time laugh laugh). He said that they were going to waive me requiring proof that it was counterfeit but I had to send it back.

When I asked him what happens if the seller refuses the shipment he stated the refund would still be given even if it showed attempted delivery. I call BS on this, they are shady fucks, and the user agreement says otherwise.

I also told him I'm pretty sure it's against federal law to ship counterfeit goods, he didn't really respond to that. This blows double since it wasn't funded from a CC payment so I can't do a chargeback.

What do I do now? Go to the cops with it? Ship it and hope for the best? (I'll destroy it internally of course, it electric :) ) I've spoken to the company that manufactures it and they've confirmed it's counterfeit, I could show other proof as well. I've already ordered another genuine one from an authorized dealer, I just want my money back at this point, I can deal with throwing a brick through the front window of the seller when this profession finally brings me to cali ;)

On a side note, this is a massive problem, this guy has 10K+ feedback and everything he sells is something commonly counterfeited, it makes me sick.

just ship it back using a method that confirms shipment and delivery confirmation. the reason you are returning it is because it's not as it was described (counterfeit vs genuine). i would not worry about shipping something counterfeit it happens daily no one cares about a single item. now if you have a shipping container of fake gucci bags or dvds then i'd be concerned.

they will refund your payment upon reciving a tracking number send back anyway you want, ups, fed x, or usps, dont give a fuck about the reciver ie. company, just make sure you get a tracking # then call paypal give them the # and you'll recieve payment in minutes.

WORD. That's what I was sorta wondering, and exactly what I wanted to hear from someone who knew the deal. Frying the thing & shipping it first thing tomorrow.

Yes it is.

Gave PP a tracking # 'round noontime- the decision granted went away and it said awaiting other party's response, I knew it was going to do that. They've had it all day and no refund, looks like it will be awhile now.

I know I'm a bit paranoid, but it's just something for my 9-5 that could reveal what my 9-5 is which I'd rather not.

Today I bought a similar product that said on the box: "contents made in the usa"

Well the contents clearly said 'made in china'!
 
like others said, ship it back with tracking.
the company you got it from may even give you a shipping label so you will not have to pay. just email them, act very very nice, say you want to return it, say you wont leave negative feedback if they give you a label.
so what was the item if you dont mind me asking, and what did you pay? how much more was the legit one?
i knew some of the clothing and handbags were fake, but i didn't know too many electronics besides the sandisc memory cards

edit:nm just read your post above, at least let us know how much cheaper the fake was

Wait, there are people who actually have had GOOD experiences with eBay/Paypal? :laughing:

Seriously though, they're all a bunch of scamming pieces of shit. I lost thousands of dollars because of PP's mistake years ago and now I still receive a monthly e-mail asking me to pay a $100 fee and jump back into the black. :laughing: they're out their cotton picking minds

Yeah ebay sucks for the most part, I use it a lot less these days. I paid $80 shipped from e-bay, $95 shipped for the legit one I have in my hands finally. The seller has 11K feedback, when I requested his info from e-bay his phone # turned out to be a hospital. They don't give a shit.

We will see if I get my money back in a few days, regardless I won't get my $8 return shipping back. If anyone learns one thing out of this though let it be this: Never fund a purchase directly from your paypal balance. Keep your paypal account and any bank accounts linked to it at zero. When you want to buy something make sure it is funded through a debit/credit card that always has a zero balance on it except for what you are spending. If I had done that in this situation I would have already had my money back. Would have gone straight to the credit card company & done a chargeback. Keeping the balances @ zero is really only needed for sellers.

Yeah I am paranoid, it's because I have dealt with paypal 'customer service' in the past, they will lie, SWEAR, and hang up on you, it's fucking insane.

Before their merger eBay was the King of terrible service. About a decade ago before they really "blew up" I searched for an hour or more to find a toll free customer service number...finally reached someone after a very long hold...and then was hung up on within a few seconds of having the call answered because they didn't like the question I asked. Take a break, half an hour later go to log back in to the site and get the number again -- they removed the fucking website. No bullshit. I'm sure they've only become more evil since then.

Still no refund, but I found a holy grail if paypal wants things to go south: Google so you hate paypal

They give out several different customer service numbers as you can see there. It's just a list but I still managed to pull a good quote that sums there little operation up-

Avoid using PayPal's automated email submission center -- that email goes straight to New Delhi, India where you will get a prompt reply back that has nothing to do with what you asked in the first place.

Weird that you've experienced this.

When my gf bought what turned out to be a fake bracelet on eBay, PayPal refunded her, but only once she'd signed a declaration to say that she had destroyed the counterfeit goods.

There was never any mention of returning the goods to the seller.

Maybe UK law works differently..

Sold an Iphone on Ebay and the girl paid me through pay pal. About a month later, I received an email from pay pal saying she never received the item and they refunded her money and wanted the originally sold price of $199 back from me. Some how even though I have the return receipt from the post office that she received it, I am out the phone and a bad mark on my credit. She has a nice iphone and her $200 bucks, what a world we live in. I still occasionally get collections letters for that's shit
