Does this small like a scam to you?

So yesterday I am driving my girlfriend down to Sacramento for a doctors appointment. I have been having a hard time finding a job in my town which is very tourist-reliant and is in the dead season so unfortunately my car insurance was expired.

ANd of course, I get in the first accident of my life. With a Mercedes.
I am a very good driver and I still don't know how the hell this happened. The guy in front of my was stopped at a green light, there was about 20-30 feet in between him and the car in front of him. They got out, then I said lets pull into the gas station ahead, so we did and BEFORE I EVER GOT OUT OF THE CAR they were talking with a woman who just happens to be a mercedes autobody worker...

She tried telling me that it could cost 1600$, 1000$ for the brackets if they are damaged (they are 40$ each i looked em up)
I just got off the phone with him and hes now hes telling me that its a total is 2888$, and that the muffler is bent in.. I was going 20 MPH, and i hit my brakes.

I told him I don't have the money, but maybe I could do a payment plan so now hes suing me (supposedly) and taking me to court.

Why do you always get kicked when you are down? Ever notice that?

Sounds like a scam to me. Tell her to meet you at the dealership so you can know how much it is really going to cost.

At the very least, have to other party involed get multiple quotes, to keep him honest.
And because its a benz its gonna be pricey to fix.. Sucks man, i feel for you..

if i were you i would do the following:


send him a registered letter offering to repair the car on your own expenses from YOUR mechanic....

if he says yes....then it costs you a shitload less than what he is charging.....

if he says no....then when you go to court you have a registered letter saying that you offered to fix the car and he refused it, the judge will rule in your favor 9/10.....this will also prove that he is trying to scam you


EDIT- make sure when you go to court to have an estimation from YOUR mechanic that says it will cost what you say it will




but on a side note, if his car is in the last 8 years i bet it does cost about 2k to fix....they dont come cheap...especially from the DEALERSHIP

probably charging you for being a nice guy and not getting the police involved. Lost license and reinstatement fees. I'd say thats worth a couple hundred right there. Just pay the dude and move on.

If I were in a mercedes and some dude without insurance rear ended me I'd call the police and file a report.

Protip: Don't drive faster than the person in front of you.

have you fixed your insurance lapse? If not, I would do that first. Then have him get a few quotes, as stated earlier, and go that route. He may be trying to pull one over on you....kind of like pulling one over on the dmv for not having insurance when you should have. Not trying to kick you when you are down, but get all your ducks in a row and pursue the situation the right way.

Was there significant body damage, or just a bent bumper? There's a possibility he might just want to pocket the cash & not even have the repair done. By the way, since you offered a payment plan; and it wasn't satisfactory to him, he's a moron then to have filed suit. If the judge has proof you tried to offer a payment solution, the court costs likely would be the responsibility of the plaintiff. Ask for quotes the plaintiff got, compare with yours. In the end, he will have to accept some kind of payment plan, lawsuit or not. No one can squeeze you for all that money up front, especially if you don't have it. The key is, as long as there is an effort on your side, in the court's eyes.

If he has insurance, he should be covered under the "uninsured motorist coverage"

Tell him to file it with his insurance and leave you alone, he missed his opportunity to call the cops.

No police report....no comprende....I would go with scam as he has not suggested authorities or his insurance company.

not trying to sound like a dick...but if i was driving a mercedes and some uninsured dude crashed into me damn right id sue you.

stop acting like its anyone elses fault besides your own.

that being said...what you should do is just not pay and let it hit your credit. my roomate crashed his 400 dollar hyundai beater into some ladies brand new volvo. her insurance company took care of her, then tried to sue my roomate. since my roomate is broke and has nothing in his name, they couldnt do anything except move to collections..then you just ignore their calls. after 5 years his credit is almost back to normal.....

i drove for a couple years with no Ls or insurance so i know the struggle....but still you F'd that guys day up as well....hes gonna lose value in his car most definately.
 
No, it doesn't sound like a scam. Pay it if you can, if you can't, let his uninsured motorist coverage pay it for him, they'll come after you for the cost of the repair and probably for the collection costs as well. Bye bye credit rating in that case; probably hassles with the DMV for being uninsured too. In hindsight you would have saved money by being insured but oh well.
If it were my Mercedes ( I wish ) I would definitely NOT let you pick the collision shop where your cousin Bubba will take care of the repairs with a pry bar, Bondo, and some duct tape.

There's no report? Police never called? It never happened...it wasn't you. Let them sue you.

Unless you WERE at fault then you should pay up.

If it's a scam, they'll drop it and find another sucker. If it's true, they'll sue you. It happens all the time, scams and people being sued for damages.

My wife was just rear ended at like 3 mph...just a small dent in the bumper and trunk lid, and a small ripple in the quarter panel, and it cost $3000 for the repair...on a Corolla!!
You hit the guys car...period-- Ask for a copy of the estimate, take it to another body shop and ask them if it seems right-- If it does, then pay the man--
If it goes to Court, you will lose, still owe the $$...and also you will get another big fine for no insurance...plus Court Costs!!
Always better to do the right thing--:tiphat:

Since the police were not involved. Next time he calls, just ask him what the fuck he's talking about? Get your car fixed so there's no proof you've been in an accident.

Don't sign shit. Don't admit to anything by text/phone/writing.

It could be a scam but maybe not. No real way to tell since they're so slick these days. $3k sounds ridiculous though.

Sorry to hear about your accident,i would get a few estimates before agreeing to pay.But the repair costs sound about right.Those are quite expensive to fix,especially if its a AMG one.

Seriously? You're driving uninsured and it's the OTHER guy's fault? Standard American MO, I reckon...blame everybody else, no personal responsibility. Pretty sad, no?
