Well guys! i had it coming! haha.


about 2 weeks ago, i chopped some outdoor plants, hung them to dry and let them sit..

5 days later i returned to do a trim and jar the buds, i found that a good portion of my stash had been stolen (girlfriends mom and friend took it..) i got pissed and packed all the "herb" into jars and put it in my truck..


about 2 hours later i was at my brothers home, in the backyard working on the table saw (helping him remodel the basement) when 5 "MAGNET" officers approached the backyard, cuffed me and my girlfriend and proceeded to question us about said plants..

they got the bright idea to search my vehicle and found the jars, i would say a good pound of wet herb in the jars. TAKE IN MIND AT THIS POINT I WAS NOT LEGAL. they took the jars and took pictures of my truck and the jars.. and left just as silently as they came..

the next day i went to my local ceritification office and finished my paperwork for becoming legal. I am now 100% legal, i have not been summoned to court, nor was i arrested at the time of the search and seizure..

my question for you!

can they still stick me with possession of the "herb"?

they said something like.. transporting..manufacturing..and something else?

i explained i was in the process of obtaining my medical card, and they left me in peace.. now im sitting here waiting for the shit storm to hit!

ive heard through the grapevine(other locals caught in somewhat similar situations..) that the charges will be hard to stick on me since im now a legal patient/caregiver..

wondering if i should waste my time/money on a lawyer?

did i mention i lost my job, and residence over this whole fiasco? LAME. advice needed!!

there were 4 plants total, my state legislation states a patient may posses up to 12 plants for personal use. and up to 2.5 ounces of dried/cured SMOKEABLE bud, mind you the bud they took was in no way "smokeable"...

ummm time/money on a lawyer is never wasted... if fact spend alittle more time/money then you can afford on one and youll be alittle better off... more you spend the better your sentence... (not always true but its amazing what alitlle $$ can do to grease some wheels....)

Money on a lawyer is never wasted. In fact, you should get as much money as you can, and get the best attorney possible; as soon as possible. At least on a retainer basis in case they come and charge you with something.

Even though you have your med card, you sure they allow you to have outdoor plants? I know on my side of town it speificially says "in a locked facility"..... Get a lawyer man; they'll give you better advice than me and any one else.

dont have much $$ to obtain a lawyer, but i do plan on getting some sort of representation..

im not sure on the outdoor plants , assuming the worst.

Although the plants were not on my property and they have no proof that i was the one tending to the plants or that i had even planted them in the first place.. as they found the bud in jars and said they had "heard" i was growing..

confused about my situation.. no charges have been made, it is an "ongoing investigation" as the officer put it. Although im 100% positive the shit storm isnt far off.. im left herb'less and broke!

the herb she took was not recovered nor did they attempt to recover it..

she is the one who tipped them off, and fed them a load of shit that conflicts my story of things.. they are now watching her waiting for her to slip up! she is not medical.

they showed up on her tip off, no idea how they found out were i was or that i had anything on my person, the mother had no knowledge of were i had gone to, or were my brother lives. all very fishy smelling?

it did not make sense to not take me to jail right then and there? isnt generally how police operate in this area, as ive had friends booked on minimal possesion charges of less than 2grams.

they have also been contacting me, asking me to become a "CI" for them and rat out any herb dealers i may know in the area, im not a rat nor do i plan to help them in anyway, in turn they offered to "help" me with my case? now i wasnt born yesterday so i know this is a ploy to get me to flop over any info i may have out of pure fear, as the piggies never intend to help any "criminal". thats why they say "now i cant promise you anything.. BUT..if you do this and that it will LOOK good" im not falling for that BS.


ive also been advised by other local med. users, to plead neglegence about the plants, as i had only found them and harvested the fruits! and take the heat for the posession of the actuall buds..as there is no proof i had tended to the plants or planted them in the first place..

You had more then was legally aloud for one patient, even though it was uncured.

One way to beat that, is to lable your medicine with staggered "ready" dates. May not save you but is better then nothing, gives your lawyer something else to work with.

I would get your gf legal asap and list her as your patient, there for raising the legal limit you are aloud before court as well.

Shitty shit man, hope you don't catch a drug related charge right before you were legal.

Wasn't the car parked on private property when they arrested you? Did they have a warrant for you? Did that warrant grant permission to search your car on private prperty simply because they arrested you?

Sounds like alot is missing here.

Also 2 hours later? when you put a # of fresh herb in the trunk I suggest you go A to B, it is no time to run errands and stop and help people out. Have to have a "mission" frame of mind, discipline.
Affirmative defense in MI is strong, you will be a true test of how strong it is, and what defines "ready useable medicine"

I suggest using a lawyer off the norml site if you can afford it, and if not, get multiple referrals from them in your price range.

your case is gonna depend on the judges mm views. i have a patient under similar circumstance. popped growing, all his numbers were in compliance with the act. then he got legal within weeks after the raid. the judge wouldnt allow mm as a reason so now he is in the court of appeals. good luck.

i kept my mouth shut about everything regarding the actuall cultivation of the product, i simply admitted to having the pot in my vehicle.

note: i was living with gf's mom at said time, could this be a loop hole? as i was not the property owner, i was simply a guest? never changed official address to that location nor did i pay rent or have a renters agreement.

seems like alot of variables to pin point just myself as the sole criminal. She herself is being watched and has realized it prolly wasnt the smartest thing to do.. as its coming back to haunt her smoking and security.

they kept saying i was growing it in this pop up trailer, that i had the bud drying in. I could take that defense, as that was a secure facility. i only had 2 plants worth of slightly immature buds.


i also have no previous felonies, or any previous drug charges of any kind. just a humble pot smoker.. busted for the first time!
