Yeah, the shooter is fucked. He shot the guy while he was fleeing. He should have shot him while in the yard.

Should have shot him in the yard or drug his thieving ass back into the yard after shooting him. (If you are into that kind of thing. I wouldn't shoot anyone over material possessions.)

I've got a few opinions about this story. First off, these people were growing in the middle of the city so they should have built up their fence to prevent this. Secondly, All rippers should be used as fertilizer (make use of the waste of life). Third, Yeah the shooter is probably fucked, but if you look at the truck the bullets were going through the windshield so the truck was facing the shooter. A grey area because the thieves could have still shot at the man or tried to run him over, we don't know the whole story. Lastly, the reporter threw in a degrading remark about changing the growing laws there (not cool) he also talks about how there were "hundreds" of plants there, sounds like he's trying to invite the feds to come take a look.
With prop 19 coming up this is a bad time for a story like this, hopefully it won't get around the state too much.

I am reading my local paper and I have not seen a Cannabis story get to my paper faster than this one has. Normally I can find several instances of an article being published in my email inbox before I'll see it in the Modesto Bee..

So :
FRESNO -- Police say a huge marijuana crop in a Fresno backyard with plants reaching 10 feet high was apparently irresistible to a man critically wounded while trying to steal a personal stash.

The 40-year-old man was shot Wednesday morning at the home across the street from Roeding Park. He's in critical condition at Community Regional Medical Center.

The Fresno Bee says 47-year-old Phayvanh Dydouangphan, who lives in the home where the pot crop is tended and has a medical marijuana card, is being questioned by police but he still hadn't been charged late Wednesday.

It's unclear if the pot is a legal medical marijuana grow.

The 3,750-square-foot marijuana garden is is easily seen from the street.

I thought this would make for an interesting discussion and a fun poll.
I won't take it too seriously myself and no one should.

Consider it a humorous way to explore how we feel.

ripper get what they have coming now and then but it sure sounds like this grower was asking for trouble if his plants are visable from the street and he did not have the area secured from people going in and doing what the ripper did but point of law if you use deadly force they need to be on your property hopefully hanging in a window or in a porch area if they have successfully left the property and no one was killed or injured by them its a no no to blast them and in most cases if you get a liscense number the police will prosicute as a property crime such as burglary or grand theft depending on the value of what was taken

My preference is Taser XREPs using a street sweeper for the delivery method. After incapacitating the asshole one can then calmly decide on the next step, with no blood pool to clean up. Some might prefer to turn the asshole over to the authorities, some might enjoy administering a long, slow, and very painful death.

The guy that shot the ripper has got to be nut's, First off he lives in a area that has a lot of crime, second if your plants are ten feet high on a busy street that can be seen by everyone driving by, then you probably will get targeted by rippers.

I think the severity of action taken against a ripper, depends on the rippers actions once confronted.

Had the dead man been armed and shot in the yard, maybe. If he was in the act of fleeing, there's no self defense plea.

Anyone who has had CCW training or anything resembling formal firearms training (at least that includes legal responsibilities) knows that this guy is totally screwed. The use of the gun was completely illegal and his garden will probably be determined to be an attractive nuisance (unfenced swimming pool....). Pretty stupid thing to do over a plant - for all of the involved parties. The timing couldn't have been better for the anti-19 folks.

We don't know but, it's been heavily suggested in the stories I've read.

The classic example is: 2 guys drive to a store, one goes in with a gun demanding money, store owner kills him. Who's guilty of murder? Not the corpse, not the owner (self defense) so it's the guy in the car that never touched the gun or went in the store.

So far, there's no suggestion of threat to life. Without self defense, the murder charge can't jump the shooter to get to those in the car.

damn this is fucked up. first off...all theives deserve to die.

however use some common sense and do not shoot if they are fleeing. that is for sure gonna get you in some trouble. the jury needs to see that your immediate life or property was threatened. shoot him in the face when hes facing you or dont shoot him at all.
