For those of you who think prop19 wont have an affect on our current med laws, read this and tell me what you think....

This item exempts medical marijuana patients only in cities, and only with regard to how much they may possess and consume. It makes it legal to ban medical marijuana dispensaries, collectives, and delivery services. Unless the city enacts a sin tax, any buying and selling will be illegal.
That whole statement is wrong. For one, they already do ban dispensaries even without Prop 19. 2nd, it does not only exempt patients from how much they possess or consume, also from cultivation and sale. 3rd, if a city does not want to sell cannabis then medical is still protected.

from Prop 19:

7. Ensure that if a city decides not to tax and regulate the sale of cannabis, that buying and selling cannabis within that city’s limits remain illegal, but that the city’s citizens still have the right to possess and consume small amounts, except as permitted under Health and Safety Sections 11362.5 and 11362.7 through 11362.9.
HS 11362.7 is what we know as "SB420" which reads


(e) No person or designated primary caregiver in possession of a valid identification card shall be subject to arrest for possession, transportation, delivery, or cultivation of medical marijuana in an amount established pursuant to this article, unless there is reasonable cause to believe that the information contained in the card is false or falsified, the card has been obtained by means of fraud, or the person is otherwise in violation of the provisions of this article.
AND

(c) A primary caregiver who receives compensation for actual expenses, including reasonable compensation incurred for services provided to an eligible qualified patient or person with an identification card to enable that person to use marijuana under this article, or for payment for out-of-pocket expenses incurred in providing those services, or both, shall not, on the sole basis of that fact, be subject to prosecution or punishment under Section 11359 or 11360.
AND

11362.775. Qualified patients, persons with valid identification cards, and the designated primary caregivers of qualified patients and persons with identification cards, who associate within the State of California in order collectively or cooperatively to cultivate marijuana for medical purposes, shall not solely on the basis of that fact be subject to state criminal sanctions under Section 11357, 11358, 11359, 11360, 11366, 11366.5, or 11570.
How does that not protect medical patients, collectives, and primary caregivers?

That article is total bs...even one of the readers made this comment.

For possession (Item 7), and sales (Item 8), in the preamble, the following text closes each item:

"except as permitted under Health and Safety Sections 11362.5 and 11362.7 through 11362.9."

This means that the text of those Health and Safety codes will still stand, for both possession and sales. Prop 19 will control the sale and posession, "except as permitted under Health and Safety Sections 11362.5 and 11362.7 through 11362.9.", in other words, the current medical marijuana laws.

In the future, run your article by a lawyer before you publish it.

I should add here that it is a "Political Thing" that I am experiencing. There have been a few folks I met for the first time the past two weeks who are saying and doing the disinformation thing.
somewhere this "Action" is being shared or promoted.

The Prop 19 is dead because of "Rand and other" Vauge concepts are what I am hearing and have been presented as fact.
It's been to similar to be individual points of view.

So be aware that it's a small group but they seem to be trying to project failure on the local areas.

They are easy to prove wrong just by asking them to be specific on what the source of information is as they don't know. They just know to do this "negative projecting."

Again get a vote buddy please.. Get your Granny if you can..


The Rand Occasional Paper states they know not what way the Cannabis wind blows. I agree, I also agree that the central valley area is the last best hope for No votes.
However, the Central Valley isn't a slam dunk against prop 19 if the voters go vote. That I am really sure of.

I just realized something that hasn't been brought up in all this..

Cannabis is illegal both federally and internationally. Federally it's illegal under the Controlled Substances Act. And internationally in the Single Convention On Narcotic Drugs, 1961.

The reason 215 works is because individual states regulate medical practice, not the feds.. also the SCOND 1961 has an exemption for medical use.

So, all we can really do is repeal our existing marijuana laws and leave enforcement up to the feds.. But we can't legalize a federal felony!

Yeah, I'm familiar with our constitution.. but I'm also thinking about Gonzalez v Raiche. Plus the fact that the feds came in and busted the first sheriff authorized 215 grow in Mendocino the other day.. So yeah, I'm sure it'll end up in the courts...

Screw the conservatives and lets get it done in the next two years.. If they don't like this Anal Tax2010 then they are dumber than dirt. It won't get better for the haters than Tax2010
