That sucks man, but live and learn. Make sure all weapons you have are Legal and registered. Keep nothing out in open (I have probs with that rule) and never answere the door if cops are at it. Go to a upstairs window and make contact from there or just don't answere.

I myself found out the hardway too. One day after work I just sat down for a vap. Next thing I know my pops calls me, hey you got troopers with shotguns running up on your house. I was like wtf and was panicing running around hiding things. Next thing I know my back door is being bashed in. I open the door before they break it down, only to have 2 shotguns directly in my face. They ask for some guy, I say you got the wrong address. They say we have word that so and so is going to commit suicide at this location. I was like um no, he is not here.... They then ask to search my house, I say no warrent no search. They then push me outa the way and say they smell marijuana (yeah i just vped...) and begin searching my house. Say what you wanna say but when you have a gun in your face you will do as told. Checking all closets, basement ext. Finding my purple kush mother that I have kept for the last 5 years but missing the 30 plants buding (2nd week)in my main room somehow All in all I got a pssesion of mary jane ticket and a 150 dollar fine and alot of embarassment as my neighbors saw me being arrested for the first time in my 35 year old life.

and for the people wondering exactly how it went down, there was 'an emergency call' posted in the area about someone being stabbed.. so they say. they come kncoking on my door, i see its a LEO in the peep hole, i freak, cut they power to the grow room, lock up. and sit. just sit. they begin to bang on the fucking windows, now my adrenaline is pumping but yet im impaired on opiates among other things such as coronas and weed.


i end up answering (believe me i played this scenario through my head 1,000 times by now) they tell me they're in the area for someone being stabbed and said they noticed my place REEKS like 'marijuana'

i admitted to had smoking a bowl, and give up my pipe which was on me, and they asked for the weed. i said i didnt have any left.. they conned me with their bullshit into 'well we're just gonna get a warrent unless you give up what you have..'
inside im shakin like fuck, im just gonna givethis pig a 20 sack or something.. so im like ok i'll grab it.

i walk back in to which he followed with out my consent.
(remember folks if in a situation shut the door and lock it behind yyou.

i gave up a sack and this fucker says 'well you know what? i think you got more.' i say no way man thats it. get out my crib.
'get a warrent'

at this point i have 4 officers in my residence, and i tell them give me my ticket and get the fuck out..

3 officers leave to get 'said warrant'
3 minutes later they enter again while im in custody.
ohhh we gotta make sure theres no weapons in the house..

my grow room is locked and they kicked the fucking door down (which i later had to pay the landlord for) and took my ass to county.

i went calmly which is not like me at all, but i knew i was in a heap of shit, kept my mouth shut like a good ol' boy. fuck making a statement.


bottom line is, they knew what they were there for. I fucked up on so many levels in handling the situation.
i useto transport herb via interstate and been in some sticky situations but being impaired on drugs and alcohol seemed to fuck me the most.

initially my attorney thought i was gonna get off scott free, as the evidence of the grow was basically illegal.

he did a bunch of research and found a few cases close to mine and in one of which a new law was pass3ed - sort of a 'no harm no fowl' law.

they claimed to be getting a warrant and since they where supposedly going to obtain one (whether a judge would have granted one or not) the evidence found was going to be found 'regardless'

i could have fought 4 felonies in which all put together the max sentence would have been 35 years in the pen.. if i lost my case they wouldnt hesitate put my white ass in the pen for all above charges.

i kick myself in the ass everyday about this but its done and done. sucks beyond imagination but what can i do.

im gonna be using my previous address while in court - no reason they need to know i have no permanent place to stay.

also i just got into an "intensive out-patient treatment" program thats a 26 week deal. i'll only be a couple weeks into it by court time but what judge is going to pull an "addict" out of recovery and lock'm up?? i mean at least thats my thoughts and a few others, but then again we're talking about the "JUSTICE SYSTEM"
ive been pretty edgy and depressed lately but i got lots of support and much is coming from a few here at IC.

Unless you have had a few felonys in the past there is no way you'll do time on your 1st class 4. Time served with probation. And fuck that IOP bull shit. Lie to all drug and alcohol evaluations. If you tell them people the truth about how often you use mj or anything else your gonna be taking drug tests for the next 2 years of your life. And thats a promise. I have 2 class 4 felonys for possesion of controlled substance (herion) I did a total of 75 days in county. That wasnt shit. Where I fucked up was by telling the IOP people the truth about my drug habits. For the next 18 months I was basically a ginea pig for North Central Behavorial Health Systems. Xanax, Seroquel, Ambient, Trazidone. The list goes on folks. Bottom line. Tell them people at the evaluation that you have never smoked weed before. It was a one time thing. Not to be negative but rehab always ='ed relapse for me.

No tellin holmes.. but in my mind they werent leaving. despite what 'police reports' say, i know they were after me..

one thing i forgot to mention - when i answered the door they asked "are you ********?" that was a bit odd to me, and at the time i thought they were there for something completely different seeing as they knew my name.. ppl say well yeah but thats public info and all that. probably fucked either way, but i'll still fight every instance in my head until i lose my mind.

see i bullshitted my way through that like whoa, and then after filling out froms and forms of crap!! i talked to the counselor - tatted up crazy dude, seemed decent. he actually is a friend of my lawyer and basically told me even if i emellish my drug use (which i didnt have to) its going to help my case as i am "a drug addict" and not a "dealer" so i mean yeah the UA's are gonna happen anyways i dont mind sharing a little info, i mean i was busted with some other drugs too so.. its not like its not common knowledge to the judge.



as crazy as it sounds to some i'd almost prefere to get a year in prison off the bat and do my 6 months in and get out on good time.. but i have responsibilities so im pressing for probation even if it is a few years or so..

Probable cause and "acting in good faith" gets them around a warrant.

Never mind that they perjure about a dozen times and are "acting in good faith"

Also, never mind that they didn't find what they were looking for and "their basis for the warrant" was all made up in their heads.

They still find a gun and I am done.

The cops broke into two houses without warrants and it stood.

as others have said here, thanks for a grim story from the front lines of this war
the one thing i've seen in common from these deals with no warrant entry, LE lies every time
one deal comes to mind, video/audio record of your entry area
the equipment is cheap, wonder how the pretrial hearing would go when you can introduce a little 'this is how it happened' evidence?
something not easily seen, say with a panic button by your entry area so a record of an hour or so is created
water over the dam, sounds like you have a pretty good chance of walking pretty soon
