probation

hey all, im new to these forums so im not sure if im even asking this in the correct area. sorry in advance if im wrong.

i got a question tho. i got arrested back in july of 2009, original charge was a cannibus felony. the sentence was probation for 1 year starting on september 17 but i was given the opportunity for early termination after only 6 months as long as i stayed clean and completed a drug rehab type of program, which i have. today marks those 6 months, and i tested clean again. so basically im just awaiting a court hearing so the judge can grant me my early termination.

my question is do you think ill be tested at court? ive been told thats pretty unheard of but i would like some outside opinions from anyone whos been through something like this before. thanks in advance.

I doubt the early termination will happen on its own. You should mention this "early termination" deal to your probation officer. Many have the procedural ability to and will file a request with the sentencing court for early termination. They'd like to lessen their case-load too!

If you had private counsel, also ask them to effect the deal.

Usually, courts rely upon the reports provided by probation and do not themselves drug test. Not too many courts are staffed and equipped to implement instant pee tests. There are exceptions, but not typical.

thanks the the resoponse. i spoke to my probation officer today and she said it was up to my lawyer and me to set up a hearing for the early termination, which we have. so im just waiting on that date. so do you think im in the safe zone to spark up?

plan your party now, but hold off ... a premature esparkulation could ruin a very beautiful thing ... getting the gov't out of your life.

AND, for what it's worth, remember how you ended up on probation in the first place and make sure it never happens again.

i dont think its up to the judge they have more on their plate to give a shit about someone on probation usually just the probo officer. id go in and see him/her tomorrow prolly just tell you bye and hope not to see you again, they have so many people to deal with they dont know when time is up. congrats on staying clean bud

Its possible. I've been tested at court.... kinda same deal as you... i wasnt sure if i was gunna b tested or not so i stayed clean for 2 weeks, and was scared shitless i was gunna fail. I passed tho thankfully

Yeaa the courts have drug testin, cuz they test the inmates that are released during the day for work. Also atleast in my city its commen to be tested during sentencing for drug related charges... Stay clean bro, its not worth taking the risk

yes wait it out, i actually fucked myself by failing the test they gave me in court after going through a year of shit....then i had to start all over...lets just say in my younger years i was constantly on probation.....just wait it out bro!

Ask your lawyer if there is anyway you dont have to appear in acourt ofr your early termination date. Chances are he can just go for you maybe tell him you have something to do and you`ll be gone at various times throughout the month or maybe even the whole month. Your lawyer should know if your appearance is necessary
