States are making their own laws in defiance of federal law
On the state level these laws are 'legal'
On the fed level they are 'illegal'

The only penalties regarding Kush should be against the people who claim its from cali & the people who think its the best weed in the world. In the UK Skunk is the generic word for hybrid canna regardles of the strain, sounds like Kush is the US version of Skunk.
