I have the 6th edition Nolo landlords legal guide in front of me. California requires 24 hr notice and specifies landlord may come in during "normal business hours" Which to me would exclude weekends. Hope this helps..good luck.

I dont understand you say you are legal well whats the point of 215 if you have to pack up your plants on a whim?It woul;d seem to me that its pretty discriminatory to out someone thats doing something legal.

According to what you say, you should be just fine, don't panic. If you live in California, have a valid doctor's recommendation per Prop 215, and if it is not forbidden in your lease, you are on solid legal ground. Especially with today's California Supreme Court verdict striking down limits on how much a patient may possess.

Practically, your landlord could be ignorant and try to illegally evict you, but there is likely an "Unlawful Detainer" office at your downtown courthouse that provides free legal advice to tenants in need.

Edit: if you know a lawyer, call in a favor, have him present during inspection. Have your original recommendations and a valid ID ready to go. If no lawyer, print out Prop 215 and the news article regarding the recent Supreme Court decision. Don't deviate from the script: show them the law, show them the news, show them your recommendation, show them your lease. Don't get into your medical history, you don't want to waive your patient/doctor privilege. Its for personal use, that's all you say, nothing more. Untouchable.

Why would that crack you up? He doesn't appear to be doing anything illegal along with all the other Californians legally growing under Prop 215. You must be one of those people who enjoy seeing others suffer, in which case, I wonder why you would be posting in these forums at all. Then I saw your name and your join date. I think Fox News may be more your style.

If you def want to continue staying their ,i would move it for the day just in case.You prob won't get in any trouble cause your legal .But who knows what the landlord thinks.Also good for noone else to know your biz.Landlords talk to everybody..just some thoughts.

its law that they gotta give you 24 hours

also the landlord just cant come in to inspect anything he has to have a reasonable excuse like fixing something, etc.

if it comes down to tear everything down and hide it. we had to do this twice. tahts why you are supposed to set up your grow to be easily torn down if you rent.

well land lord came, i didnt' move anything i was just prepard with prop 215 documentation and dr reccomendation....

i heard a knock at the door then he opened the door, i got up outta bed (naked) with a blanket draped over me, and coughed... then my dog (pitbull) went to the door, the guy saw her and said he would come back later... the letter on the door said the inspection was between 11am and 4pm and its 5:30 now so i guess they decided not to inspect me.

thanks for the advice everyone, i woulda done the u haul thing if i was growing illegally in some other state but i feel like its my right to grow my medicine and i dont have to hide shit from anyone.... anyway he musta thought i was sick bc i was all sweaty when i woke up from sleeping under the down blanket plus i went to the door naked with a blanket over my shoulder then my pit walked up and he decided not to inspect i was gona tell em to fuck off anyway...

That's the news I was waiting for, good job. I know it took some balls to stand your ground, so I am very impressed, especially in light of all the bad advice that quickly filled your thread. Sounds to me like your landlord may come back in the near future, so keep your copy of Prop 215, copy of People v. Kelly (2010 California Supreme Court decision banning limits on possession), your original recommendation, and your lease handy. You can't be intimidated anymore: you know your rights and are armed with evidence.

Edit: there are two factors at play here: the landlord and the cops. The cops are the most immediate issue. Even though you are growing legally, you still don't want to be arrested by some ignorant cop. That's the biggest reason for having the copy of Prop 215 and your recommendation. Remember too, that before yesterday, the number of plants would have exceeded the statutory limit that was struck down by the California Supreme Court yesterday in People v. Kelly. You can't expect all cops to instantly recognize this. So you want a copy of that decision so you can politely educate them, if need be. (By the way, you never ever get rude with cop, even when you are right. Cops have to believe they are in control of the situation or else they lose control of their emotions. Whenever I confront a cop I always say "Please, Sir, thank you.")

You have the paperwork ready for the landlord too, but a landlord can't evict you immediately, they have to go through a complicated and lengthy process, the courts make landlords dot all their i's and cross all their t's before they can evict a tenant. A cop, however, can arrest you on the spot, so you need to be prepared for both.

How much you want to bet that he'll be back? I have lived in a lot of rentals especially apartments and I'll get notices of inspection talk to them and then they get caught up with something else or other tenants but they always come back.

p.s. Don't tell him to fuck off. You don't want to outright lose your place. Also if you want to live somewhere else its good to have a good rental history/ referral. You might be able to just grease his palm too.

I've been evicted myself, and it sucks ass. But its because the renter was bat shit crazy I took her to the city and she got into shit for what she was trying to pull. I still ended up out looking for a new place in a real inconvenient time though.

Good advice about trying to maintain a good rental history/referral. Bribing the landlord is not so good advice. If I felt backed into a corner, I may consider a 'pre-emptive strike' where I approach the landlord with the law and my paperwork before he has a chance to inspect anything. I may also, very calmly and diplomatically, inform the landlord that if I am illegally evicted and denied access to my medical marijuana, then he is going to have very expensive lawsuit on his hands and he better have his assets hidden or have a real good insurance policy. This would likely prevent you from being evicted, but would guarantee a nice little rent increase when your lease expires.

Oh shit...get the uhaul. Poopy and I did it and it worked out okay...other than it's the north fuckin pole n shit here and we got some cold shock. Yield was affected, but that's because it's colder than ice here sometimes. BUT, landlords sat on my couch and walked around the house. Took time and some money, but worth it.

Man, y'all are killing me. UHAUL is for illegal operations. The OP has every legal right to grow, why would he rent a UHAUL?

1) It is a waste of money
2) It is inconvenient. You have to go down to the UHAUL store, rent it, bring it back, then INCONSPICUOUSLY load it up with pot pants and then INCONSPICUOUSLY drive it somewhere and drop it off where no one is going to think its a bomb or smell it. And then what would you say if you got busted loading it or parking it? Um, I'm legally allowed to grow this, really.
3) Prop 215 isn't perfect. It allows for possession, not transportation. When you transport marijuana, even with a recommendation, you are at risk. Therefore, the UHAUL idea would be putting the OP at more risk then if he allowed the inspection.
