H.R.2848 - High Potency Marihuana Sentencing Enhancement Act of 2009
Introduced. High Potency Marihuana Sentencing Enhancement Act of 2009 - Amends the Controlled Substances Act to provide enhanced fines and prison terms for trafficking in marihuana with a tetrahydrocannabinol content of 15% or more.

Has this been in the news and I'm just hearing about it today for the first time ?
Is there anyone working on our behalf to stop this legislation?
What will this new restriction do to the medical quality marijuana many of us depend upon?

So what? Now they are planning to test every batch that they seize to determine this? PITA and another waste of taxpayer loot. Most dispensaries don't have this capability. ARGH!
If we're going to get scientific with it, then how about we get reasonable and stop busting people for the weight of their fucking root systems and soil?

Punishing people for having better weed is retarded (I know there are a lot of good strains under 15%). This bill is retarded. Congress is useless.

‘(8)(A) Unless a higher penalty is otherwise provided in this Act, in the case of a violation of subsection (a) involving high potency marihuana such person shall be sentenced to a term of imprisonment of not more than 25 years and if death or serious bodily injury result shall be sentenced to a term of imprisonment of not less than 20 years or more than life, a fine not to exceed the greater of that provided in title 18, United States Code, or $1,000,000 if the defendant is an individual or $5,000,000 if the defendant is other than an individual, or both. If any person commits such a violation after a prior conviction for a felony drug offense has become final, such person shall be sentenced to a term of imprisonment of not more than 35 years, and if death or serious bodily injury result from the use of such substance shall be sentenced to life imprisonment, a fine not the exceed the greater of that provided in title 18, United States Code, or $2,000,000 if the defendant is an individual or $10,000,000 if the defendant is other than an individual, or both. Notwithstanding any other provision of law, the court shall not place on probation or suspend the sentence of any person sentenced under the provisions of this subparagraph which provide for a mandatory term of imprisonment.CommentsClose CommentsPermalink

How many grows really get shut down by the FBI? Most of the time it's state laws that are applied, I could see this effecting growers that use national lands...but really, those fed laws are already so harsh...there is no way that they can use federal laws on eeryone.

The majority of the citizens would be in prison!

No, they would probably try a stretch by saying there was violence from the good bud....or someone being under it's influence....and nothing to do with the increased penalty or how some people just do not pay attention driving sober or were on some other drug.

They don't have a possession limit defining that new punishment, but I can see the FBI trying it out on some big operation....or just closing the noose on California. They would need a lot of new prisons to do more than just be dumb and make it look like Congress does something to earn that paycheck!

Imagine if stoners just passed fascist laws all day, like a mandatory minimum yearly harvest.

This bill was just political grandstanding IMO, and isn't likely to go anywhere. Last action was on 7/23 when it was referred to the Subcommittee on Crime, Terrorism, and Homeland Security. The bill has no co-sponsors.
