4 months and still no charges

FWIW, I have a friend who was indicted on felony distribution charges. He was free on bond (or is it bail?) after his arrest. His lawyer kept getting continuances, pusing back the trial for something like a year. After a while, his lawyer stopped calling him and stopped returning his messages. Finally, one day, his lawyer called him to say the DA dropped the charges since the case was so old and things were not progressing due to the continuances.

I'm not saying that is what is going on with you, but rather, it is possible. It is also possible the DA/court hasn't gotten around to prosecuting your case yet, but hey fully intend on doing so.

Just keep in contact with your lawyer's office and see what he/she says.

I have a buddy who got jammed by the feds, he hasnot been back to court for about 8 months now. Good thing for you is your out on bond. They will let you roam around and do your thing, hoping you fuck up more, or worst...get more people jammed up just by being around you and their dealings.

btw, I was never arrested, charged, indicted. I am in Missouri, but this will be a Federal case if and when things do move forward. I make a weekly phone call to my lawyer to make sure I there is no indictment, it would be real shitty to have U.S. Marshalls at my door on a friday night. The DEA guy that I did my proffer session with said that I got a really good attorney, that he is real slick with these cases and knows how to work the system. The way my lawyer talked to the assistant U.S. attorney and the DEA youd think i only got popped with an ounce, when in reality i'm looking at 5-10 mandatory.

i got busted with 15 plants and 30 odd clones a while back. I had misdemeanor possession and intent to manufacture charges. I was put on probation, did my community service. Finished, moved to a different state. Almost two years later I find out there's a bench warrant for my arrest because they decide to indite me for two felony 5s. Had to fly back a whole bunch, shell out a bunch of cash to a lawyer, got it reduced to a misdemeanor, 2k fine. No probation though, so I was happy. They were really throwing the book at the guy I got busted with, and had to charge me too. Ancillary casualty. Should've stuck with the herb instead of the kilos!

I'm not surprized they haven't charged you yet, they don't want to start the clock running. My fed case took a little over 4 months before they indited me on a "criminal complaint", took almost 2 years before I was sentenced. Luckily if you just get caught with weed and get a good lawyer, present yourself well the A-USA and fed judges know that it's just weed, they see far worse all the time. In my case I was able to buy my 5k1, talk about corrupt system. My PSI said I couldn't afford to pay a fine, but I paid a huge money judement to the fed marshalls pretty funny, got probabtion and only got cuffed for a few minutes when I did a walk through with my lawyer. Always have a good lawyer if you go big!

In federal court, not really, just takes longer to get on with your life. Being his first time he'll qualify for the safety valve, he will get sentencing points knocked off just for that, acceptance of responsibility, perhaps offering to pay a fine as "cooperation" to get a 5k1. The feds know this guy would rather get as many points knocked off the sentencing guidelines and he'll likely get probation. Chances are the warrant is clean enough it would be a slam dunk to send him to jail otherwise. 5 year sentence would be 3 years with a drug program. Unfortunately they don't do the boot camps anymore, at least with that you could get in decent shape, and be outside.

I totally agree with that statement, I think we were on the same page. In a case like this "beating it" is being able to walk away with probation.

THEY ARE NEVER IN A HURRY TO indict, the feds know their time limits & usually wait until the last min to put the charges on you.. they want to wait as long as they can to solidify the evidence + it gives them time to "paint the best picture"..they are also busy people..

that being said, to anyone reading this....DONT HAVE GUNS-simple easy rule to follow...it will just make things worse is you are caught.

And what are you going to do shoot the robber and have the cops come investigating gun shots? i just dont see how a gun could ever help u when growing nothing but shit comeing your way.

This is why it's a great idea to have a high limit credit card handy. You can bail out of jail with it (esp. if you arrange with a bondsman in advance) and/or pay a lawyer with it (esp. if you arrange with a lawyer in advance). Sure youll get your ass way in debt, esp. to the attorney...bondsman will apply your secured bond amount to your credit card and refund it, minus the bail fee of 10% of so, after you case is over, but at least you won't rot in jail. Usually the measure is whether the money paid was likely obtained through illegal means (cash generally won't work once you're on a drug charge...atty will be more lenient on cash payment than bondsman or the magistrate/court will not be. Cash won't be accepted in most cases).

Credit cards are the best solution to this problem.

My lawyer never had a problem with cash. I had some trafficking charges years ago and did just that, walked into the lawyers office with a pile of cash.
And I would like to add the MONEY talks in legal situations. If you have not saved any money and your busted, your broke ass will do more time than the guy who had the foresight to stash a legal fund.
Just my experience with the legal system.
