Medical Marijuana: First California DEA Arrests Under Obama Took Place Last Week

A massive DEA operation featuring dozens of heavily armed agents and at least four helicopters ended with the arrests of five people in California's Lake County last week. According to California NORML, the arrests are believed to be the first since the Obama administration announced it would not persecute medical marijuana providers in states where it is legal unless they violated both state and federal law.

The DEA seized 154 marijuana plants from Upper Lake resident Tom Carter, and arrested him, former UMCC dispensary operator Scott Feil and his wife, Steven Swanson, and Brett Bassignani. Carter is a registered medical marijuana patient and provider, and his wife, Jamie Ceridono, told the Lake County News he was growing for several patients and his grow was legal under state law.

The genesis of the bust appears to lie with an alleged May deal between a DEA informant and Bassignani to purchase marijuana. According to documents filed by Carter's federal defenders late last week, the informant claimed to have arranged to buy marijuana from Carter and to have left a voicemail message for Carter to set up the deal. That same informant allegedly made a deal to buy marijuana from Bassignani.

In the document, the federal defenders said prosecutors made no claim that Carter ever heard the phone message the informant allegedly called and that they set out no evidence linking Carter and the informant.

"All the complaint says is that another individual, Mr. Bassignani, called the informant, claimed he worked for 'Carter Construction,' and arranged a marijuana deal," Carter's defense attorneys wrote. "The deal later took place, and the only other reference to Mr. Carter is the conclusory claim that the informant 'had agreed on the price with Carter.' No context, no specifics, and no other information is provided in the complaint which indicates that Mr. Carter in fact talked to the informant, arranged a marijuana deal, and indicated that he (Carter) was knowingly involved in a marijuana transaction."

Moving that the two felony counts of marijuana trafficking against Carter be dismissed, the attorneys added: "This complaint is sadly deficient with regard to whether Mr. Carter has done anything to indicate that he conspired to break the law. It should be dismissed accordingly."

It is unclear why Feil and his wife were arrested. They are neighbors of Carter and his wife.

Carter and Feil are being held in Oakland, where they are set to have initial detention hearings today and tomorrow. Federal prosecutors have asked that Carter be held pending trial "on the basis of flight risk and danger to the community."

Carter is a long-time resident of Upper Lake, prominent construction contractor, and community benefactor.

"California already has enough federal marijuana criminals," said CANORML coordinator
Dale Gieringer, "It's time for concrete changes in federal law."

While the Obama administration has announced it would no go after law-abiding medical marijuana providers, the DEA has conducted at least two raids against providers in San Francisco and Los Angeles, although there have been no arrests in those cases. The administration has not announced any changes in federal laws or regulations around medical marijuana, and Bush appointees continue to serve in the DEA and the US Attorney's Office of Northern California, which is prosecuting the case.

Just like the animals they are they just sat back and waited in the bushes. Let the people start to feel somewhat at ease, and then strike like a venomous snake.

So i guess since they cant catch anyone for these alleged "cartel grows" on national land they go after the next best thing.

maybe there is a secret agenda behind this bust. This is also the first bust since eric holder said that state law could be used as a defense. the article says "Carter is a long-time resident of Upper Lake, prominent construction contractor, and community benefactor."

He might have enough sway to take this to the supreme court and win. This would set a precedent for the rest of us. It would be a great step towards getting pot taken off the schedule one list, which is the biggest thing standing in the way of federal mmj laws.

UPPER LAKE – Federal authorities arrested a well-known Upper Lake contractor Tuesday as part of an extensive enforcement operation, with at least two others also taken into custody.


But the federal defenders assigned to Upper Lake resident Tom Carter's case said in court documents filed this week that the complaint against him is “sadly deficient” and offers little in the way of information about his alleged involvement in a May marijuana deal arranged by an informant.


Dozens of Drug Enforcement Administration (DEA) agents armed with assault rifles and driving more than two dozen black Cadillac Escalades descended on the Hunter Point Road home Carter shares with wife, Jamie Ceridono, on Tuesday just before 7:30 a.m., Ceridono said Friday.


Ceridono said she counted four helicopters flying overhead at one point during the operation.


Later that day, Brett Bassignani, Carter's co-defendant in the case, was arrested at his Clover Valley Road home, Ceridono said. Also arrested was a neighbor, Scott Feil.


“I don't know the charges,” said Ceridono. “I don't know what's going on. No one has told me.”


Ceridono said her husband is being held at a jail facility in the Oakland area. Initially, after the arrest, she said he was taken to Sonoma County and was checked by medical personnel after his blood pressure shot up, causing her to believe he was having a heart attack.


“I don't know what he could have done to cause this,” she said, noting that her husband has worked hard all of his life, donated time to community causes and done fundraisers, as well as introducing the recent Rainbow Bridge Festival.


She said she saw a sheriff's official and another man who she believed was a local policeman on scene. Capt. James Bauman of the Lake County Sheriff's Office said the agency wasn't involved in the DEA operation earlier this week.



DEA spokesperson Casey McEnry would offer little information about the raid.


“I can confirm the enforcement operation; however, the search warrants remain under court seal and I am prohibited from providing further details relating to the operation. I don't anticipate the warrants being unsealed anytime soon,” McEnry said in an e-mail response to Lake County News' inquiry about Carter's arrest.


When pressed on the circumstances of Carter's arrest, McEnry referred Lake County News to the US Attorney's Office in San Francisco. Repeated attempts to contact a spokesperson at that agency Friday afternoon were unsuccessful.


Carter, who was arraigned Wednesday, is facing two felony counts of conspiracy and possession with the intent to distribute under the federal Controlled Substance Act.


At his hearing, the US Attorney's Office requested that he be detained “on the basis of flight risk and danger to the community,” according to federal court documents obtained by Lake County News.


A detention hearing is set for Wednesday, Aug. 26, in San Francisco before US Magistrate Judge Bernard Zimmerman.


Ceridono said she was held in a chair in her front yard from about 7:30 a.m. to 3 p.m. on Tuesday. Also held were members of her husband's construction crew. Her teenage daughter was allowed to leave with her older daughter during the operation.


Officials took 154 marijuana plants that Ceridono said were covered by medical marijuana prescriptions held by her husband and several others. Also taken was her computer.


Agents went through Carter's and Ceridono's home, but she said they didn't trash it. She said a head agent seemed surprised not to find more plants or evidence.


Ceridono said at one point agents “didn't have anything to do.”


“They were playing with my dogs, they were so bored,” she said.


She said her husband, whose hard physical labor has resulted in a lot of aches and pains, also suffered a fracture in his back in May when he rolled his truck, and uses medical marijuana to deal with pain. Ceridono said she doesn't use the drug.


Federal court documents show that the US Attorney's Office requested on Aug. 14 – four days before Carter's arrest – that documents filed against him in the United States District Court for the Northern District of California be sealed, which US Magistrate Judge Maria-Elena James agreed to do the same day.


On Wednesday, US Magistrate Judge Bernard Zimmerman signed an order to unseal the documents at the request of Assistant US Attorney Tarek Helou.


On Thursday, federal defenders Barry J. Portman and Geoffrey A. Hansen filed a 26-page pre-trial memorandum regarding Carter's detention to dismiss the case, citing “sadly deficient” evidence.


The document explains that a confidential informant claimed to have arranged to purchase marijuana from Carter, leaving a message on an unspecified number alleged to be Carter's voice mail to set up the deal. That same informant allegedly made a purchase deal with Bassignani.


Carter's federal defenders said the case against Carter contains no claim that he got the phone message the number that the informant allegedly called and its relationship to Carter also isn't set out in the complaint against him, they noted. Feil''s arrest wasn't listed in the documents.

The document continues, “The deal later took place, and the only other reference to Mr. Carter is the conclusory claim that the informant 'had agreed on the price with Carter.' No context, no specifics, and no other information is provided in the complaint which indicates that Mr. Carter in fact talked to the informant, arranged a marijuana deal, and indicated that he (Carter) was knowingly involved in a marijuana transaction.”


The attorneys added, “This complaint is sadly deficient with regard to whether Mr. Carter has done anything to indicate that he conspired to break the law. It should be dismissed accordingly.”


Carter's counsel also is seeking to receive copies of any evidence that may have been collected by wiretap.


Ceridono said she and a group of friends and supporters are planning to travel to San Francisco next Wednesday for her husband's hearing in federal court.


In the wake of the raid, Ceridono said she feels like she's living in another country. “I don't feel like I'm in California at all.”

i herd via-mouth that a dispo in venice california "organica" was raided by dea/fbi/irs/sherrif and the local dispo owner cited "clones" as the reason they were targeted... im going to leave the dispo/owner anoynmouse, but i will say it was on venice blvd, a street i found 5+dispos on and 1/2 of that sold clones.

the fact that the owner mentioned IRS/FBI makes me think they were not paying proper taxes on, or were selling to minors, or some other illigal action not protected by prop215 in cali.

How many liquor stores are raided by SWAT team thugs & choppers for selling to minors? None. They get a letter in the mail saying their license has been suspended.

This type of military action on the civilian population for consensual crimes is a disgrace.

Obama's a coward. If we're to believe what he says then he's President of the biggest empire the world has ever seen, with Democratic Congress behind him, and he can't control a few heavily-armed buttcracks from the DEA? Pathetic. He's either lying or a pussy.

DEA usually act in severely deficient ways in regards to State laws unfortunately I've seen it happen over and over. Society is still stupid in regards to MJ. Did anyone see the ridiculous CNN headline today? MJ found in Michael Jackson's house. WTF? They could have well said he had a dildo in his underwear closet...and it would have been as relevant..

What we are looking at now in the USA is a first world economic power and a third world labor force.

The USA is split into two economic strata now. The Stocks and Bonds have recovered from the economic melt down but manufacturing and jobs sector is not going to be recovered any time soon.

That the DEA is cutting slack on drugs has more to do with fear of an uprising then defending a SOCIETY IMO now..

That the USA is setting up bases in Columbia is obvious that the USA is looking to capitalize on the Americas.. Drug trade is just another industry.

Mexico is the first to embrace the fear as the poor there are closer to an uprising.

Don't get me wrong I'm all for freedom.

No, Obama won't have to answer any questions.

He made it clear that these operators need to also follow state laws or all bets are off.

It's not really that hard to believe that a few (lol) operators are not following state law.

I might have gone far in life, if it weren't for the simple fact that some psycho-chics can be so damn good in bed.

With that in mind, through absolutely no fault of my own, I once found myself in front of my townhouse surrounded by the local swat team. It's kind of surreal to be surrounded by people yelling orders and pointing guns at you, but I remember at the time looking around and seeing my new neighbor peeking out of her window, and then thinking silly things about this was no way to make a first impression. Can you imagine what it would be like to have "dozens" of federal agents all over your home?

This kind of paramilitary assault is really uncalled for. I can see leo wanting to make sure they are safe, but there are other strategies besides an all out military style assault. It's really going overboard to use these gestapo-style tactics on American citizens.

Yeah, but what fun would that be? For the most part, all the cops I've met are control freaks - like the bullies in school. They like to scare people, they like to inflict fear and terror - that look in people's eyes. It makes them feel like their schmekle is bangin' of their ankles. They got their high, we got ours. Somehow, they've been able to justify it thus far.
