I just wanted to post this report I found of the internet....it is true I was in the chow hall when it kicked off and saw those two beaten kids while being transfered to a federal holding center.....it was not fun, but this is a reality that is. BE SAFE AND SECURE F.A.M.I.L.Y. and all Tri-Staters especially in the keystone....


On August 14, 1995 there was a riot at the State Correctional Institution at Coal Township near Shamokin in central Pennsylvania. Michael Yancey and Aaron Johnson were just two of the young black men from Philadelphia caught up in that incident. The guards have had an opportunity to give their version of events. In the following narrative you'll get the real facts directly from a man involved. The constitutional violations were severe, if not unique. Prisoners are often treated like inventory to provide job security at all costs.

The collapse of the coal mining industry in Pennsylvania's mid-state communities left thousands unemployed. The opening of the state prison in Coal township in 1993 was the state's welfare for the region. It proved to be a gigantic financial catalyst. It is a "medium security" facility housing 1700 inmates. The staff has a total complement of 468 persons. Only 2 are black, a percentage even lower than other Pennsylvania prisons.

During the lunch period on August 14, 1995, there was a disturbance which has been characterized as a riot. Several inmates and guards were assaulted. On the morning after the disturbance, six guards dressed up like ninja stormed cell 244 in "D-Unit," the cell housing Yancey and Johnson. The guards were the self-important members of the "Correctional Emergency Response Team," or "CERT," in bureaucrat-ese. Dressed up in black para-military fatigues and bulletproof Kevlar vests, the guards were armed with billy clubs, stun guns and pepper mace. Although unprovoked, the guards savagely beat Yancey and Johnson and transferred them to punishment cells in the hole or "Restrictive Housing Unit," as officials like to call it. Both men were severely bruised and required medical attention.

Although Johnson suffered a broken jaw, and Yancey was viciously beaten, officials refused to get them medical help. They were not treated until they were transferred to SCI-Dallas, four days after the riot.

While still in the Coal prison hole, the two prisoners were cited with prison misconduct reports alleging that they has assaulted guard Daniel Casey instead of the other way around. Two months later, in October 1995, criminal charges were filed against Yancey and Johnson. Going to extremes, the officials "threw the book" at the men. Based on the allegations of Daniel Casey, the men were charged with riot, assault by a prisoner, aggravated assault, simple assault, recklessly endangering another person, failure to disperse when ordered and disorderly conduct!

The two black men were assigned two local white public defenders, Joseph Michette, Jr. and David Noon and a preliminary hearing was held before the local white district justice, Wilbur Reddinger. It's little surprise that the case was bound over for trial. No medical records were presented to substantiate white guard Casey's claim that he'd been assaulted even though Casey's excuse for not reporting the supposed assault until late was that he'd been "held in the hospital." The two local defenders made no effort to show that no such records existed. Attorney Michette's excuse was that a motion to force the production of records "wouldn't have affected the outcome of the proceedings."

For obvious reasons, Yancey fired Michette and took on his own defense. The court, being in a county that has never had a black sit as a juror, was reluctant to accept Yancey's waiver of counsel. In fact, he was the first black in the history of Northumberland County to represent himself.

On March 11, 1996, Yancey received a bill for half of the cost of treating guard Daniel Casey. It was for only $42.50! It was not for treatment at the time of the August riot. It was not for any supposed assault. It was for treatment of a "strain/sprain" on December 4, 1995, four months after the riot! And 3 days after the preliminary hearing at which the guard testified under oath that he'd been treated on the day of the riot!

Yancey asserts that Casey was never assaulted and that prison personnel and State Police "investigators," Robert McBride and Douglas Foura knew that the allegations were a concoction.

It is virtually unbelievable the extent to which the court violated the inmates' rights, even disregarding geographic judicial boundaries in order to get convictions, fully knowing that the men were innocent.

The law requires that all parts of a case be heard in the county where the alleged offense occurred and that the hearing be public. It's rare to go to a different county and it requires a hearing and the action of the Pennsylvania Supreme Court to assign the county to which the matter will be transferred. Not troubling with pesky laws, Samuel C. Ranck, a senior (meaning "retired") judge from Northumberland county, changed the venue in order to compel Yancey and Johnson to go to trial with 5 other prisoners charged with the riot. The consolidation hearing was actually held in the hole of another state prison in another county. It was not open to the public. Because of the consolidation of all the men into one stew, Yancey and Johnson were convicted along with the others.

Yancey wants to bring an action against Judge Ranck and District Attorney Anthony Ronsins. It's true that "judicial immunity" protects the judge from liability for acts committed within the exercise of his judicial function and that DAs are generally immune. It is unsettled, however, if the judge and DA abdicated their respective immunities by acting outside their geographical jurisdictions where they were simply private citizens.

Yancey seeks counsel to represent his claim. If sustained, it would be an important precedent. The consolidation hearing fated him and Johnson to lose their trial. The hearing was not open to the public and press. The "CERT" guards who had beaten the men were the bailiffs during the hearing!

The "Coal-Blooded" conspiracy encompasses not just prison officials, cops and court personnel, but a community hospital; all with the single objective of job security at the expense of black men imported from the city. Yancey and Johnson seek more than just release from their unlawful confinement. They seek material compensation by way of a civil action against the "Coal-Blooded" conspirators. They should be viewed in the same light as other organized crime.
