The thing i dont understand is will it be illegal for me to grow and sell without paying a tax? If so then then they are voting on full decriminalization not legalization.

Hello all,

I was reading the other day about a gentleman that claimed he moved $10,000 through one despensory alone in a month tax free.

I am starting to get a bit miffed at those who think they should not have to pay taxes...

I have to pay taxes on the money I make. I don't like it but I pay anyway because amoung other things I like the roads/schools/infrastructure the money helps pay for.

Why do pot growers feel they should have to not pay taxes.

It is not right! period.

If you want people to pay taxes on drug money, best way to go about it is legalize. Sure MMJ is legal in cali, but its still a grey/sketchy market just due to the federal issue.

If only your tax money actually went to roads/schools/infrastructure...

If the bill were to pass as is, with the 25 sq foot limitation on my non-medical grow, is there a limit on how tall I can make my 25 sq foot vertical grow?
The only limitation I've read is that any plant CANNOT be seen from a neighbor's property / the street or sidewalk.

If it can be seen from "Outside" your own property it will be considered an Illegal grow and subject to a fine. The cops would most likely chop it down and cite you.

Jack! I really do admire your positive attitude! I'm not sure I'm going to be able to make it, but we will see.

Oh, I found this, I chuckled:
According to AlterNet, pot entrepreneur Richard Lee (who owns seven buildings -- including Oaksterdam University -- within a radius of a few blogs, and who is also working to get legal marijuana on the California ballot in 2010) "soon will be the person most associated with pot legalization in America."

Wow, the BS in this thing just doesn't stop does it.... Although I think you wouldn't want your crop to be seen, just because of rippers. Still crap that that would be called an "illegal" grow.

Just a few examples of the local regulation side companion to the taxcann thing - as they've been being drafted over the last 4 years :/

http://www.oaklandnet.com/measureZ/Measure%20Z%20web%20site/2008%20Agendas/MeasureZMinutes-10-23-08.pdf

Check page 4 for the description of the non-commercial garden. I'm not positive, but I think as these laws would both be in effect the state canopy size would trump the local? And the $1000/yr per light fee would stay in (as no fees in the state portion)

Good example of the kind of surprise I was curious about.. yeah you can grow but any county or town can add a fee? :/

here's a few of the proposed commercial license fees on page 3. note the $30k for 201+ members. I wonder how many members harborside has for 20k :x

http://www.ci.oakland.ca.us/measure...ndas/Measure Z Agenda Package - 15 Jan 09.pdf

There are more complete versions of the whole regs somewhere in all those minutes if you want to look.

Same crew getting caught sabotaging their last ballot, measure z. scheming to leave a typo in the ballot text made it a year past the election before anyone noticed that it actually said the opposite, making sales/smoking legal in public places instead of at home. Wonder what we'll find out was in this? http://www.ci.oakland.ca.us/measure...ion/Private Adult Use Rpt - City Attorney.pdf

If this passes you can guarantee that they will squeeze the blood out of the turnip and try and get every penny they can. California is handing out IOU's today with continued falling tax revenue. They desperately need money and this is how they are going to get it. Whatever BS you think is in the bill the fact remains people will be able to legally grow cannabis and that's what the hell we have been fighting for the last several decades. Baby steps. We're getting there.

so let me get this straight, we can only have one ounce in our house at a time? And the cities get to say whether or not you are allowed to grow? Sounds like a terrible bill.

correct me if im wrong?

One ounce > Nothing.

Except everything else that comes along with this potential proposition. Honestly right now here in California the penalty for possession of an ounce of weed is a $100 ticket. Parking tickets cost more. The odds of getting busted with an ounce out here are slim to none. But lets say you get busted once year holding an ounce, thats $100 out of your pocket... oh wow... now lets say that you smoke 1/2 an ounce a month. Thats $25 in tax monthly because $50 an ounce seems to be the magic number right now, which comes out to $300 more dollars a year.

Settling for legalization in this manner is dumb in my opinion. We can get what we want, the true legalization for the plant which is no law period against cannabis. We are almost there. Look at how the California courts have been ruling on mmj issues. They are being as liberal as possible when it comes to our rights to grow and posses cannabis. The drug warriors are losing the war, how many families have been destroyed, people sent to prison for life, people shot, ect ect to settle for a fucking ounce, gimme a break.

are you kidding me? May as well keep it illegal, like freedomfighter said an ounce is a minor infraction and only cost 100$. How could anyone grow weed with an ounce limit, I think just one of my plants would go over that limit, what would we do just throw away all the other ounces?

weed is an annual plant, id like to be able to grow alot in one season and stock up for the year.

Not to mention putting the power to outlaw it in the hands of the cities is a terrible idea, sounds great if you live in Oakland but what about everyone else? We will still be discrimnated against like awlays.

The way the bill is worded right now may as well just keep going the medical route. I think like many before me have said right now is as good of time as any to do this, but lets just do it right.

I really shouldn't have commented. I don't live in CA. The laws there are so much different from my area. And the politics that back them up.

If I get caught with a 1/8 here, the best I can hope for is a 300-400 dollar fine. 1000 isn't out of the question. Not to mention you get labeled as a drug addict. I need to move to CA.

FWIW, I only have one piece of advice:

Keep cannabis and capitalism separate. DO NOT fetter cannabis culture with institutionalized greed, no matter what they promise. They will always sell you out in the end.

On a related note: most of us here agree that weed already costs too much on the commercial market, especially once you know how to grow it (then the market prices are just downright insulting!) - and this insane mark-up has not gone unnoticed by the powers that be. Just about all of the proposals for actual legalization I've seen by mainstream politicians use current full mark-up prices as a starting point... and you KNOW that it'll only go up from there.

The things I could do with 25 sq feet outside with no thought of legal reprimand!!!

Don't get to exited....25 sq ft is one nice plant outside (5'x5')=25sq ft
U want the cops stoppin by to make sure your plant is trimmed?
to stay within the 5 foot sq?
wanna loose all yer stash to 1 branch hanging over the alloted space?
we need 100 sq ft per person....STOP the bullshit
100 sq ft NO plant count and just STOP it!!!
anything else is just BULLSHIT lip service

WE Need NO WAY to break the Pot rules....
it's the ONLY to remove LEO bullshit from the equation

You guys gotta relax! I have been pulled over recently with a little under 2 lbs on my person. Whipped out my card and basically threatened the cop to get sued and lose another 50 Sacramento police over his bullshit and my legal meds. Got red in the face, made a call to his sup., gave me back my lic and card then prompltly left. So all this doomsday stuff is a little out dated for me. Im sure the cops are bing dicks somewhere in the town but for me that was a watershed moment. Cali is def. moving forward with some form of legalization. May not be what "everyone" can agree on but, its working out for me.

As for me and 25 sq feet? Check my thread and you get an idea of what I can work with in crowded spaces. You are only limited by your imagination and what you believe people tell you, you cant do. I do me! You do you and the world turns.
