Monday was not a good day for Democrat New Yorkers and Medical Cannabis:

Senate revolt could lead to legislative gridlock

Monday's Senate revolt has greatly increased the possibility that the waning days of this year's legislative session will be mired in the kind of partisan gridlock that has plagued past years

and another story on the same subject:

Republicans flip Senate

Senate Democratic leader Malcolm Smith called the session illegal and pledged to close the Senate until he could be assured there would be no "circus." He considered locking the chamber so Skelos and Espada did not try to convene.

But within an hour, Senate Democrats were reduced to de facto minority status and it seemed that the GOP had scored a victory.

So we have another serious hurdle to overcome, and I can only hope they do the right thing this year but again I am not very hopeful.

News from NORML a few moments ago.... Sums up current status.

New York: Legislation (Assembly Bill 7542) to exempt qualified medical cannabis patients from state arrest and prosecution continues to move through the state Assembly. So far, members of the Committees on Health, Codes, and Ways and Means have all signed off on the proposal, which is now before the Assembly Committee on Rules. A companion bill, Senate Bill 4041-A, remains pending before the Senate Committee on Codes.

I talked to reps for both Assembly Gottfried and Senator Duane today and things still look promising if they ever get started. In the Assembly, it is on the calendar for a vote, which they are sure will pass for a third straight year. In the Senate it is in Codes and could be brought for a vote at anytime. If both votes pass then it will go before the Governor who has stated he will not oppose the Law....

No I believe after Codes in senate it must then pass a floor vote. theres 10 days left for senate before they go on recess. After that it starts over again next year clean slate. New york is designed to eff up bills like this as bigdaddy was pointing out.

and there was some garbage the other day with republicans effing it ALL up again with this garbage

nothing against TRUE republicans (they are 1/100000 in my eyes). its the neoconservative fugks blowing the country down the tubes. even democrats in new york are rednecks

I have been sitting back watching this thread and the comments of posters here and I am struck with the similarities between the NY legislature and the IL legislature. Illinois also has a MMJ bill supposedly working it's way through the legislature and it too is stalled in the House because of bickering between politicians over the budget. The budget battle will end and we will have a budget,everyone knows this. What will not happen will be a vote in the House on the MMJ bill. After the budget battle all these politicians will adjourn and tell everyone how they worked hard for the people to pass a budget. Nothing will be said about how much time they wasted not doing something that could have been accomplished in weeks not months. Neither will they talk about all the other legislation they could have worked on but didn't.
No,they will come home and say,"I worked hard for you and I really deserve more money." Politicians show such a disregard for us the people they are supposed to represent that it disgusts me. But then it is because we who vote them into office show so little interest in what they do that causes them to act as they do.
At least there are some of you in NY who are trying to hold their feet to the fire and I commend you for that. My sympathies go out to those of you who are fighting the fight only to be beaten back again and again.
Things won't change until we the people understand that "POLITICIAN" is a dirty word.

Medical Marijuana Bill Moves Forward In New York
Legislation to exempt qualified medical cannabis patients from state arrest and prosecution is moving forward to the state Assembly.
Assembly Bill 7542 is now before the Assembly Committee on Rules. Members of the Committee on Health, the Committee on Codes, and the Committee on Ways and Means have each approved the measure.
A companion bill, Senate Bill 4041-A, is pending before the Senate Committee on Codes.
These measures would allow state-qualified patients to possess (up to two and one-half ounces) and cultivate (up to 12 plants) cannabis for medicinal purposes. The measures also seek to license non-profit organizations to manufacture and distribute marijuana to authorized patients.

Governor David Paterson of New York stopped short of endorsing the legalization of marijuana in his interview for my latest magazine piece: A Drug War Truce?

But the governor was astoundingly frank about the relative harmlessness of marijuana compared to pernicious (and legal) drugs, including alcohol.

You can only get the full version of the magazine piece in the physical magazine, but here is an extended version of the Governor’s remarks that you won’t find on any newsstand:

Rolling Stone: Politicians like Jim Webb and Governor Schwarzenegger have said, “Let’s debate this.” Let’s talk about whether marijuana should be brought in from the cold, as it were, for responsible adults. Where you stand on that?

Gov. Paterson: Marijuana always appeared to be a substance for which great punishment was meted out for very little demonstrated problem with the actual substance. You can really document what the excesses of alcohol have done on the roadways of our country; you can’t really do that with marijuana.

Our society is odd because we have this contempt for marijuana smoking, meanwhile people have access to pharmaceutical products that are just destroying them. The same people who rail about marijuana use are draped over a bar and then get in the car and kill people. I wouldn’t suggest driving under the influence of marijuana either [Laughs]. I’m just saying that we’ve always seemed to have an uneven policy.

At this particular time, when we’ve passed drug laws hopefully to help people and help fight addiction, I don’t know if I would want to support the legalization of marijuana. But I’d certainly be open to a conversation on the subject.

Monday is when the state senate breaks for Summer.

Patterson though said starting Tuesday if the senate does not come to agreements on the 31/31 stalemate for leadership then he would enact a special session every day, including weekends and the 4th if they do not come to an agreement breaking the stalemate.

Problem for us? He can not FORCE the senate to actually vote on anything. He can only hold them in session until they come to terms with the problems they are having with the 2 democrats who jumped party lines.

That means that although realistically he can keep them in session all summer, he can't actually force them to vote on any particular bills which means if the senate were to go into session and vote on a bill and pass it they could adjourn for the rest of the summer with out voting on the important Medical Marijuana Bill, Gay Marriage, or on the bill to reform Rockefeller laws.

In the end my personal "opinion" is that we will not see any progress in the senate in regards to medicinal cannabis. There is still a very very small glimpse of hope but from most things I have read, this bill will be one they are going to ignore. A letter I got back from my senator in response to a letter I sent him asking for legalization of both Cannabis and hemp. He stated that although he would back it, he doubts they would ever get it passed considering they can't even get the Medical Cannabis bill passed. He said he had high hopes this year that they would finally pass it, but those hopes were left with anger when he realized that this bill would most likely not reach a vote this year.

And everyone thought I was a negative Nelly.NY lags behind even Montana in being a state that leads.California is now that state.Used to be Ny but we now have a bunch of gutless,useless and uncompassion pieces of shitite,there ever were.I have written,e-mailed and called till my fingers are numb and my carpal tunnel returns.I am sorry we put such a bunch of back stabbing losers in office in NY State.Let them coe and arrest me for medicating.I have enough medical documentation that I would win a jury trial.And I'm not gonna die because of NY screwing its citizens over.I am seriously considering a move to Vermont where I would get a rec in seconds.This sucks bigtime.My trust is gone completely for this bunch.Fire the whole lot of them they are as usless at "tits on boar hog"Peace BigD

According to Mpp the Dems wrote up another bill they thought the Republicans would go for.It was written June 9th and there is a copy at Mpp.org-however the asshats that we elected still have not finished the "Peoples business".Maybe all of us NTers should send a clear message come election night-dont let the door hit ya on the ass on the way..OUT! :noway: I am new to NY,& would like to know. I asked someone & they said it was up to the judge. I also have a friend that was charged with 1g and went to jail, 1st charged:yoinks:

I think possesion up to 28grams in private is decriminalized.However public use or caught outside the home its more drastic.Throw me a bone here law experts! BigD
