Yup, BUSTED!

no, it was the LL. he came to the house hell bent on fixing this "leak" the day i got pinched. not to mention the detective was with him posing as a worker. the LL smelled a pungent odor the day before and went to the preceint the next morning.
still though, if i had 10,000 lets say for my defense, i still would be worried about the weapon. I mean, why allow them to find that? all because i wanna exercise my rights? fuck that dude, they think they got over on me, but in reality i got over on them. its one thing getting guns off the street, its another thing taking someones plants (that are not even blooming). what the hell did they accomplish besides causing a great inconvenience to me?
all these cops had to do was wait for 2 months and catch me wayyy off guard with 2 lbs bagged walking out the house...not to forget they could have followed me to my guy and had a R.I.C.O case. the person i deal with is a major distributor...so it could have been way worse. ill take this anyday

what do guys think would happen if someone was growing some plants and had some guns stored in a locked gunsafe? Do you think that would still be as serious?
we have the right to hold firearms, if the guns are legal you would have no problem unless they were in the same room as the grow

It's a first offense and not even a felony,to my surprise(85 plants)....so what are you worried about? Sounds like probation to me. Be ready for that PO to be stoppin by, whizz quiz's too. If you can't afford an atty. then see what kinda deal the DA will give you. Probably be about the same lawyer or not. Maybe they'll go as easy on you as the cops did. Do what they say and you'll be back in business in no time! Hopefully you'll learn from this lil experience....

Due to some turd bringing up the fact that i was busted to make himself look wise i guess i decided to update my case:
possession of marijuana paraphernalia charge- DISMISSED
possession of marijuana 4th degree- dropped down to a VIOLATION (disorderly conduct)
$220 FINE
21 HRS OF Community Service

You got extremely lucky. You took a gamble and only you know if that gamble was worth it and likely to be a smart move. It looks like you got off pretty damn easy so your gamble paid off.
Having said that, your gamble was exactly that! A gamble! If the cops decided to ignore the basement only and still found the pistol you were doubly screwed because you consented to the search and they'd just make up whatever they wanted to justify finding the pistol. Cops lie all the time. It's part of their job description. This is the X-factor when dealing with police. They can and will lie to obtain a warrant but they'll lie even easier after they are inside. You sign the paper and you just made their job much, much easier.
The rule of thumb is to never consent to a search, particularly if there's no "gamble" like you had the fortune of having. If the cop has to ask then he doesn't have a warrant and you only hang yourself by consenting. Same goes for your car. Never ride dirty "recreationally" (no pipes, no personal smoke, nothing). I'm glad your case worked out but you got extremely lucky and most people would not be so fortunate. There is a Bill of Rights for a reason. It should be used.

NEVER CONSENT TO A WARRANTLESS SEARCH.... I know this is easy to say this when bullshiting on a computer, but this is something we should all practice and run drills with our roommates ,wives,ect
I have a buddy that was out playing poker(2am) when the cops came knocking....his wife answered the door . the cops said they got a tip of a grow opp. I am so proud of my bro's wife for standing her ground and not letting the cops in. Naturally my bro freaked and came home and cleaned out the whole grow. but the cops never came back. they couldnt get a warrant ....and many times they cant without more evidence ....so they FISH or use the good cop/bad cop/ to get you to talk

Ok just IMO but if they searched your car without your consent tell your lawyer if you were not on probation they had no legal right unless you gave it to them. Your next grow wait tell you are off probation because they can and will do random searches. Home car what ever.

Great to hear that! Sounds like you made out very well. Smart choice about consenting but amazing they kept their word. Must have been a very specific search warrant for basement only, anyhow glad you got off easy.
You said earlier you have since talked to the LL, was he fairly cool about the whole situation? Sounds like you are pretty golden right now and I would consider approaching the LL for another round and include him in for a cut. I bet he may have a better reaction than most may think. From your wording it sounds as if he had some regret. Good luck and stay strong.

i think its the states way of keeping federal funding (yes feds will punish states for not upholding fed law) and not hurting the non violent marijuana offender

Here in the uk I would rather be caught in a house with 500 plants and stolen electricity than in a house with an illegal 9mm pistol,they would come down really heavy on you for the latter.

Why would you even open your door in the first place?I could have prevented them from coming in, but b/c my nasal passages are not as sensitive, i really thought i was safe.
Just so you know... you made a STUPID choice and got really lucky. Please do not think to yourself that you made the correct choice. They could have just as easily found the pistol and then you'd be totally screwed because you gave them consent. If you never consented... you would have never got busted. NEVER EVER EVER give consent no matter WHAT the cop says. Let the attorneys deal with it; you NEVER help yourself by consenting. If you had not caved in, the cops may NOT have found a judge willing to sign off on the mere smell..alleged smell..and you may have walked. If the cops CAN get a warrant, LET THEM!! So many people here tell the tale of finally giving in and consenting and it cannot help them no matter what.

Im not here to bash you in the slightest way. BUT i hope you have learned your lesson about smell protection, you said you had none because you couldnt honestly smell it......It doesnt matter if you can smell it, you're growing the plants, OTHER PEOPLE MATTER. Hope all turned out ok.

ok if bodies suggest that the gun was used to kill someone, then why the fuck would you own it? further more why would someone who committed a capitol offence using this gun, sell it (easy to trace back) or keep it at all???? sounds really wack....let me ask you something do you or the person you got the gun from have a poster of "scarface" hanging somewhere?
